Per difendere gli ecosistemi minacciati da forme sempre più transnazionali di
inquinamento è nata la Fondazione SEJF ONLUS (Supranational Environmental
Justice Foundation).
Tra le iniziative che la SEJF promuove ci sono:
t l’istituzione della Corte Penale Internazionale dell’Ambiente
che prevede l’ampliamento delle attuali competenze della Corte Penale Inter
nazionale. La proposta è di considerare il grave reato ambientale intenzionale
transfrontaliero quale crimine contro l’umanità.
t l’istituzione di un Tribunale Europeo contro i crimini ambientali
che dovrà assicurare un sistema di giustizia penale atta a garantire sanzioni in
base al principio del “chi inquina paga”, attraverso la creazione di una sezione
specializzata della Corte di Giustizia o di un tribunale specializzato della General
Court.
