Giovedì 30 giugno 2016 Per maggiori informazioni: [email protected] Avvocato generale – Pro rata IVA incompatibile con le norme UE Opinion of Advocate General – VAT pro rata not in line with the EU Directive di Luca Lavazza e Alessia Angela Zanatto In data 29 giugno 2016 sono state pubblicate le conclusioni dell’Avvocato Generale in merito alla Causa Mercedes Benz Italia (C-378/15). On June 29, 2016, the opinion of the Advocat General regarding Mercedes Benz Italia case was published (C-378/15). La domanda di pronuncia pregiudiziale, ad opera della Commissione Tributaria Regionale di Roma, è relativa alla valutazione della compatibilità UE del pro rata IVA nazionale (artt. 19, comma 5, e 19bis, d.P.R. n. 633/1972), così come interpretato dall’Amministrazione finanziaria italiana. Il pro rata in Italia, come noto, si applica all’IVA assolta su tutti gli acquisti di beni e servizi (e non solo a quelli c.d. “promiscui”). The request from a preliminary ruling, from the second tier tax Court of Rome, regards whether the Italian VAT pro rata, as interpreted by the Italian tax authorities, is in line with the EU Directive (articles 19 (5) and 19-bis, Presidential Decree no. 633/1972). As known, the pro rata calculation applies to all purchases of goods and services (and not only to the promiscuous ones). Il rinvio pregiudiziale, sollecitato da Mercedes Benz S.p.A. (di seguito “Mercedes Benz” o “Società”), trova la sua origine da una contestazione mossa nei confronti dell’Agenzia delle Entrate in merito al conteggio dell’IVA detraibile da parte della Società. In breve, Mercedes Benz aveva escluso dal calcolo del pro rata di detrazione gli interessi da finanziamenti verso società controllate in quanto aveva considerato tali operazioni come accessorie. The request for a preliminary ruling, asked for by Mercedes Benz Italia S.p.A. (hereinafter “Mercedes Benz” or “Company”), has come from an assessment from the Italian tax authorities regarding the calculation of input VAT deduction carried out by the Company. In brief, Mercedes Benz did not consider, in the pro rata calculation, interests on loans granted to controlled companies; this because such transactions were considered as ancillary to the main activity. In breve, secondo l’Avvocato Generale: In brief, according to the Advocate General: • • la Direttiva IVA UE osta alla normativa IVA italiana e alla prassi nazionale relative al pro rata che impongono di applicare il pro rata di detrazione nei confronti della totalità dei beni e servizi acquistati (quindi, anche nei confronti di quei beni e servizi utilizzati esclusivamente per operazioni che danno diritto alla detrazione); il pro rata IVA previsto dalla Direttiva IVA UE si applicherebbe, pertanto, solo all’IVA assolta sull’acquisto di beni e servizi utilizzati promiscuamente; • • the EU VAT Directive precludes the Italian VAT law and the Italian tax authorities guidelines related to the pro rata, which impose that the pro rata itself applies to all purchased goods and services (therefore, even those exclusively used for transactions with right to deduction); VAT pro rata according to the EU VAT Directive would, therefore, be applicable only to input VAT on purchases of goods and services promiscuously used; • • il pro rata di detrazione, per quanto riguarda beni e servizi utilizzati esclusivamente per effettuare operazioni imponibili, sarebbe 100%; il pro rata di detrazione per quanto riguarda beni e servizi utilizzati esclusivamente per effettuare operazioni esenti sarebbe 0%. Se confermato dalla Corte di Giustizia UE, ciò rappresenterebbe una modifica epocale per tutti i soggetti passivi che determinano l’IVA detraibile secondo il pro rata. • • VAT pro rata would be equal to 100% where regarding goods and services exclusively used for taxable transactions VAT pro rata would be equal to 0% where regarding goods and services exclusively used for exempt from VAT with no right to deduction transactions.
