CALL TO ORDER: Pat Atkins, Board President, called the meeting of the Waco Independent
School District Board of Trustees to order at 6:05 p.m. He stated that a quorum of Board members
was present and that notice of the meeting had been posted.
Board Members Present:
President Pat Atkins, Vice President Allen Sykes,
Secretary Norman Manning, Cary DuPuy, Stephanie Korteweg,
Larry Perez, and Angela Tekell
Board Members Absent:
None
III. CLOSED SESSION – President Atkins called the closed meeting to order at 6:05 p.m.
pursuant to the following sections of the Texas Government Code:

a. The Board of Trustees will convene in closed session for a private consultation with
the Board's attorney on any or all subjects or matters, including pending or
contemplated litigation, as authorized by law (Tex. Govt. Code Section 551.071),
including Gabriel v. Waco ISD.

No action was taken during the closed meeting. President Atkins reconvened the open
meeting at 6:50 p.m.
President Atkins inquired as to whether there were any objections to hearing items out of
order. Hearing none President Atkins began with item:
VI-A Consider Hiring of Administrator(s)
 Dr. Bonny Cain, superintendent, introduced assistant principal candidate Erika Douglas.
Larry Perez moved, Norman Manning seconded, to approve the Administration’s
recommendation to employ Erika Douglas as assistant principal at University High School.
Motion passed 7-0.
VI-D Consider 2015-2016 Employee Compensation Plan
 Elaine Botello, Executive Director of Human Resources, briefed the Board on the
compensation plan for 2015-16. Human Resources will look at different modes of getting
this information out to teachers.
Allen Sykes moved, Angela Tekell seconded to accept the Administration’s
recommendation to approve the employee compensation plan as presented. Motion passed
7-0.

VII-A Consider Adoption of the 2015-16 Proposed Budget
 The Board requested that Administration have specific goals that linked to the Board’s
goals which the tax increase would fund by the first of September. Sheryl Davis, CFO,
stated that the proposed budget did not include the tax rate swap. The Board will vote on
the proposed budget on August 24, 2015.
VII-B Consider Resolution Adopting the Tax Rate for the 2015 Tax Year
 Sheryl Davis, CFO, briefed the Board on the 2015-2016 proposed tax rate. Ms. Davis
presented two tax rate options for the Board to review. The Board will vote on the tax rate
on August 24, 2015.

VI-B Consider Student Code of Conduct
 Alfonso Saldaña, Coordinator of Student Services, stated that the Texas Legislature passed
Senate Bill 107 on June 20, 2015, and the only major change was that “Principal” was
replaced with “Campus Behavior Coordinator” in Chapter 37. Mr. Saldaña stated that the
Student Code of Conduct was available to parents via the Waco ISD web page or by
requesting a hard copy on campus. Larry Perez moved, Angela Tekell seconded, to approve
the edited 2015-2016 WISD Student Code of Conduct as presented. Motion passed 7-0.

VI-C Consider to Rescind Recommendation to Propose Notice of Non-Renewal
 There was no discussion on the line item.
Angela Tekell moved, Allen Sykes seconded, to approve rescinding the previous approval
to give notice of the proposed nonrenewal of the teacher’s term contract. Motion passed 70.
VII-D Consider 2016 Employer Group Health and Prescription Insurance
 Elaine Botello gave the Board a brief overview of the District’s proposed health plan.
VII-C Approve Order of Special Election for the Waco Independent School District
to be Held on November 3, 2015 for Voting on Approving an Ad Valorem Tax
Rate of $1.443236 (Aprovar el Orden de Elección Especial para el Distrito
Escolar Independendiente de Waco que se celebrara el 3 de noviembre de 2015
para votar de la aprobacion de la tasa de impuestos de $1.443236); Official
Ballot; Polling Locations; Election Workers; and Ballot Board and Signature
Verification Committee

 Larry Carpenter, Director of Elementary Advanced Academics, briefed the Board on the
District’s plan to implement a universal screener for all elementary students as well as to
offer nomination training on all campuses so as to increase the number of identified
students.
3. AP Exam Performance
 Dr. Scott McClanahan stated that of students who took the AP exam, there was an eight
percent increase in the passing rate. Dr. McClanahan also stated that he would like to have
equal weight in both Dual Credit and AP classes and increase the rigor of instruction.
Administration will submit recommendation to the Board at the Regular Board meeting on

August 24, 2015.

Dr. McClanahan, Director of Advanced Academics, and Dr. Robin McDurham, Executive
Director of High Schools, briefed the Board on the criteria for equally weighting dual
credit and AP classes, equal grade point weighting of 1.15 for all students enrolled in
Academic Decathlon, and allowing students to audit a zero hour course.
VIII-C Board Member Committees
 Allen Sykes, member of the Downtown Development Committee, stated that the Stratton
project had been approved and was in negotiations for renovations.

District Board of Trustees to order at 6:04 p.m. He stated that a quorum of Board members was
present and that notice of the meeting had been posted.
Board Members Present:

Board Members Absent:
Pat Atkins, arrived at 6:40 p.m.

 The Pledge of Allegiance was led by Andrew Llano, a student at Bell’s Hill Elementary.
VII. SPECIAL RECOGNITION
 Dr. Bonny Cain recognized the following groups/individuals:
o Lili Bien, Mountainview Elementary, Diana Salas, Bell’s Hill Elementary, and
Brenda Hernandez, Cesar Chavez Elementary. The students has their artwork
published in the 2015-2016 Peter Piper Pizza School Calendar.
o In recognition of the relentless efforts of Cheryl Pooler and Kathy Wigtil with the
District’s Homeless Outreach Department, Waco ISD surpassed the State’s
graduation and attendance rate for homeless students in Texas public schools.
Every twelfth grader who remained in the District until the end of the school year
graduated.
o Sandra Dorsey, administrative assistant, went above and beyond the call of duty
by diligently working long and hard to make certain Waco ISD’s Family Fest was
successful.

VIII. PUBLIC HEARING
A. A Public Meeting to Discuss the 2015-2016 Budget and Proposed Tax Rate
 In accordance with Section 44.002 of the Education Code President Atkins recessed the
Open Meeting at 7:40 p.m. to conduct a public hearing to discuss the 2015-2016
proposed budget and tax rate. Sheryl Davis, CFO, briefed the Board that a notice had
been posted regarding the public hearing; Texas property tax law; budget timelines;
budget priorities; ways to generate funding; tax rates; truth-in-taxation; accessing the
highest level of enrichment funding; proposed tax rate options; State funding for debt;
funding per penny of local tax effort; how Waco ISD voters could maximize State aid for
students; what eight million dollars would do for the Waco ISD community; impact of
proposed tax rate on average homestead; surrounding district 2014 local tax rates; official
budget summary; and cost of salary increase. President Atkins inquired if there was
anyone in the audience who wished to address the proposed budget and tax rate. No one
asked to speak. President Atkins closed the public hearing and reconvened the open
meeting at 8:30 p.m.
IX. AUDIENCE FOR GUESTS
 Pam Cooper, President, Greater Waco AFT (American Federation of Teachers),
introduced herself and stated that AFT wanted to promote a positive workplace at Waco
ISD.
 Louis Malfaro, State President, Texas AFT (American Federation of Teachers), stated
that the local and State chapters were supportive of the District’s endeavors with the
upcoming TRE.

B. Approve 2014-2015 Budget Amendments
 That the Board of Trustees approve amendments:
#061 Lake Air Montessori – will reallocate budgeted funds for instructional supplies to
security for extra-duty.
#062 General Fund – Maintenance Projects – will reallocate budgeted funds for plant
maintenance, contracted building maintenance to facilities construction, and contracted
service and materials.
#63 General Fund – Final Amendment – will reallocate budgeted funds for various
functions and increase teacher retirement on-behalf revenue to cover projected
functional over expenditures. The Texas Educational Agency requires a school district
to amend the official budget before exceeding a functional expenditure category within
any fund in the official district budget.
C. Approve 2014-2015 Fund Balance Commitments
 That the Board of Trustees approve the resolution committing unassigned general
operating fund balance in the amount of $5,285,616 for future bus replacements and
completion of approved projects.
D. Approve Bid Award for Maintenance Supplies, Repairs, and Equipment

That the Board of Trustees approve the responding vendors to be appended to the original
list of vendors providing maintenance supplies, repairs and equipment as presented.
E. Approve Contract with Bayes Achievement Center for Residential Placement
 That the Board of Trustees approve the contract with Bayes Achievement Center for
residential placement for a special education student as presented.
F. Approve Renewal of Job Order Contract for Plumbing Services
 That the Board of Trustees approve the renewal of the job order contract #14-1005 for
plumbing services with the Brandt Company, as the primary vendor, with Cornerstone

Plumbing and McNamara Custom Services awarded as additional vendors for projects
between $5,000 and $125,000 as presented.
G. Approve Declaration of Miscellaneous Technology and Other Equipment as
Surplus Property
 That the Board of Trustees approve the miscellaneous technology and other equipment as

H. Approve Cost Share Agreement for Communities-in-Schools Services

I. Approve Memorandum of Understanding for the 2015-2016 School Year
Between the Waco Independent School District and Area ISD's Setting the Tuition

 That the Board of Trustees approve the Memorandum of Understanding for the 20152016 school year between Waco ISD and area ISDs, setting the tuition rate of $2,900 and
building use fee of $400 per student for the for the Greater Waco Advanced Health Care

That the Board of Trustees approve the District’s health and prescription insurance
renewal with United Health Care for the 2016 plan year effective January 1, 2016 and the
$300 per eligible employee per month for employees who enroll in the District’s health
insurance and a reduced rate from $50 to $41.66 per eligible employee per month toward
the alternative flexible spending account for employees who waive health insurance as
presented.
R. Approve Agreement between Waco ISD and Walch Educational Consulting, LLC,
for Tax Rate Consulting Services
 That the Board of Trustees approve the agreement between Walch Educational
Consulting, LLC and Waco ISD for tax rate consulting services as presented.
Larry Perez moved, Angela Tekell seconded, to approve the consent agenda as
presented. Motion passed 7-0.
XI. DISCUSSION AND POSSIBLE ACTION
A. Consider Adoption of the 2015-16 Proposed Budgets
 President Atkins expressed the Board’s gratitude to Sheryl Davis and her department for
the time and effort spent on preparing the proposed budget.
Cary DuPuy moved, Norman Manning seconded, to approve the budget for the 20152016 fiscal year as presented. Motion passed 7-0.

B. Consider Resolution Adopting the Tax Rate for the 2015 Tax Year
 Board member Angela Tekell stated that the best investment a Waco taxpayer could
make was to education. Angela Tekell moved, Allen Sykes seconded, that the property
tax rate in increased by the adoption of a tax rate per hundred dollars valuation of $1.17
for Maintenance and Operations (M&O), of $0.23 for interest and Sinking (I & S), for a
total rate of $1.40, which is effectively a 10.7 percent increase in the tax rate. This tax
rate will raise more taxes for Maintenance and Operations than last year’s tax rate. The
tax rate will effectively be raised by 14.6 percent and will raise taxes for Maintenance
and Operations on a $100,000 home raised by a -$6.50. Motion passed 7-0.

 Bonny Cain, superintendent, stated that Administration was recommending that the
Board of Trustees approve the order calling for a special election for Waco ISD to be
held November 3, 2015 for voting on approving an ad valorem tax rate of $1.40. Allen
Sykes moved, Cary DuPuy seconded, to approve the Order of Special Election for
the Waco Independent School District to be held on November 3, 2015. Motion passed
7-0

D. Consideration of Resolution Regarding McLennan County Appraisal District
 A motion was not made on the line item.
E. Gifts and Grants
 The Board expressed their appreciation of the grants department’s dedication to
aggressively pursuing grant opportunities for the District.
Gifts: The National Academy Foundation donated $5,000 to AJ Moore Academy of
Health Science for being named a Distinguished Academy.
$7,157.00 in total cash, items and service were recorded in July.
Grants: The U. S. Department of Education for the third year of the Waco Counseling
Project awarded the District $395,781.00 to provide counseling programs and services to
the economically-disadvantaged students in elementary schools.
The Rapoport Foundation through Texas State Technical College for the second year of
Prosper Waco – Project Link provided $126,618.00 to fund two Link Impact Team
members at University High School.
Apple, Inc, awarded four AppleConnectEd grants during the 2014-2015 school year to

 Summer school graduation will be held on August 25, at 7:00, located at University High
School Performing Arts Center.
 The Derrick Johnson Football Classic begins on Thursday, August 27th thru Saturday,
August 29th.
 Bell’s Hill Elementary recently begun using monthly School News Guru newsletters at
no cost. School News Guru held a special drawing for those campuses who signed on
early and Bell’s Hill received $1000.
 Greater Waco Advanced Health Care Academy grand opening to be held on Tuesday,
September 15 at 7:00 p.m.
 The District had a very successful first day of school.

been opened and evaluated for the purpose of awarding a contractor to provide
floor covering services to the District. We received two bids for this service.
After evaluating the bid proposals and in consideration of new guidelines for
Job Order Contracts, the Maintenance and Facility Department recommended
that the primary vendor be awarded to Centex Carpet & Interiors, while Gene
Ives Acoustic be awarded as the additional vendor.
All projects under $5,000 will be awarded to Centex Carpet & Interior. Quotes
from both awarded vendors will be requested for projects costing between
$5,000 and $125,000. Projects with an estimated cost equal to or exceeding
$125,000 will be separately bid.
The Maintenance and Facility’s Department have been pleased with the
services which they have received from Centex Carpet & Interior and Gene Ives
Acoustics and would like to exercise our option to renew both vendors for an

Communities-Schools Services for 2015-2016

Background Information:
At the August 24, 2015, Board meeting, the Waco ISD and Communities-inSchools of the Heart of Texas (CIS) entered into a cooperative effort to provide
school-based support services to students and their families in order to
increase their level of academic success.
The original agreement provided CIS programming on nine Waco ISD
campuses.
The amended agreement will add services at South Waco
Elementary School
Attached is a copy of the amended agreement.
Fiscal Implications:
Waco ISD will assume a total of $286,250 for managerial and operating costs
associated with the implementation of CIS programming on ten campuses.
Purchases will be made to the appropriate campus and/or departmental
budget from the State Compensatory Education funds.

Approve Renewal of Exclusive Beverage Contract

Background Information:
Request for Proposals, RFP # 10-0860, has been previously opened and
evaluated for the purpose of awarding a contract for an exclusive beverage
contract with the Waco Independent School District. There were two proposals
submitted for consideration for this service, American Bottling Company dba
Dr. Pepper Bottling Company of Waco and Waco Coca Cola.
The original contract was valid from September 1, 2010 thru August 31, 2015.
The contract allows for two additional one-year renewal options. The district
would like to exercise the first of these renewal options at the same terms and
conditions as the original contract. The contract highlights are a $15,000
annual sponsorship, 25% commission rate on vending machine sales, $2 per
case rebate, reduced case price for concession stand profits, and $1,000 in
annual product donations.
Fiscal Implications:
The cost of these beverage products will be charged to the appropriate
campus/department’s supply budget.

Background Information:
The McLennan County Elections Office has prepared the notice of the joint
general election to be held on November 3, 2015. The Waco ISD will hold a
Special Election on that date for voting on approving an ad valorem tax rate of
$1.40000. While the Board of Trustees Ordered the Election at the August 24,
2015, meeting, the notice was not approved at that time.
Attached is a copy of the notice and a list of polling locations for the election.
Fiscal Implications:
The estimated cost of the election to Waco ISD is estimated to be $13,586.17.
Administrative Recommendation(s):
The Administration recommends that the Board of Trustees approve the Notice
of Joint General Election calling for a special election for the Waco Independent
School District to be held on November 3, 2015 for voting on approving an ad
valorem tax rate of $1.40000 and approving the polling locations, as presented.

The Board of Trustees ordered a special election on August 24, 2015, for Voting
on Approving an Ad Valorem Tax Rate of $1.40000. The election will be held on
November 3, 2015. A proposed agreement to conduct a joint election with
McLennan County is attached.
The agreement provides for common polling places, election officers and a joint
election ballot, where possible. The McLennan County Elections Administrator
publish the Joint Notice of Election in the Hometown News (formerly Waco
Citizen Newspaper) and El Tiempo Newspaper. The Waco ISD will also agree to
contract with the McLennan County Elections Administrator to provide election
services.

AGREEMENT TO CONDUCT JOINT ELECTION
November 3, 2015
THIS AGREEMENT is entered into between MCLENNAN COUNTY, acting herein
by and through the Commissioners Court and Waco Independent School District, acting by
and through its Board of Trustees for the purpose of conducting a joint election for members
of their respective governing bodies, do hereby agree as follows:
1.
The entities will utilize common polling places in the voting precincts, as shown in
Exhibit "A" attached hereto. Each entity shall designate the McLennan County
Election Administrator's Office (Records Building), Robinson First Baptist Church,
City of Waco Multi-Purpose Community Center, First Assembly of God Church
and Brazos Meadows Baptist Church as the sites of in-person Early Voting;
2.
The entities agree to appoint the same persons to serve as election officers in the
November 3, 2015 Joint Election with a minimum of four (4) workers per each Early
Voting location and a minimum of three (3) workers per each Election Day location.
3.
The entities shall appoint the McLennan County Elections Administrator, as the Early
Voting clerk for the Joint Election.
4.
To the greatest degree possible, a Joint Election ballot shall be used by the entities.
5.
The election forms and records maintained at common polling places shall be combined.
6.
Each entity agrees to take the necessary action to call the election as a Joint Election.
7.
The McLennan County Elections Administrator will publish the Joint Notice of Election
in the Hometown News (formerly Waco Citizen Newspaper) and Tiempo Newspaper.
8.
Waco ISD agrees to contract with the McLennan County Elections Administrator to
provide election services.
9.
If a manual count is required to be performed in accordance with Section 127.201 of the
Election Code, the Election Administrator shall be responsible for performing the manual
count.
10.
If any regular Early Voting Clerk receives applications for mail ballots, the applications
shall be forwarded to the designated Early Voting Clerk at the McLennan County
Records Building, Office of the Elections Administrator. [Sec. 31.097].

COUNTY OF MCLENNAN
CONTRACT FOR ELECTION SERVICES BETWEEN THE MCLENNAN COUNTY
ELECTION ADMINISTRATION DEPARTMENT AND THE WACO INDEPENDENT
SCHOOL DISTRICT.
THIS CONTRACT made by and between the Waco Independent School District, acting
by and through its Board of Trustees, hereinafter referred to as the "District," and Kathy E.
Van Wolfe, Elections Administrator of McLennan County, Texas, hereinafter referred to as
the "Contracting Officer," and by authority of Section 31.092 (a), Texas Election Code for the
conduct and supervision of the November 3, 2015 Election for voting on approving the ad
valorem tax rate of $1.40000 per $100 valuation in the Waco ISD for the current year, a rate
that is $0.13000 higher per $100 valuation than the school district rollback tax rate.
THIS CONTRACT is subject to the approval of all participating parties and shall be
binding on said parties upon written approval.
WITNESSETH:
WHEREAS, the District is holding an election for voting for voting on approving
the ad valorem tax rate of $1.40000 per $100 valuation in the Waco ISD for the current year, a
rate that is $0.13000 higher per $100 valuation than the school district rollback tax rate (at the
expense of the District) on November 3, 2015; and
WHEREAS, the voting precincts of the District which lie within the boundaries of the
District, has been established by the District as their voting precincts; and
WHEREAS, the voting places in the voting precincts of the District which lie within the
boundaries of the District, are the voting places in the voting precincts of the District; and
WHEREAS, the County owns the HART eSlate electronic voting system which has
been duly approved by the Secretary of State, pursuant to the Texas Election Code, (Section
122.031-122.039, Section 122.091); and
WHEREAS, the District desires to use the County’s electronic voting system in their
elections and to compensate the County for such use and to share in certain other expenses
connected with such elections in accordance with the provisions of Section 31.098 of the Texas
Election Code; and
NOW, THEREFORE, in consideration of the mutual covenants, agreements and
benefits to the parties, IT IS AGREED as follows:
I.

In all of the District’s voting precincts, the Contracting Officer shall conduct the
District’s election in accordance with this contract. The District shall bear the full cost or pay
a pro-rata share of the voting sites and election judges, alternates and clerks, if applicable, to
be used for the election.
II.
In all of the District’s voting precincts, which are to be consolidated, the District shall
use the consolidations of McLennan County. Judges’ Booth Controllers (JBCs), eSlates and
Disabled Accessible Units (DAUs) owned by the County shall be used for the District’s election.
In all of the District’s voting precincts, which share common boundaries or lie within the
boundaries of the District and the County shall share JBCs, eSlates and DAUs.
III.
The District agrees to appoint the Contracting Officer as the Clerk for Early Voting
and shall furnish wording on the ballots and election order necessary for Early Voting in the
election to be held at the expense of the District.
The District agrees that the shared locations for Early Voting will be the McLennan County
Elections Administration Office, located in the Records Building, located at 214 North Fourth,
Suite 300, Waco, TX 76701; Robinson First Baptist Church, located at 104 E. Stegall Rd.,
Robinson, TX 76706; Waco Multi-Purpose Community Center, located at 1020 Elm Street,
Waco, TX 76704; First Assembly of God Church, located at 6701 Bosque Blvd., Waco, TX
76710; and Brazos Meadows Baptist Church, located at 625 S. Hewitt Dr., Hewitt, TX 76643.
The above-mentioned wording on the ballot(s) and election order(s) shall be delivered
to the Elections Administrator upon completion of the ballot drawing for a place on the ballot
prior to the commencement of Early Voting in the election to be held at the expense of the
District. The Contracting Officer/McLennan County shall bear the full cost for the Early
Voting locations’ personnel, at an hourly rate of $10.00 and an overtime rate of $15.00 per
hour for Presiding Judges; an hourly rate of $9.00 and an overtime rate of $13.50 for Alternate
Judges and an hourly rate of $8.00 and an overtime rate of $12.00 for Clerks; and a $25.00
pick-up and delivery fee for Early Voting supplies.
The District will forward any requests received for a ballot by mail to the McLennan
County Elections Administrator for processing. The District shall pay to the County the actual
cost incurred for materials and postage for the distribution of ballots by mail.
The Contracting Officer shall provide to the District one (1) copy of the Early Voting
report via email on a daily basis and a cumulative final Early Voting report following the
election.
IV.

The Contracting Officer shall have the District’s sample ballots, printed to cover the
District’s election, in accordance with Texas Election Code, Section 124.004. In all of the
District’s voting precincts, which lie within the boundaries of the District, the ballots shall
include the selection of elective officers for the District.
V.
In all instances covered by Article I of this contract, the Contracting Officer shall cause
the HART eSlate voting equipment to be delivered to the Election Day voting places and Early
Voting places at least one (1) hour before the time set for opening the polls in each voting
precinct, pursuant to Texas Election Code, Sections 125.001, 125.004, 125.061, 127.032-.065.
VI.
The District shall bear the full cost of the rent or pay a pro-rata share, if applicable, for
all voting places contemplated by Article I of this contract.
VII.
The District shall bear the full cost or pay a pro-rata share, if applicable, for any
equipment as deemed necessary and/or desirable for the holding of said election and cause
same to be delivered to the voting places of the District.
VIII.
The District shall bear the full cost or pay a pro-rata share, if applicable, for the
employment and/or use of such personnel as the Contracting Officer deems necessary or
desirable to prepare for and conduct Early Voting.
IX.
The District shall bear the full cost or pay a pro-rata cost for the employment and/or
use of such personnel as the Contracting Officer deems necessary to program and operate the
automatic tabulating equipment in accordance with Texas Election Code, Sections 124.066,
127.001-.006, 127.121-122.
X.
The District shall appoint, bear the full cost of or pay a pro-rata share for the presiding
judges and clerks in the voting precincts, which lie within the limits of the District, including
the cost for the election personnel to attend an election school held by the designated
Contracting Officer for the training of Election Day judges and alternate election judges
pursuant to the Texas Election Code, Sections 32.091 - .093 and 271.013, for their services in
connection with the election to be held at the expense of the District. The election school will
not exceed four (4) hours in length. Election Day personnel will be compensated at an hourly
rate of $10.00 for Presiding Judges; an hourly rate of $9.00 for Alternate Judges and an hourly

rate of $8.00 for Clerks; and a $25.00 pick-up and delivery fee for Election Day supplies.
The Contracting Officer shall appoint the Presiding Judge and Clerks of the Early
Voting Ballot Board to process Early Voting results pursuant to Texas Election Code, Sections
87.001 - .025, 87.101, and 87.103. The District shall pay a pro-rata cost for the Presiding Judge
and Clerks of the Early Voting Ballot Board.
XI.
The Contracting Officer will provide the preparation of programs and test materials
for tabulation of voting equipment and of ballot by mail materials, supervision of handling and
disposition of election returns and preparation of the tabulation for the official canvass in
accordance with Tex. Elec. Code, Section 31.094.
XII.
The Contracting Officer will provide advisory services in connection with decisions to
be made and actions to be taken by the responsible parties of the District.
XIII.
The District shall pay to the County an Administrative Fee of ten (10) percent of the
total amount of the contract for administering the election.
XIV.
It is understood that the County will incur costs and expenses in connection with the
making of arrangements and preparations for the election, and that in the event the election to
be held at the District is enjoined or canceled, or if for any reason whatsoever the District shall
decide not to proceed with the election to be held at the expense of the District or if the date of
the election to be held by the respective parties is postponed or otherwise changed, the District,
shall be obligated to pay the County for the amount specified in Article XIII of this contract,
which is agreed to be a fair and reasonable estimate of the costs and expenses incurred, or to
be incurred, by the County in making such arrangements and preparations and the loss of
damage to be sustained by the County in such event.
XV.
In connection with the performance of this contract, neither McLennan County nor the
Administrator shall be liable to third parties for any default of the District in connection with
the holding of the joint election, including the failure by such entities to pay any expenses
hereunder, and such Entities shall not be liable to third parties for any default of the
Administrator in connection with the holding of the joint election.
XVI.

Except as herein expressly provided otherwise, each party hereto shall do all things that
may be required in connection with the election to be held at its expense. The District shall be
responsible for the preparation of election resolutions and other pertinent documents for the
adoption or execution by the proper officer of said party, and no party hereto shall have the
responsibility or duty in connection with such preparations by any other party thereto. The
Contracting Party will prepare the Notice and Order of Election and submit the documents to
the entities for execution by the proper officers. The District shall likewise be responsible for
posting or publication of election notices and no party hereto shall be responsible for the
posting or publication by any other party hereto.
XVII.
It is understood that to the extent space is available that other districts and political
subdivisions may wish to participate in the use of the above-mentioned election equipment and
voting places, and it is agreed that the Contracting Officer may contract with such other
districts or political subdivisions for such purposes and that in such event there may be an
adjustment of the pro-rata share to be paid to the County by the District under this contract.
XVIII.
It is estimated that the District’s obligation there under shall not exceed thirteen thousand five
hundred eighty-six dollars and seventeen cents ($13,586.17) and the District agrees to pay a
deposit of fifty (50) percent of said amount to McLennan County for an amount of six
thousand seven hundred ninety-three dollars and nine cents ($6,793.09) within five (5) days
after the District’s execution of this contract. The exact amount of the actual cost of the
District’s obligation hereunder shall be calculated after the November 3, 2015 Election, and if
the amount of the District’s obligation exceeds the amount deposited, then, in the event, the
District shall pay to McLennan County the balance due within thirty (30) days after the receipt
of the bill from the Contracting Officer detailing actual costs. However, if the amount of the
District’s obligation is less than the amount deposited, then and in that event, McLennan
County shall refund to the District the excess amount paid within thirty (30) days after a final
bill detailing the cost of the election has been provided to the District.

known as “Jump Start.”

Sykes, Waco ISD Board Member, serves on the appraisal district board. Nominations
