SCOPO

SCOPE
Scopo di questa procedura è descrivere e disciplinare le
attività da svolgersi e le responsabilità dei soggetti coinvolti
nel caso di affidamento dei lavori in Appalto, o Prestazione
d’Opera, o Somministrazione.
The aim of this procedure is to describe and regulate the
operations to be carried out and the responsibilities of the
persons involved when works are tendered or contracted
out.

CAMPO DI APPLICAZIONE
Questa procedura si applica nel caso in cui vengano affidati
dei lavori all'interno della azienda committente, nonché
nell'ambito di tutte le sue unità produttive e di cantieri
temporanei.
2.1
AREA OF APPLICATION
This procedure applies when work is tendered out and has to
take place on company premises, at any of the production
units and on temporary sites.
Definizioni
2.1
Definitions
Tutti i termini con iniziale maiuscola utilizzati nella presente
procedura recheranno il seguente significato:
All the capitalized terms used in this procedure shall have
the following meaning:

Contratto d’opera – art. 2222 c. c.
Contratto nel quale una persona si obbliga a compiere
verso un corrispettivo un’opera o un servizio con lavoro
prevalentemente
proprio
e
senza
vincolo
di
subordinazione. Il lavoro viene svolto da un prestatore
d’opera autonomo, o dal titolare di una ditta individuale.

Work contract – article 2222 of the civil code
A contract by means of which a person not employed by
the company is obliged to carry out work or provide a
service in exchange for payment. The work is done by a
freelance professional or the owner of a single-person
company.

Contratto

A contract in which one party takes on responsibility for
carrying out work or providing a service in exchange for
payment, with the organisation of the resources
necessary and the management of the contract at its
own risk.
Il lavoro viene svolto da personale dipendente e/o
collaboratori di altre imprese.
The work is carried out by the employees and/or
collaborators of other companies.
Il contratto intercorrente tra le Aziende prevede l’attività
da svolgere e i soggetti incaricati del lavoro, che devono
essere
identificati
e
coincidenti
con
quelli
preventivamente dichiarati.

Contratto di somministrazione – art. 1559 c.c.
Contratto nel quale una parte si obbliga, verso
corrispettivo di un prezzo, a eseguire, a favore dell’altra,
prestazioni periodiche o continuative di cose e di servizi
– rif. art. 1677 c.c.).
The contract stipulated by the companies specifies the
operations to be carried out and the parties who will do
the work, who have to be the same as those previously
declared.

In questo caso devono essere evidenziati i costi relativi
alla sicurezza. Nell’ipotesi di somministrazione lavoro, vi
è responsabilità solidale con l’Agenzia somministratrice
di lavoro ai fini dell’adozione delle MMS.
In this case, the safety costs have to be set out. When
works are supplied, the company and the works supply
agency are jointly responsible for the adoption of the
preventive measures.
Il contratto intercorrente tra l’Azienda e l’Agenzia
prevede l’attività da svolgere, la verifica da parte
dell’Agenzia della avvenuta redazione del Documento di
Valutazione del Rischio dell’Azienda che deve anche
indicare i costi relativi alla sicurezza del lavoro di cui
all’Allegato D.

Permesso Di Lavoro
Autorizzazione al lavoro per comunicare all’esecutore
che sono state adottate precauzioni di sicurezza e salute
per l’esecuzione dello specifico lavoro indicato nel
Permesso.

The contract between the company and agency specifies
the work to be carried out, and the checks required by
the agency on the drafting of the company risk
assessment document, which also has to indicate the
safety costs specified in annexe D.

Operations to be carried out by the
employer, managers and supervisors
Il DdL e/o il Dirigente procedono in via preventiva
all’identificazione dell’attività e degli operatori, con la stipula
di opportuno contratto(1), e previa verifica della idoneità
tecnico-professionale delle imprese appaltatrici o dei
lavoratori autonomi, anche attraverso l’iscrizione alla
CCIAA(2).
The employer and/or manager will first identify the work
required and the operators by means of a specific contract (4)
and checks on the technical and professional suitability of
the tendering companies or freelance workers, which may
involve examining the Chamber of Commerce registration (5).
4.1
Attività di competenza del,
Lavoro, Dirigenti, Preposti
Datore
Come regola generale, l’attività viene preceduta da un
sopralluogo
congiunto nell’area interessata,
per la
definizione di tutti gli aspetti operativi e le implicazioni di
sicurezza conseguenti, compresi gli eventuali rischi di
interferenza.
Al termine del sopralluogo viene redatto il verbale di cui al
fac-simile in Allegato E.
All’ingresso in Azienda il personale deve essere in ogni caso
identificato, e deve esporre la tessera di riconoscimento
corredata di fotografia, degli elementi identificativi del
lavoratore e della azienda per cui lavora.
In ottemperanza all'art. 26 dal D.Lgs. N°81 del 9 Aprile 2008
il DdL o il Dirigente applica le Procedure di Sicurezza da
Interferenze di cui all’Allegato B e, in conseguenza, assicura che a tali lavoratori esterni siano fornite dettagliate
informazioni su:
rischi specifici esistenti all'interno dell’ambiente di lavoro
in cui sono chiamati ad operare
misure
di
prevenzione
ed
emergenza
adottate
dall’azienda,
mediante compilazione del Documento contenente la
Valutazione dei Rischi da Interferenze - DUVRI – anche con il
personale della propria Azienda, utilizzando il MOD 2 o il MOD

Nel caso in cui l’attività in appalto rientri, anche
successivamente, nelle ipotesi previste dalla normativa
cantieri (D.Lgs 81/08 – Titolo IV, All. 10), il Committente
provvede alla nomina dei Coordinatori per la Sicurezza di
progetto e di esecuzione, ed assicura l’applicazione della
Procedura di Cantiere specifica.
I Preposti ricevono copia delle istruzioni ed informazioni
fornite alle aziende appaltatrici ed ai lavoratori autonomi e
As a general rule, an on-site inspection is first carried out, to
define all the operating aspects and consequent safety
implications, including any risks due to interference.
On completion of the on-site inspection, a report similar to
the one contained in annexe E is drawn up.
Upon entering company premises, the personnel have to be
identified and have to show their pass with photograph and
the identity details of the workers and the company
employing them.
Pursuant to the terms of article 26 of legislative decree 81 of
9th April 2008, the employer or manager applies the Safety
Procedures Due to Interference set out in annexe B, which
means that the outside workers have to be given detailed
information on:
specific risks within the workplace in which they have to
operate,
the preventive and emergency measures adopted by the
company,
the document containing the assessment of risks due to
interference (DUVRI), including interference with
personnel from their own company, which is drawn up in
form 2 or form 5.
If the work tendered out falls within the hypotheses
considered in the site regulations (legislative decree 81/08 –
Section IV, Annexe 10), either right from the start or at a
later date, the customer will nominate the safety
coordinators for the design and execution stages and ensure
that the specific site procedure is applied.
The supervisors receive a copy of the instructions and
information supplied to the tendering companies and
freelance workers and ensure their correct application within
their areas of responsibility, with the updating of forms 2
and 5.

sovrintendono, per quanto di loro competenza, alla loro
corretta applicazione, assicurando l’aggiornamento dei MOD
2 e MOD 5.
4.2
Attività di competenza del Gestore
Il Gestore assicura che la Scheda di informazione sui rischi
di incidente rilevante di cui all’all. V del D.Lgs. 334/99
(ALLEGATO H) venga trasmessa agli appaltatori la cui
attività si svolge presso le aree operative aziendali del
Terminale Offshore, delle Valvole di Blocco e della Stazione
di Misura di Cavarzere

Il DdL, in relazione alle attività a cui si applica la presente
procedura procede, in collaborazione con le figure aziendali
preposte e il Responsabile Servizio Prevenzione e Protezione
(RSPP), alla verifica dei rischi di interferenza esistenti negli
ambienti interessati all’attività appaltata, come risultanti dal
Documento di Valutazione dei Rischi (VdR) vigente in
Azienda e dallo scambio di informazioni con l’Appaltatore con
il supporto del crono-programma.
Nell’organizzazione di lavoro, con il supporto della
Valutazione dei Rischi da Interferenze di cui all’Allegato A,
sono individuati i rischi e le conseguenti Misure di
Prevenzione come riportato nel MOD 6.

ANALISI DEI RISCHI
RISK ANALYSIS
The employer, supervisors and head of the prevention and
protection service (RSPP) assess the risks due to
interference that exist in the areas where the work subject
to this procedure is to be carried out, as specified in the risk
assessment document in force at the company and on the
basis of the exchange of information with the contractor with
a view to drawing up the time schedules.
When the work is organised, the risks and consequent
preventive measures are identified, as specified in form 6,
with the support of the risks due to interference assessment
contained in annexe A.

MEETING OF THE PREVENTION AND PROTECTION
SERVICE (SPP)
Se necessario, il RSPP convoca una riunione del SPP per la
definizione delle misure di protezione e prevenzione da
adottarsi nella fattispecie.
If necessary, the RSPP will arrange a meeting of the SPP to
lay down the protection and prevention measures to be
adopted in the case in question.
Alla riunione sono presenti, oltre all’ RSPP o suo delegato:

Tutti gli altri soggetti potenzialmente interessati alle
specifiche attività.
Nella riunione vengono definite le misure da adottare per
evitare o ridurre i rischi associati alla mansione dei
lavoratori, se del caso anche modificando temporaneamente
le condizioni e l'orario di lavoro.
Se l’attività oggetto dell’appalto si svolge presso le aree
operative aziendali del Terminale Offshore, delle Valvole di
Blocco e della Stazione di Misura di Cavarzere, ai fini della
prevenzione dei rischi di incidente rilevante, nella riunione
vengono illustrati i contenuti della scheda di informazione
alla popolazione di cui all’V del D.Lgs. 334/99 e s.m.i.
Al Verbale della Riunione viene allegato il documento
contenente le misure adottate ivi comprese le misure di
prevenzione e sicurezza relative ai rischi di incidente
rilevante, ove pertinenti.

Il documento contenente le misure adottate citato al punto 6
o le prescrizioni pertinenti da esso derivate, sono trasmesse
di norma dall’RSPP ai responsabili delle unità interessate,
che devono essere identificati per la specifica attività
mediante specifica lista di distribuzione.
I responsabili delle attività devono assicurarne la
distribuzione ai lavoratori coinvolti. L’esecutore non potrà
iniziare il lavoro se non in possesso del Permesso di Lavoro,
rilasciato dal Referente ALNG.

Terminal, Block Valves and Metering Station areas, in order
to prevent major accident risks, the meeting agenda will
included the information sheet on major accident hazards
(Annex V to Legislative Decree no. 334/99 as amended by
Legislative Decree no. 238/05)
The document specifying the measures adopted, major risk
accident risk prevention and safety related measures
included where applicable, will be attached to the minutes of
the meeting.

NOTIFICATION TO PERSONS IN CHARGE AND
INFORMATION FOR WORKERS
The document containing the measures adopted as
mentioned in point 6 or the instructions deriving from these
are normally sent by the RSPP to the heads of the units
involved, who have to be identified by means of a specific
distribution list. The persons in charge of the operations
have to ensure that this document is distributed to the
workers involved. The work cannot begin until the contractor
is in possession of the work permit issued by the ALNG
representative.

Contratto d’opera
La idoneità tecnico-professionale del lavoratore deve
essere preventivamente documentata anche con
l’iscrizione alla CCIAA e eventualmente attraverso
l’autocertificazione(3). Viene compilato il MOD 1.

Work contract
The technical and professional suitability of the
worker has to be documented in advance, possibly by
means of the Chamber of Commerce registration or
self-certification (6). Form 1 is filled in.

Contratto d’appalto
L’Impresa appaltatrice provvede a comunicare i dati
relativi al personale impiegato, ed la documentazione
prevista al MOD 3, comunicando altresì le proprie
Procedure Operative di Sicurezza (POS) per l’attività
contrattuale. Viene compilato il MOD 3.

Tender contract
The contractor passes on the details of the personnel
to be used and the documentation specified in form
3, along with notification of its operating safety
procedures (POS) for the operations to be carried out.
Form 3 is filled in.

Contratto di somministrazione
Il contratto intercorrente tra l’Azienda e l’Agenzia
prevede l’attività da svolgere, la verifica da parte
dell’Agenzia della avvenuta redazione del Documento
di Valutazione del Rischio dell’Azienda che deve
anche indicare i costi relativi alla sicurezza del lavoro
di cui all’Allegato D.

Supply contract
The contract stipulated between the company and
agency specifies the work to be carried out and the
check carried out by the agency on the drafting of the
company risk assessment document, which also has
to indicate the safety in the workplace costs as
specified in annexe D.

Allegato alla presente Vi trasmettiamo nostra Procedura “Lavoratori esterni chiamati a prestare la loro
opera presso la nostra unità produttiva di _____________________”, che Vi preghiamo di voler restituire
controfirmata per accettazione prima dell’ingresso dei lavoratori della Vostra società nei nostri locali.
Per tutti i lavori affidatiVi, da eseguire all’interno del nostro insediamento dovranno a cura e
responsabilità della Vostra Società, essere rigorosamente osservate le norme di prevenzione infortuni di
cui a dal D.Lgs. N°81 del 9 Aprile 2008, Direttive CEE specifiche in materie di sicurezza e igiene del
lavoro già recepite, Legge 123/07, nonché le prescrizioni riportate nella nostra Circolare “Lavoratori
esterni chiamati a prestare la loro opera”, allegata alla presente.
Sarà, inoltre, Vostro obbligo provvedere alla distribuzione delle copie al personale che dovrà accedere al
nostro insediamento per i lavori assegnati, accertando la sottoscrizione di avvenuta presa visione e
l’impegno al rispetto più completo delle disposizioni in essa contenute.
È facoltà della nostra azienda richiamare in qualsiasi momento l’osservanza di tali disposizioni e di
prescrivere altresì l’allontanamento del personale che non si attenga scrupolosamente alle stesse. Il
Responsabile dei lavori o suo sostituto, dovrà far osservare le disposizioni indicate e sarà ritenuto
responsabile ad ogni effetto della loro inosservanza.
La Vostra società si impegna altresì fin da ora, per allora, ad assumere ogni iniziativa e adempimento
necessario a sollevare la nostra Società da ogni pretesa risarcitoria per danni che si volesse avanzare
per l’attività prestata presso la nostra Società da Vostri dipendenti e/o personale connesso a detta
attività.
In osservanza dell’art. 26 del D.Lgs. N°81 del 9 Aprile 2008 , con la presente la ALNG Vi fornisce
puntuali informazioni sui rischi specifici esistenti nell’ambiente in cui sarete destinati ad operare e sulle
misure di prevenzione ed emergenza adottati in relazione alle proprie attività.
In osservanza dell’all. V al D.Lgs. 334/99, ALNG Vi fornisce informazioni sui rischi di incidente rilevante,
ove presenti, nei siti in cui sarete destinati ad operare (Terminale offshore, Valvole di blocco e stazione
di Misura di Cavarzere)
Rimane peraltro comune l’impegno allo scambio di reciproche informazioni, per coordinare gli interventi
di prevenzione e protezione ritenuti necessari, anche al fine di eliminare rischi dovuti alle interferenze tra
i lavori delle altre eventuali imprese coinvolte nell’esecuzione dell’opera complessiva.

Information and notifications on safety within the company

Please find attached a copy of our procedure on “Outside workers operating in our
_____________________ production unit”. Please return this to us signed for acceptance before your
workers enter our premises.
All the work to be carried out by yourselves on our premises has to take place on the basis of the
accident prevention regulations set out in legislative decree 81 of 9th April 2008, the specific European
directives on safety and hygiene and the workshop incorporated into Italian legislation, law no. 123/07,
and the instructions in our circular entitled “Services rendered by outside workers”, attached to this
document.
Please also ensure that copies are distributed to the workers who have to enter our premises to carry out
the work. The employees in question should sign these copies for acceptance and as a declaration of
their agreement to adhere strictly to the regulations they contain.
We have the right to insist on the observance of these regulations at all times, and to have any
personnel who fail to do so removed from the premises. The works manager or person acting on his
behalf will ensure that the regulations are observed and will be held responsible for all the consequences
of failure to do so.
You also hereby agree to adopt all the initiatives and measures necessary to hold us harmless in the
event of any claims for damages that might be presented against us by your employees and/or other
personnel in connection with the operations to be carried out.
Pursuant to the terms of article 26 of legislative decree 81 of 9th April 2008, ALNG hereby provides you
with information on the specific risks existing in the environment in which you will be operating, and the
preventive and emergency measures adopted in this regard.
Pursuant to the terms of annexe V of the legislative decree 334 of 17th August 1999, ALNG hereby
provides you with information on major accident hazards where existing in the installations in which you
will be operating (Terminal offshore, Block Valves and metering Station)
We are in any case bound by a mutual exchange of information, with a view to coordinating the
preventive and protective actions required. This also extends to the need to eliminate risks due to
interference between any other companies that might be present on the premises at the same time.
