Mercoledì 20 gennaio 2016 Per maggiori informazioni: [email protected] Legge di stabilità 2016 Principali novità sulle imposte dirette Italian Stability Law 2016 Main corporate income tax changes In data 30 dicembre 2015 è stata pubblicata sulla Gazzetta Ufficiale la Legge di Stabilità 2016 (Legge 28 dicembre 2015, n. 208). Di seguito un elenco delle principali modifiche in materia di imposte dirette. On December 30, 2015, the Stability Law 2016 (Law December 28, 2015, no. 208) was published on the Official Gazette. Please see below a list of the main corporate income changes. Aliquota IRES. L’aliquota IRES è ridotta dal 27,5% al 24%, a decorrere dal periodo d’imposta successivo al 31 dicembre 2016. Di conseguenza, con effetto dal suddetto periodo di imposta è anche rideterminata dall’1,375 all’1,20% l’aliquota della ritenuta sugli utili corrisposti a società ed enti soggetti a imposta sul reddito delle società residenti in uno Stato membro della UE o in uno Stato aderente all’Accordo SEE. IRES tax rate. The corporate income tax rate is reduced from 27.5% to 24%, with effect from the tax period following December 31, 2016. As a result, for the same FY the rate of the withholding tax on dividends paid to companies and entities, resident in a EU member State as well as in a State part of the EEA Agreement, subject to corporate income tax is reduced from 1.375% to 1.20%. Per i soggetti titolari di reddito d’impresa e per gli esercenti arti e professioni che realizzano investimenti in beni materiali strumentali nuovi dal 15 ottobre 2015 al 31 dicembre 2016, il costo di acquisizione subisce una maggiorazione del 40% ai fini delle imposte sui redditi solo con riferimento alla determinazione delle quote di ammortamento e dei canoni di locazione finanziaria. Super-depreciation. For corporations and professionals carrying out investments in new tangible assets from October 15, 2015, to December 31, 2016, the purchase cost is notionally increased by 40% for the determination of tax depreciation and lease fees for corporate income tax purposes (i.e. IRES). Sanzioni amministrative. È stata anticipata dal 2017 al 2016 l’entrata in vigore del nuovo regime sulle sanzioni amministrative, ridefinite con il Decreto Legislativo n. 158/2015. Administrative penalties. The enactment of the new administrative penalties regime as defined by the Legislative Decree no. 158/2015 has been anticipated from FY 2017 to FY 2016. Credito d’imposta per beni strumentali. È attribuito un credito d’imposta alle imprese che acquistano beni strumentali nuovi destinati a strutture produttive ubicate nel Mezzogiorno d’Italia dal 1° gennaio 2016 fino al 31 dicembre 2019. Tax credit on assets. A tax credit for companies purchasing new assets intended to manufacturing facilities located in Southern Italy from January 1, 2016, to December 31, 2019, has been introduced. Riallineamento operazioni di aggregazioni aziendali. È introdotta la possibilità di ridurre il periodo di ammortamento previsto per l’avviamento e i marchi d'impresa da 10 a 5 quote. L’opzione si applica alle operazioni di aggregazione aziendale poste in essere a decorrere dall’esercizio successivo al 31 dicembre 2015. Realignment operations of business combinations. The option to reduce from 10 to 5 periods goodwill and trademarks depreciation has been introduced. The election applies to business combinations carried out from the period following December 31, 2015. Termine per gli accertamenti fiscali. Sono prolungati i termini per l’accertamento delle imposte sui redditi come segue: a) al 31 dicembre del quinto anno successivo a quello in cui è stata presentata la dichiarazione; b) al 31 dicembre del settimo anno successivo a quello in cui la dichiarazione avrebbe dovuto essere presentata, nel caso di omessa dichiarazione. È inoltre eliminata la norma che raddoppia i termini per l’accertamento delle imposte sui redditi ove sussista una violazione che comporti obbligo di denuncia per i reati tributari. Le novità si applicano a partire dagli avvisi di accertamento relativi al periodo d’imposta in corso al 31 dicembre 2016. Statute of limitations. Deadlines for corporate income taxes assessment are extended to: a) December 31 of the fifth year following the year in which the return has been filed (previously the fourth year); b) December 31 of the seventh year following the year in which the return would have been filed, in case of omitted return (previously the fifth year). Also, the rule doubling the terms of assessment for income tax purposes in case of an infringement that involves obligation to report for one of the tax offenses. New rules apply starting from tax assessment notices referred to the tax period in progress as at December 31, 2016. Operazioni con Paesi “black list”. È abrogata la disciplina relativa ai costi “black list”. Con riferimento alla disciplina sulle CFC, non si fa più riferimento ai paesi “black list” mentre si considerano regimi fiscali privilegiati quelli in cui il livello nominale di tassazione risulta inferiore al 50% di quello applicabile in Italia. Sono esclusi dall’applicazione della disciplina gli Stati o territori appartenenti all’UE e quelli aderenti all’Accordo SEE con i quali l’Italia abbia stipulato un accordo che assicuri un effettivo scambio di informazioni. Le disposizioni si applicano a decorrere dal periodo d’imposta successivo a quello in corso al 31 dicembre 2015. Transactions with “black list” countries. Rules governing “black list” expenses are repealed. As for CFC rules, reference is no longer made to “black list” countries and it is provided that tax havens are those countries where the nominal level of taxation is lower than the 50% of the one applicable in Italy. Such provision is not applicable to companies resident in EU or EEA States having established agreements for effective exchange of information. The rule apply starting from the tax period following the one ongoing as at December 31, 2015. Addizionale IRES per il settore creditizio/Deducibilità interessi passivi. È introdotta un’addizionale IRES del 3,5% per gli enti creditizi e finanziari. Inoltre, per i medesimi soggetti sono resi integralmente deducibili dall’IRES e dall’IRAP gli interessi passivi. Resta inalterata la deducibilità al 96% per le imprese di assicurazione. Tali disposizioni trovano applicazione a decorrere dal periodo d’imposta successivo al 31 dicembre 2016. IRES surtax for financial entities/Deductibility of interest expenses. It is provided a 3.5% IRES surtax for banks and financial entities. Also, interest expenses for the above-mentioned entities is fully deductible for IRES and IRAP purposes. No changes for insurance companies (i.e., interests deduction remains limited to 96%). These provisions apply as from the tax period following December 31, 2016. Country-by-country reporting Per le società controllanti residenti, obbligate a predisporre il bilancio consolidato e che conseguono un fatturato di gruppo di almeno 750 milioni di Euro, è introdotta una rendicontazione Paese per Paese che riporta l’ammontare dei ricavi, degli utili lordi, delle imposte pagate e maturate, etc. Le disposizioni applicative saranno emanate con apposito decreto. Country-by-country reporting Country-by-country reporting has been introduced for resident parent companies of group that are obliged to file consolidated financial statements, with consolidated revenues in previous year at least of Euro/M 750.
