TERMINI E CONDIZIONI – condizioni contrattuali noleggio breve termine
1 Età minima: 125 cc 18 anni compiuti con patente A o B da almeno tre anni
2 Patente di Guida: il noleggiatore deve essere in possesso di valida patente di guida riconosciuta dalla Legge Italiana, Irpice Srl cr (di seguito chiamata IRPICE) non si
assume nessuna responsabilità per le violazioni al Codice della Strada e/o contravvenzioni inerenti la patente di guida del noleggiatore; nello specifico il noleggiatore
sottoscrive ed accetta di esibire la propria patente di guida, in corso di validità, alla firma del contratto assumendosi tutte le responsabilità, penale e civile, qualora circoli
senza patente su di un mezzo della società IRPICE.
3 Codice della strada: con la stipula del presente contratto, il noleggiatore, dichiara di conoscere l'utilizzo dello scooter, i regolamenti del traffico e che non si metterà alla
guida sotto l'influenza di alcool, droghe o medicinali che ne possano alterare i riflessi e rendere la guida stessa pericolosa per la sua o l'altrui incolumità. Tutte le
contravvenzioni che dovessero pervenire alla società IRPICE saranno a totale carico del noleggiatore, per il periodo di noleggio da lui effettuato, con la maggiorazione di €
50,00 per pratica quali diritti amministrativi
4 Manutenzione: la manutenzione ordinaria dello scooter è a totale carico della società IRPICE, qualora il noleggiatore si trovasse nella necessità di dover far effettuare un
servizio di manutenzione dovrà preventivamente essere autorizzato dalla società IRPICE pena il mancato rimborso delle spese. Qualora il noleggiatore fosse richiamato
dalla società IRPICE per un intervento di manutenzione e non si dovesse presentare verrà addebitata una penale di € 100,00 oltre gli ulteriori costi che ne dovessore
insorgere.
5 Deposito cauzionale: al momento della stipula del presente contratto, il noleggiatore rilascerà a titolo di CAUZIONE la somma di € 500,00 a mezzo contanti, assegno
bancario intestato a Irpice srl cr, carta di credito. La cauzione verrà restituita al noleggiatore alla riconsegna dello scooter a seguito del controllo dello stato del veicolo. Il
perfetto stato del veicolo verrà confermato a seguito di accurato controllo da parte del nostro personale, sino a tal momento il contratto non si potrà definire chiuso anche se
la cauzione fosse già stata restituita.
6 Penali:
6.1 Luogo di riconsegna: qualora il luogo della riconsegna, salvo diversi accordi, non dovesse essere lo stesso del ritiro, verrà addebitata una penale una
tantum di € 50,00 oltre alle spese di rientro del mezzo alla stazione di partenza
6.2 Ritardata o mancata riconsegna: saldo diversi accordi, la ritardata o mancata riconsegna del mezzo alla data ed ora stabilità dal presente contratto,
sarà tollerata e priva di penali sino a 30 minuti; dopo tale periodo sarà addebita una penale di € 50,00 oltre al costo del noleggio giornaliero. Qualora il
ritardo dovesse superare le 12 ore ne verrà denuciato il furto da parte del noleggiatore.
6.1 Smarrimento chiavi: in caso di smarrimento della chiave verrà addebitata una penale di € 50,00 oltre al costo per la sotituzione della serratura e tutte le
maggiori spese che dovessero insorgere
6.2 Sequestro o fermo: in caso di sequestro o fermo del mezzo da parte delle Forze dell'Ordine, sarà addebitata una penale di € 50,00 oltre alle maggiori
spese che dovessero insorgere
6.3 Documenti: il noleggiatore è responsabile di tutta la documentazione in dotazione al mezzo e che gli è stata consegnata, in caso di smarrimento verrà
addebitata una penale di € 50,00 oltre alle maggiori spese che dovessero insorgere
6.4 Carburante: salvo diversi accordi, il mezzo, deve sempre essere riconsegnato con il pieno di carburante pena l'addebito di una penale di € 15,00 oltre al
costo del carburante mancante
7 Sinistri: in caso d'incidente, il noleggiatore, deve compilare il modello CID presente nella documentazione fornita in tutte le sue parti e darne immediata comunicazione
telefonica alla società IRPICE; qualora il mezzo non fosse più utilizzabile per il proseguio del noleggio e/o il rientro dello stesso, il noleggiatore dovrà attendere l'assistenza
stradale presidiando il mezzo stesso. Se nelle disponibilità della società IRPICE, la stessa, metterà a disposizione un altro scooter sino al ermine del periodo di noleggio;
qualora questo non fosse possibile, nulla sarà dovuto al noleggiatore come indennizzo per il termine anticipato del contratto/servizio.
8 Condizioni dello scooter: il noleggiatore conferma di aver controllato il perfetto stato dello scooter, il suo regolare funzionamento e di aver ricevuto tutta la
documentazione necessaria alla libera circolazione.
9 Limiti alla circolazione: salvo diversi accordi, il mezzo, non potrà circolare al di fuori della Regione dove ha inizio il noleggio pena l'annullamento del presente
contratto e l'addebito di una penale di € 500,00.
10 Assicurazione: salvo diversi accordi, il mezzo, è coperto da assicurazione RCA come previsto dalla vigente legge per danni a terzi. Non sono compresi
nell'assicurazione i danni al noleggiatore, passeggero e tutti i danni provocati allo scooter (kasko, minikasko, furto e/o incendio) che sono tutti a totale carico del
noleggiatore secondo le tabelle di riferimento al momento del sinistro (eurotax, etc.). Tutti i danni arrecati saranno addebitati al costo secondo il listino presente nell'ufficio
di noleggio oltre alle maggiori spese che dovessero insorgere e ad una penale per diritti amministrativi di € 50,00.
11 Foro compentente: per tutte le controversie si fa riferimento al Foro della sede legale della società IRPICE

6 Penalty:
