DIRITTI D’ASTA:
sono pari al 15% del prezzo di aggiudicazione, oltre ad iva se dovuta.
ISCRIZIONE E CAUZIONE
Ogni concorrente dovrà iscriversi sottoscrivendo l’apposito modulo e
contestualmente versando un deposito cauzionale infruttifero pari ad
€ 10.000 in contanti o assegno circolare oppure tramite una garanzia
bancaria a prima richiesta dell’importo minimo di euro 50.000,00
(EUROCINQUANTAMILA) intestata a M.C.I.AUCTION srl a garanzia del
pagamento del prezzo. In caso di mancata aggiudicazione la cauzione
verrà restituita al termine della gara.
PAGAMENTO:
Il pagamento del prezzo di aggiudicazione maggiorato dai diritti
d’asta, dovrà avvenire a mezzo assegno circolare emesso da una
banca o tramite bonifico bancario, tassativamente entro 15 giorni
dall’aggiudicazione. Il mancato pagamento del prezzo nel termine
indicato comporterà la risoluzione di diritto della vendita, che si intenderà nulla, e l’incameramento della cauzione a titolo di penale.
I bonifici dovranno essere effettuati a valere sul c.c. intestato a M.C.I.

I partecipanti all’asta potranno esaminare i beni nei giorni stabiliti
Con la partecipazione all’asta il concorrente ammette di aver esaminato il bene, di averlo trovato di suo gradimento, e di volerlo acquistare “come visto e piaciuto” senza possibilità di reclami. I dati tecnici
e gli anni di fabbricazione sono dati a titolo indicativo.
SVOLGIMENTO DELL’ASTA
L’Asta si terrà in tornata unica .I lotti saranno aggiudicati al miglior
offerente.
La gara si svolgerà mediante offerte al rialzo, orali per alzata di mano,
mediante rialzi minimi dal 5% al 10% rispetto all’offerta precedente, a
seconda dei lotti. Il banditore si riserva la facoltà di rifiutare offerte
inferiori al prezzo di riserva.
RESPONSABILITA’
Gli aggiudicatari sono responsabili dei propri lotti a partire dal
momento in cui l’aggiudicazione è stata pronunciata e dovranno
conseguentemente provvedere ad assicurare gli stessi I banditori non
possono essere ritenuti responsabili per eventuali scomparse e/o
deterioramenti. Dovranno smontare e caricare le macchine a carico
loro il 30 di giuono 2011 al più tardi, dopo l'aggiudicazione in accordo
con TIFITESS. Il ritiro potrà essere effettuato solo dopo l’integrale
pagamento del prezzo e dei diritti d’Asta. Lo smontaggio dovrà essere
fatto a regola d’arte, da personale qualificato e nel rispetto delle
norme sulla sicurezza sul lavoro. Eventuali danni cagionati a terzi, ad
altri beni o ai locali durante le predette operazioni resteranno a carico
dell’aggiudicatario.
ASTA
L’asta ufficiale si svolgerà in lingua italiana e sarà soggetta alla legge
italiana. In caso di contestazione sulla traduzione del testo del bando
in altre lingue prevarrà il testo in lingua italiana.
In caso di traduzione non sarà ammessa nessuna contestazione per
errori o incomprensioni.

INSCRIPTIONS ET CAUTIONS
Les amateurs doivent s’enregistrer et régler une caution bancaire de
bonne fin de 10.000 € soit en espèces, soit par un chèque émis directement sur une banque européenne, soit présenter une garantie bancaire d’un montant minimum de 50.000 € à l’ordre de MCI AUCTION
Srl.
S’il n’y a pas d’adjudication, ce montant sera restitué à la fin de la
vente.
PAIEMENT
Le paiement du prix d’adjudication augmenté des frais de vente
devra être effectué par un chèque de banque ou par virement bancaire au plus tard 15 jours après l’adjudication.
Le non respect des conditions de paiement aura pour effet la résolution de l’adjudication qui sera considérée comme nulle, les acomptes
seront conservés par la société de vente à titre de pénalité.

Les matériels sont vendus dans l'état où ils se trouvent, sans réclamation.
Une exposition préalable permettant aux acquéreurs de se rendre
compte de l'état des biens mis en vente, il ne sera admis aucune réclamation une fois l'adjudication prononcée. Les renseignements techniques et les années de fabrication ne sont donnés qu'à titre indicatif.
La vente aura lieu en une seule vacation. Les lots seront adjugés au
meilleur enchérisseur.
RESPONSABILITE
Les adjudicataires sont responsables de leurs lots dès l'adjudication
prononcée. Les Commissaires Priseurs ne peuvent être tenus pour responsables d'éventuelles disparitions et détériorations. Malgré cette
facilité les adjudicataires conservent l'entière responsabilité des
matériels qu'ils ont acquis, de leur démontage dans les règles de l'art,
de leur enlèvement, ainsi que des dommages qu'ils pourraient occasionner aux matériels des autres adjudicataires, ou aux bâtiments. Les
acquéreurs feront leur affaire personnelle de l'assurance des biens
acquis dès l'adjudication.
Les adjudicataires devront démonter et charger la marchandise à leur
frais au plus tard le 30 Juin 2011 après l’adjudication en accord avec
TIFITESS. Le démontage devra être effectué dans les normes de sécurité
du travail et de l’environnement
ENCHERES
Les enchères officielles seront portées en langue italienne et soumises à la loi
italienne. En cas de traduction aucune contestation ne sera admise pour
erreur ou incompréhension. Les Commissaires Priseurs se réservent le droit
de refuser une enchère insuffisante.
En général une surenchère devra excéder la précédente de 5% à 10%.
Le Commissaire Priseur se réserve la faculté de refuser des enchères inférieures
au prix de réserve.

AUCTION FEES:
they represent 15% of the adjudication price, adding VAT if necessary.
APPLICATION FOR ADMISSION AND CAUTION
Each competing has to register by signing a special form and contextually by paying a security for an amount of €10.000. This one has to
be paid by cash, by cheque issued directly by a bank, or with a bank
guarantee for proper execution of a minimum amount of € 50.000,00
(Euros FIFTYTHOUSAND) to the holder M.C.I.AUCTION srl, as guarantee of the price payment. In case of no adjudication, the security will
be returned at the end of the auction.
PAYMENT
The payment of the adjudication price, increased with the auction
fees, will have to be settled by cheque directly issued by a bank, or by
bank transfer, imperatively within 15 days from the adjudication. The
non-respect of the payment terms will entail the cancellation of the
selling right, which will be considered as null, and the appropriation
of the security for legal action.

GARANTEES
The participants in the auction could inspect the goods during the
fixed dates. With his participation in the auction, the competing
admits to have inspected the goods, to have accepted them as they
are, and to want to buy them as “seen and approved”, without possibility to claim. The technical information and the years of construction
are given for information only.
CARRYING OUT OF THE AUCTION
The auction will be done in a single sitting. The lots will be adjudicated to the best bidder. The auction will be carried out through upward
offers, in oral by show of hands, with minimum upwards from 5% to
10% compared to the previous offer, depending on the lots. The auctioneers have the possibility to refuse offers which are lower than the
minimum price which has been fixed.
RESPONSIBILITY
The purchasers are responsible for their lots as soon as the adjudication is announced and, consequently, they will have to insure the
goods. The auctioneers cannot be considered responsible for possible disappearances and/or deteriorations.
The purchasers will have to dismantle and load the machines at their
own expenses on the 30 June 2011 at the latest, after the adjudication
in agreement with TIFITESS spinning plant.
The collecting will be done only after complete payment of the price
and the auction fees. The dismantling must be made with care, by
competent skilled staff, respecting all work safety rules. Eventual
damages done by third party to other goods or to the places during
the above mentioned operations will be payable by the purchaser.
AUCTION
The auction will be done in Italian language and will be subject to the
Italian law. In case of claims about the translation of the notice text in
other languages, the Italian text will be considered as prevalent.
In case of translation, no claims will be accepted for mistakes and
misunderstandings.
