Directive 2009/103/EC
of the European Parliament and of the Council of 16 September 2009 relating to
insurance against civil liability in respect of the use of motor vehicles, and the
enforcement of the obligation to insure against such liability.
The Directive 2009/103/EC of the European Parliament and of the Council of 16 September 2009 relating to
insurance against civil liability in respect of the use of motor vehicles, and the enforcement of the obligation to
insure against such liability requires all Member States to set up or authorize a body with the task of providing
compensation to both damage to property and personal injuries when the insurance undertaking cannot be
identified, for instance for damage caused by an unidentified vehicle, or when the insurance undertaking
cannot be satisfied.
The minimum amounts covered by the compulsory liability policy for personal injury are EUR 1 000 000 per
victim or EUR 5 000 000 per claim, whatever the number of victims, and for property damage, EUR 1 000 000
per claim, whatever the number of victims.
The directive also states the compensation for non insured parties victims of an accident in
which a motor vehicle is involved.
Thus pedestrians, cyclist, and other non-mortised users of the road , if they are holders of the compulsory
policy against civil liability in respect of the use of motor vehicles, are still eligible of indemnities for personal
injuries and damage to property.
The following table lists the Motor Vehicles Compensation Bureaus of the European Union Member States, - as
available through The Council of Bureaux, the Managing Organization of the Green Card System and of the
Motor Insurance Directives and through the National Contact Points list available at Insurance Europe, the
European (re)insurance Federation, - and the Member States Legal Framework according to the references
available from the Member States Motor Vehicle Compensation Bureaus and from the statutory laws of the
European Union Member States.

Besides the Guarantee Fund for the Traffic Victims, France legislates several guarantee funds which
provide additional compensations for damages to victims of crimes. The guarantee funds
considered are the Commission d'Indemnisation des Victimes d'Infractions, CIVI and the Fondation
