PVC un’esperienza che viene da lontano
Un mondo in costante crescita.
I serramenti realizzati con profili in PVC trovano sempre più larga applicazione in un mercato che ha iniziato a mettersi in evidenza da alcuni decenni, grazie alle continue migliorie che sono state apportate alla tecnologia
costruttiva, ai materiali e agli accessori che vengono impiegati per il loro
assemblaggio e montaggio. L’attenzione della ricerca OTLAV® risale ai primi anni 70, quando furono realizzate le prime cerniere dedicate a questo
specifico segmento di mercato.

three-dimensional adjustable hinge. The range of hinges stands out for its

La dima Rollacta, grazie alla proprie caratteristiche uniche, permette
un’agevole, precisa, facile e veloce installazione delle cerniere.
The jig for Rollacta, thanks to its own characteristics, allows an easy, precise
and quick installation of the hinges.
È composta di una parte base (A) adatta ad essere installata su tutti i tipi di
profili PVC. I kit (B e C) sono personalizzati in base al sistema di profili utilizzati.
Realizzata interamente in alluminio. Leggera, pratica e resistente all’usura.
L’utilizzo è estremamente semplice ed intuitivo. Equipaggiabile con asta
millimetrata che rende il posizionamento dell’attrezzo rapido ed esatto. Adatta
ad essere utilizzata indifferentemente sia su porte destre che sinistre (DIN).

Rollacta jig
Le cerniere Rollacta, disponibili in diverse versioni, permettono di individuare la
specifica soluzione per tutti i tipi di profili PVC presenti sul mercato.
Allo stesso modo la Dima Rollacta è dotata di viti di regolazione che permettono
di calibrare lo strumento in base alle esigenze del cliente.

solution for all types of UPVC profiles on the market.

Il concetto di versatilità è alla base della progettazione della stanga
UNIVERSAL: precisione, velocità, e flessibilità sono gli obiettivi realizzati con
questo rivoluzionario prodotto OTLAV®.
A differenza dei normali sistemi di foratura per cerniere, con UNIVERSAL, non è
necessario provvedere a sistemare l’anta sul telaio. Grazie alla predisposizione
per alloggiare due o più dime speciali, é consentita la foratura separata d’anta
e telaio per il successivo montaggio delle cerniere, permettendo quindi di
allestire due linee distinte per la produzione del serramento: vale a dire una
linea per la produzione delle ante e una linea per la produzione dei telai.
La particolare forma simmetrica delle dime e il fermo reversibile fanno in modo
che la stessa stanga possa essere usata sia per ante sia per telai siano essi
destri o sinistri. L’impiego degli spessori infine permette di adattare le dime
qualora risulti necessario aumentare o diminuire le distanze di foratura rispetto
all’anta o rispetto al telaio. UNIVERSAL, opportunamente equipaggiata permette
di montare maschi su telai prendendo come riferimento le femmine già montate
sull’anta per esempio con macchine automatiche. Le dime della stanga
UNIVERSAL sono personalizzate in base al tipo di profilo, al tipo di cerniera
da montare, alla posizione e inclinazione dei gambi rispetto all’anta o al telaio.
The concept of versatility is on the base of the rod “UNIVERSAL” design:
precision, velocity and flexibility are the aims realized with this revolutionary
OTLAV® product.
Unlike the standard hinge drilling systems, with UNIVERSAL, thanks to the
device which can lodge two or three special tools that permit the separate
door and frame drilling for the subsequent hinge fitting, it is not necessary
to place the door on the frame; so that it is possible to prepare two separate
lines to produce the doors, that is to say one for producing the shutters and
one for the frames.
The special symmetric shape of the jig and the reversible stop ensure the
same rod can be used both for doors and frames whether left or right. The
using of the shims finally permits to adapt the jig in case it would be necessary
to increase or decrease the drilling distances respect to door or frame.
UNIVERSAL suitably equipped permits fitting male pieces on frames, taking
as reference the females already fitted on the door for instance with automatic
machines. The UNIVERSAL rod jigs are customized according to the kind of
frame, to the type of hinge to be fitted, to the position and angle of the pins
as to the door or frame.

9. Per quanto riguarda le ante si procede allo stesso modo. Il corretto posizionamento del
fermo reversibile sul riferimento dell’anta, è la prima operazione da eseguire per la foratura.
10. Con facilità si procede quindi al montaggio sia delle parti maschio che delle parti
femmina.

6. The UNIVERSAL rod has been designed to drill and then to quickly fit the hinges on
different doors and frames production lines.
7. The first, easy action to drill the frame, is the correct reversible stop positionning on
the frame reference.
8. Successively proceed by drilling the frame.
9. As for the door the process is the same, the correct reversible stop positionning on the
door reference, is the first operation to be done while drilling.
10. It is then easy to proceed by fitting both the male and the female parts.

L’applicazione delle ROLLACTA valorizza il design sia dei portoncini d’ingresso che delle porte in PVC,
grazie alla progettazione con linee essenziali e morbide allo stesso tempo, dalle proporzioni perfette.
Questa gamma di cerniere è in grado di offrire la soluzione ideale per qualsiasi tipo di profilo in PVC e
sono disponibili in diverse altezze, 2 inclinazioni e un’ampia gamma di colori.
Il valore tecnologico di queste cerniere non ha precedenti.
1. Innovativo sistema di fissaggio con fori standard da 5mm, che consente di ottenere economie di
scala, sia a livello produttivo che in fase di installazione.
2. Stabilità senza paragoni, grazie ai perni di posizionamento che garantiscono anche un perfetto

3. Evita il taglio della guarnizione, permettendo invece una perfetta regolazione della pressione sulla

Cella 1 - Categorie d’utilizzo.
- Grado 1 - uso leggero: cerniere da usare su porte o finestre in abitazioni
o in altre aree residenziali e in edifici in cui vi è una bassa frequenza
d’uso da parte di persone altamente incentivate a prestare attenzione e
con scarsa probabilità d’incidenti o uso scorretto.
- Grado 2 - uso medio: cerniere da usare su porte in abitazioni o in altre
aree residenziali e in altri edifici in cui vi è una media frequenza d’uso
da parte di persone abbastanza incentivate a prestare attenzione e con
qualche probabilità d’incidenti o uso scorretto.
- Grado 3 - uso pesante: cerniere da usare su porte in edifici in cui vi
è un’elevata frequenza d’uso da parte del pubblico o di altre persone
scarsamente incentivate a prestare attenzione e con elevata probabilità
d’incidenti o uso scorretto.
- Grado 4 - uso gravoso (gradi VIII cifra: 12, 13 e 14): cerniere da usare su
porte soggette a uso frequente e violento.
Metodi di prova.
Le prove che hanno permesso di definire i requisiti prestazionali sono state
eseguite su due cerniere fissate ad un’apparecchiatura di prova rigida
oppure su una cerniera singola sottoposta a prova di carico verticale.
Cella 2 - Durabilità.
Classe 3 = 10.000 cicli
Si ruota l’elemento incernierato simulando l’apertura e chiusura della porta
di 90° per il numero di cicli richiesto dal grado da testare prescelto.
Con questa prova si verifica che l’usura della cerniera sia tale da non
pregiudicare la funzionalità della cerniera. A fine prova lo scostamento
verticale ed orizzontale della porta devono rimanere entro i limiti richiesti.
Cella 3 - Massa della porta.
È il peso della porta sulla quale è montata la cerniera da testare.

Il serramento viene sottoposto ad una prova atta a determinare il grado
di sopportazione del materiale al fuoco, vedi appendice B della Norma EN
1935:2002 per i requisiti supplementari.
Cella 5: Sicurezza.
classe 1= la cerniera rispetta i requisiti essenziali in termini di sicurezza
d’impiego.
Prova di deformazione da carico: si applica un carico del peso uguale
alla massa della porta, le deformazioni registrate durante e dopo il
carico devono rimanere entro certi limiti specificati e non ci deve essere
alterazione delle prestazioni funzionali. Con questa prova si riproduce un
utilizzo scorretto del serramento in un breve arco temporale.
Prova di sovraccarico: si applica un carico 2 volte la massa della porta
di prova, le cerniere e l’anta non devono subire deformazioni o rotture,
la porta non deve cadere anche se la cerniera non è più azionabile. Con
questa prova si riproduce un evento eccezionalmente negativo.
Prova di resistenza al taglio: questa prova viene eseguita separatamente
dalla porta, sulla cerniera del tipo a 3 gambi. La parte centrale della
cerniera (boccola) viene caricata con un peso predeterminato da tabella.
Con questa prova si verifica che il perno centrale non subisca deformazioni
tali da pregiudicare la funzionalità della cerniera.
Cella 6 - Resistenza alla corrosione.
Il grado di resistenza alla corrosione, viene definito mediante la prova di
Nebbia salina NSS Norma ISO 9227 e valutazione secondo Norma EN
1670. La prova di Nebbia Salina viene eseguita su campioni aggrediti da
soluzione salina in apposita camera; il tempo necessario alla comparsa
dell’ossidazione ne stabilisce il grado di appartenenza su una scala da 0 a

Cella 7 - Resistenza all’effrazione.
Grado 0: no.
Grado 1: si. Cerniere idonee all’uso per porte con caratteristiche di
resistenza all’effrazione.
Cella 8 - Grado cerniera.

Digit 1 - Category of use.
- Grade 1 - light use: hinges used on doors or windows in homes or in
other residential areas and in buildings where there is a low frequency of
use by people highly incentivized to take care and with a low probability
of accidents or incorrect use.
- Grade 2 - medium use: hinges used on doors in homes or in other
residential areas and other buildings where there is an average
frequency of use by people fairly incentivized to take care and with a
slight probability of accidents or incorrect use.
- Grade 3 - heavy use: hinges used on doors in buildings where there is a high
frequency of use by the public or by other people with little incentive to take
care and with a high probability of accidents or incorrect use.
- Grade 4 - severe use (digit 8: grades 12, 13 and 14): hinges used on doors
subjected to frequent and violent use.
Testing methods.
The tests to evaluate the required performance levels have been carried out
on two hinges fixed to rigid testing equipment or a single hinge subjected
to vertical load testing.
Digit 2 - Durability.
Grade 3 = 10,000 cycles
The hinged item is rotated, simulating opening and closing of the door by
90 degrees for the number of cycles required by the grade being tested.
Via this test, it is verified that by the end of the test, the wear of the hinge
does not damage the functionality of the hinge.
At the end of the test, the vertical and horizontal deviations of the door
must remain within the required limits.
Digit 4 - Suitability for use on fire rated or smoke rated doors.
Grade 0: no.
Grade 1: yes.
The door is tested to determine if the material is able to endure fire (see
Appendix B of Standard EN 1935:2002 for the additional requirements).
Digit 5 - Safety.
Grade 1: the hinge satisfies the essential requirements of safety in use.
Load deformation test: a load equal to the door mass is applied: the
deformations recorded during and after the load must remain within certain
specified limits and there must be no change in the functional performance.
Incorrect use of a door over a short time period is reproduced via this test.
Overload test: a load twice the door mass being tested is applied: the
hinges and the door must not present any deformation or breakage and
the door must not drop even if the hinge no longer works. An exceptionally
negative event is reproduced via this test.
Shear load test: this test is carried out separately on a three-pin hinge (not
mounted on a door). The central part of the hinge (bushing) is loaded with
a predetermined weight as per a table. This test is made to verify that
the central pin does not sustain any deformations which can damage the
functionality of the hinge.
Digit 6 - Corrosion resistance.
The level of corrosion resistance is defined via a salt spray test according
to Standard ISO 9227 and evaluated according to Standard EN 1670. The
Salt Spray test is carried out on samples corroded by a saline solution
in a special test cabinet. The time necessary for the onset of oxidation
establishes the grade of resistance from 0 to 5. See following pages.
Digit 7 - Resistance to burglary.
Grade 0: No.
Grade 1: Yes. Hinges are suitable for use on doors requiring a degree of
security.
Digit 8 - Hinge grade.
Overall rating for the hinge (in ascending order from 1 to 14).
Digit 3 - Door mass.
It’s the weight of the door on which the hinge to be tested is mounted.

Resistance of finishing
La formazione della ruggine sull’acciaio è un fenomeno chimico naturale
ed inevitabile che avviene a prescindere dal luogo e dalla condizione. Tanto
più l’inizio è posticipato, tanto più è garantita la funzionalità e l’estetica del
serramento. La propensione alla corrosione dell’ acciaio può essere ridotta
adottando misure di protezione dello stesso basate su rivestimenti esterni
o finiture che tendono ad isolarlo da condizioni atmosferiche aggressive.
Il corretto impiego di una cerniera deve quindi tenere conto dell’ambiente in
cui verrà utilizzata e della resistenza della finitura all’aggressione della ruggine.
Per l’impiego in ambienti riparati o con condizioni ambientali miti e stabili è
possibile effettuare una scelta tra un’ampia gamma di finiture. Per l’impiego
in ambienti aggressivi si consiglia l’utilizzo di cerniere con finiture resistenti
alla corrosione montate in combinazione con i cappucci OTLAV®.
Presso Myrtus, azienda galvanica del gruppo Otlav, tutte le finiture
sono sottoposte ad un test di resistenza specifico.
La prova di nebbia salina, eseguita secondo le sotto riportate normative
UNI, è una prova di corrosione accelerata che permette di valutare
qualitativamente la resistenza di un materiale o di un rivestimento alla
corrosione e consiste nel porre il campione da esaminare all’interno di
un’apposita camera a temperatura, umidità e pressione costanti, nella
quale viene nebulizzata una soluzione salina corrosiva che aggredisce il
rivestimento protettivo delle cerniere. Ad intervalli prestabiliti i campioni
vengono osservati registrando eventuali variazioni fino all’insorgere di
tracce di ossidazione o focolai rossi di ruggine.
Non esiste una relazione diretta tra la resistenza a nebbia salina e durata
agli agenti atmosferici delle cerniere nei vari ambienti e pertanto tale prova
deve essere intesa come metodo comparativo od indicativo di qualità
relativa (non un dato assoluto).
La scelta OTLAV® si rivolge anche all’ecocompatibilità con la certificazione
“Infinitely Recyclable” (Myrtus è stata la prima azienda in Italia ad ottenere
la certificazione), che riconosce ai prodotti metallici la possibilità di
essere fusi e ricreati un’infinità di volte, senza dare origine a scorie o ad
altri elementi nocivi per l’ecosistema.

Formation of rust on steel is a natural and inevitable chemical phenomenon
which occurs regardless of the location and the conditions. The longer the
start is delayed, the more the functionality and appearance of the door/
window is guaranteed.
The propensity of steel to corrode can be reduced by adopting measures
to protect it, based on external coatings or finishing which tend to isolate it
from aggressive atmospheric conditions.
Correct use of a hinge must therefore take into account the location in which
it will be used and resistance of the finishing to rusting. When using hinges in
a protected environment or in mild and stable environmental conditions it is
possible to choose from a wide range of finishing. When using hinges in an
aggressive environment we recommend choosing from those with corrosion
resistant finishing used together with OTLAV® caps.
At Myrtus, the galvanic treatment company of OTLAV® Group, all the
finishes are subjected to a specific resistance test.
The salt spray test, carried out according to the UNI regulations detailed
below, is an accelerated corrosion test which enables the resistance to
corrosion of a material or a coating to be evaluated qualitatively. The sample
to be examined is placed inside a test chamber at a constant temperature,
humidity and pressure: inside the chamber a saline solution is atomized
which then attacks the protective coating of the hinge. At predetermined
intervals the samples are observed and any changes are registered up until
the appearance of traces of oxidation or spots of red rust.
There is no direct relation between the resistance to salt spray and the life of
hinges exposed to atmospheric agents in different environments: therefore
this test must be considered as a comparative or indicative method of
relative quality (not an absolute figure).
OTLAV® is also environmental friendly oriented having the “Infinitely Recyclable”
certification (Myrtus was the first company in Italy to obtain the certification),
which acknowledges metal products which can be smelted and recreated an
infinite number of times, without giving rise to waste products or other harmful
elements for the ecosystem.

Zone ed agenti particolarmente avversi e comportamenti scorretti
possono accelerare il declino dell’acciaio anche se trattato:
1) sali o acidi ed altri agenti ossidanti presenti nell’aria e particolarmente
concentrati nelle zone marine, in ricoveri zootecnici e nelle aree urbane,
sono fattori aggressivi;
2) la stessa intensità corrosiva può essere presente in locali o cantieri
scarsamente areati e nei quali sono stati eseguiti trattamenti chimici quali
la tinteggiatura o la finitura dei pavimenti;
3) l’elevata umidità e ripetuti sbalzi di temperatura tipici di ambienti non
abitati sono causa sicura dell’insorgere dell’ossidazione.
4) la cattiva conservazione, la non attenta manipolazione oppure la pulizia del
prodotto con prodotti corrosivi o abrasivi, possono danneggiare l’integrità
estetica e strutturale dello stesso prima ancora della posa in opera.
NOTE!
Especially hostile areas and agents and inappropriate conduct can
accelerate the decline of steel even if treated:
1) salts or acids and other oxidizing agents present in the air and especially
concentrated in marine areas, in livestock shelters and in urban areas are
aggressive factors;
2) the same degree of corrosion can be found in rooms or work sites poorly
ventilated, in which chemical treatments such as painting or finishing of
floors have been carried out;
3) high humidity and repeated temperature changes typical of rooms or
places not lived in are a certain cause of the onset of oxidation;
4) incorrect storage, handling without care or cleaning of the product with
corrosive or abrasive products can damage the aesthetic and structural
integrity of the product even before mounting it.

1) ORDINI
Tutti gli ordini trasmessi da parte del committente sono impegnativi per OTLAV® solo dopo
accettazione scritta della Sede. È facoltà della OTLAV® non dar corso alla fornitura nel caso in cui,
dal momento dell’accettazione dell’ordine a quello della spedizione della merce, sopravvengano
aumenti di costo o variazioni di listino oppure avvengano casi d’insolvenza del committente a
qualsiasi titolo nel pagamento di forniture precedentemente effettuate. OTLAV® si riserva in ogni
caso di evadere l’ordine anche parzialmente, se per cause di forza maggiore non è in grado di
evaderlo completamente. Eventuali rimanenze saranno evase non appena disponibili o con il primo
ordine successivo del committente.
OTLAV® non è responsabile di eventuali errori nell’evasione degli ordini dovuti ad incompleta,
mancata o errata indicazione del Codice Articolo.
1) ORDERS
All orders transmitted by the customer are only binding for OTLAV® after written acceptance by Head
Office. OTLAV® reserves the right not to deliver the order in the event that, from the time the order is
accepted to the time the goods are due to be despatched, there are any increases in cost or variations
to the price list, or if the customer does not pay, for whatever reason, for previous deliveries of goods.
In any case, OTLAV® reserves the right to deal with the order in part, if it is unable to fulfil it completely
due to circumstances beyond their control. Any remaining part of the order will be send as soon as
they become available, or with the customer’s next order. OTLAV® is not responsible for any errors
in supplying orders due to the Article Code Number being incomplete, missing or wrong.
2) CAMPIONI
I campioni, i cataloghi e qualsiasi documentazione tecnica in possesso del committente, per quanto
riguarda i particolari tecnici di lavorazione, hanno valore indicativo/dimostrativo. Per produzioni
particolari su commessa o per articoli diversi da quelli di produzione standard OTLAV® è richiesto il
disegno tecnico con indicazione di quote, o un campione. OTLAV® si riserva la facoltà di apportare
in qualsiasi momento le modifiche di carattere tecnico o costruttivo ritenute più opportune di
modificare i campioni, i cataloghi ed ogni altra documentazione tecnica in circolazione, senza
obbligo d’informare il committente.
3) PREZZI
I prezzi riportati nel listino sono espressi in EURO, IVA esclusa e potranno subire delle modifiche
in conseguenza di improvvise variazioni degli elementi di costo.
4) RECLAMI
Al ricevimento dei prodotti il committente deve verificare immediatamente lo stato e la conformità
dei prodotti.
Tutti i reclami relativi alla conformità dei prodotti all’ordine, anche in relazione alla loro quantità
e/o aspetto esteriore, devono essere formulati per iscritto all’atto del ricevimento della merce e
comunicati alla OTLAV®, entro e non oltre 8 (otto) giorni dal ricevimento.
In nessun caso OTLAV® risponde per danni alla superficie causati ai prodotti da errato stoccaggio
(ambienti umidi, salini ecc.)
5) TRASPORTI
Le spedizioni, salvo diversi accordi, saranno effettuate a mezzo trasportatori definiti a cura della
OTLAV®. La merce viaggia comunque sempre per conto, rischio e pericolo del committente.
OTLAV® non si assume responsabilità per ritardi, manomissioni o per altre mancanze avvenute
durante il trasporto. Ogni responsabilità di OTLAV® cessa al momento della consegna della merce
al vettore.
Se il trasporto è a carico del committente, i costi vengono addebitati sulla fattura della merce.
6) IMBALLI
L’imballo originale è compreso nel prezzo.
La merce viene consegnata con imballo OTLAV® e nelle confezioni minime standard riportate nel
catalogo. Qualora fosse richiesto dal committente un confezionamento diverso, OTLAV® si riserverà
di addebitare il maggior valore.
OTLAV® procederà a propria discrezione e senza preavviso, ad aumentare l’ordine fino al
quantitativo della confezione o addebitarne eventualmente una maggiorazione.
7) RESA
Le condizioni di resa vengono pattuite all’inizio del rapporto commerciale; in ogni caso, la resa con
corrieri veloci o con procedure d’urgenza richieste dal committente, verrà addebitata.
8) TERMINI DI CONSEGNA
I termini di consegna si intendono approssimativi e non tassativi; in nessun caso il committente ha il
diritto di rifiutare la merce, o di richiedere la risoluzione del contratto, od il risarcimento dei danni per
eventuali ritardi.
9) RESI
Premesso che eventuali reclami possono essere accettati soltanto se notificati a mezzo lettera,
fax o e-mail entro otto giorni dalla data di ricevimento del materiale e che trascorso tale periodo
decade ogni diritto di reclamo, ogni reso dovrà essere autorizzato in forma scritta da OTLAV®.
I resi di merce dovranno pervenire al magazzino OTLAV® in porto franco e in confezioni integre,
accompagnati da relativo documento sul quale dovranno chiaramente comparire gli estremi della
fattura relativa ad ogni singolo prodotto.
Eventuali resi che dovessero pervenire ad OTLAV® riscontrati manomessi od erroneamente utilizzati,
non saranno in alcun modo sostituiti o risarciti, ma rispediti in porto assegnato al committente.
Non saranno altresì accettati resi di articoli speciali, articoli fuori produzione, merce difettosa o
scarta per motivi non imputabili a OTLAV®.
10) PAGAMENTI
Per il pagamento del prezzo dei prodotti e delle relative spese di spedizione vale quanto pattuito
all’atto d’ordine. In caso di ritardato pagamento verranno addebitati al committente gli interessi
moratori ai sensi del D. Lgs. 231/02 nella maggiorazione di cui all’art. 5.
Qualora il committente venga a trovarsi in una situazione di insolvenza o sia sottoposto a procedura
concorsuale, OTLAV® potrà sospendere o cancellare ordini e/o consegne.
Qualsiasi contestazione non darà al committente il diritto di ritardare o rifiutare il pagamento.
Pagamenti mezzo assegno devono essere con assegno intestato ad OTLAV®, non trasferibile.
Il pagamento anticipato dovrà essere effettuato con bonifico swift; ordini aventi tale tipo di pagamento
verranno considerati come confermati ed avviati in produzione, solo al ricevimento del bonifico.
Il pagamento in contrassegno si intende con assegno circolare, non trasferibile, intestato a OTLAV®.
11) RISERVA DI PROPRIETA’
Tutti i prodotti ordinati saranno venduti con riserva di proprietà a favore della OTLAV® sino all’integrale
pagamento del prezzo.
Pertanto, prima di tale momento, il committente non potrà né installare, né comodare, né lasciare
sequestrare o pignorare senza dichiarare la proprietà della OTLAV® (dandone immediato avviso a
quest’ultima), pena, in caso di violazione anche di uno solo degli obblighi predetti, la sua decadenza
dal beneficio del termine dilazionato.
Sino all’integrale pagamento del prezzo, sarà in facoltà di incaricati della OTLAV® accedere ai locali
ove si trovano i prodotti, per le opportune verifiche.
12) FORO COMPETENTE
La presente è soggetta alla legge italiana. Per qualsiasi controversia tra le parti relativa
all’interpretazione, esecuzione e risoluzione della presente, e a qualsiasi inerente ragione di dare
o di avere, sarà competente in via esclusiva il Foro di Treviso o Conegliano (TV), ferma la facoltà
della sola OTLAV® di adirne ogni altro competente ai sensi di legge.
13) DEROGHE ALLE CONDIZIONI CONTRATTO
Le presenti condizioni generali di vendita annullano tutte le precedenti e nessuna deroga alle stesse
sarà consentita se non espressamente accettata da OTLAV®.
2) SAMPLES
The samples, catalogues and any technical documentation in the customer’s possession, inasmuch
as they refer to particular manufacturing techniques, have an indicative/demonstrative value. For
the production of special orders or for articles which differ from standard OTLAV® production, the
technical design with an indication of quotes, or a sample, is required. OTLAV® reserves the right
to make any technical or manufacturing modifications they deem suitable at any time (without
being obliged to inform the customer), to change the samples, catalogues and any other technical
documentation in circulation.
3) PRICES
The prices stated in the price list are given in EURO, without VAT, and may undergo changes due
to sudden variations in costs.
4) COMPLAINTS
Upon receiving the products, the customer shall immediately check the condition of the products and
that they conform to the order.
All complaints relating to the conformity of the products to the order, and regarding the quantity
and/or the exterior condition of the product, must be made in writing upon receipt of the goods and
communicated to OTLAV®, within and no later than 8 (eight) days of receipt.
OTLAV® will not be held responsible, in any case, for any damage to the surface caused by faulty
storage of the products (damp or saline surroundings, etc.).
5) TRANSPORTATION
Deliveries, unless agreed differently, shall be carried out via transporters as defined by OTLAV®. The
goods, however, always travel on behalf of the customer and at the customer’s risk. OTLAV®
accepts no responsibility for delays, tampering or any other shortcomings which occur during
transportation. All responsibility by OTLAV® ceases at the moment of delivery of the goods to the
carrier. If the transportation is to be charged to the customer, the costs shall be added to the invoice
for the goods.
6) PACKAGING
The original packaging is included in the price. The goods are delivered with OTLAV® packaging
and in the minimum standard packaging stated in the catalogue. Should the customer require
different packaging, OTLAV® reserves the right to debit the greater cost.
OTLAV® shall proceed, at its own discretion and without notification, to increase the order to
the quantity of the packaging or to debit any increase.
7) CARRIAGE
The period allowed for carriage shall be agreed at the start of the business relationship; in any case,
carriage via fast carriers or with urgent procedures requested by the customer, shall be debited.
8) DELIVERY DATES
Delivery dates are intended to be approximate and not peremptory; the customer has no right, in any
case, to refuse the goods, or to request the termination of the contract, or compensation for damages
for any delays.
9) RETURNS
Whereas any returns shall only be accepted if notified by letter, fax or e-mail within eight days
of receipt of the materials, any right to return the goods shall lapse once said period of time
is up, and any returns must be authorised in writing by OTLAV®. Any returned goods shall
be delivered to the OTLAV® warehouse carriage free and with packaging intact, accompanied by
relevant document on which the essential elements of the invoice relating to each individual product
shall be clearly shown. Any returns delivered to OTLAV® which are found to be tampered with or
wrongly used, shall in no case be replaced or reimbursed; they shall be sent back freight collect
to the customer.
Neither shall any returns involving special articles, articles which are no longer in production, or
faulty or rejected goods for reasons not attributable to OTLAV®, be accepted.
10) PAYMENT
Payment of the price of the products and of the relevant delivery charges shall be in compliance
with the terms agreed at the time of ordering. In the event of delayed payment, the default interest
pursuant to Legislative Decree 231/02 with the increase pursuant to art. 5, shall be debited to
the customer. Should the customer find him/herself in a situation of insolvency or of bankruptcy
proceedings, OTLAV® may suspend or cancel orders and/or deliveries.
The customer shall not have the right to delay or refuse payment in the event of any dispute.
Cheques must made payable to OTLAV®, and must not be transferable.
Payment in advance must be made with Swift transfer; orders with this type of payment shall only
be considered confirmed and production started, upon receipt of said transfer. Payment C.O.D.
shall be via bank draft made out to OTLAV®, not transferable.
11) RESERVATION OF TITLE
All ordered products shall be sold with reservation of title by OTLAV® until the price is paid in
full. Therefore, until such time as payment has been made, the customer may not install, nor
loan, or allow to be seized or distrained without declaring the property of OTLAV® (notifying the
latter immediately), the penalty being, in the event of violation of even one of the aforementioned
obligations, forfeiture of the benefit of deferred terms. Until full payment of the price has been made,
employees of OTLAV® shall have the right to access the premises in which the products are being
kept, in order to make the appropriate checks.
12) COMPETENT COURT
This deed is subject to Italian Law. The competent Court shall be the Court of Treviso or Conegliano
(TV) only, for any dispute between the parties with regard to the interpretation, execution and
termination of this deed and for any reason concerning credits and debits, without prejudice to the
right by OTLAV® alone to choose any other competent court pursuant to legislation.
13) EXCEPTIONS TO THE CONDITIONS OF THE CONTRACT
These general conditions of sale cancel all previous conditions and no exceptions shall be allowed
unless expressly accepted by OTLAV®.
