Italian Citizenship Through Marriage A spouse of an Italian citizen in possession of a foreign citizenship or who is stateless can acquire Italian citizenship after the marriage is celebrated and resides within the territory of the Republic for at least two years or three years from the date of marriage if residing abroad and if, at the moment the decree granting citizenship is issued there have been no separations or is separated or divorced. The timeframes indicated above are halved in the event children are born or adopted. The application – which in itself does not determine any acceptance of citizenship nor provide unreasonable rights – is sent from the Consulate to the Italian Ministry of Interiors who will issue a decree granting citizenship once processed and approved (approximate processing time: 18/24 months). Exempt from the above process are women married to Italian citizens whose marriage was celebrated prior to 27 April 1983 who acquire Italian citizenship automatically (on the condition that no divorce or separations have taken place or if the spouse did not pass away before 27.04.1983) as per the legislation. The applicant must provide their birth certificate in original with either an apostille or legalisation, translation in Italian and photo identification. For the submission of the application it is necessary for the marriage to be registered in Italy in the event the marriage was celebrated abroad. Subsequent to the introduction of Italian Law n. 94, article 9, paragraph 2 of 15.07.2008 which took effect on 8 August 2009, all applications for citizenship through marriage are subject to a payment of Euro 200. This payment is compulsory and can be deposited via international bank transfer or through the Eurogiro network (a network of international postal organisations bound by a convention). The applicant will have to register at : https://cittadinanza.dlci.interno.it 2. After the login , the applicant will find a “CITIZENSHIP” section containing the following subtitles: • Compila ed Invia la domanda with this option the apllicant will have the possibility to submit the application. • visualizza stato della domanda, it allows the applicant to check the status of the submitted application. • primo accesso alla domanda, it allows the applicant to check the status of the submitted application for the first time after submitted. • comunicazioni, it allows to visualize any communications regardings the submitted application. By choosing “GESTIONE DI DOMANDA” the applicant will have the possibility to submit his/her application by completing the form: MODELLO AE. 3. All personal data used when lodging the application on line (e.g. name / surname etc) must be the same as they appear on applicant’s birth certificate or in the certificate of change of name and surname. Note: In the event that there are discrepancies with information reported in the documents it will be necessary to request an amendment from the relevant authority. 4. The applicant must complete the form in its entirety and upload the requested documentation a. Prof of the marriage registration in Italy, issued by the relevant Italian Municipality. (The applicant must contact the relevant Italian Municipality to get a marriage certificate, called “Estratto dell’Atto di Matrimonio) b. Birth certificate in original with apostille or legalisation, translated into Italian which all provide the exact name, surname, date and place of birth, father and mother. c. Australian Federal Police Certificate (www.afp.gov.au), with apostille and translation in Italian. This certificate is valid for six months; similar certificates from other Authorities if the applicant was resident overseas in the past (since the applicant was 14 years old). Please NOTE: In the event that certificates above mentioned are obtained from outside Australia or Italy, it remains the responsibility of the applicant to consult the website of the relevant Italian Consulate in the location where the document is issued in order to establish how to legalise the certificate in question in order to render it valid in Italy. Once this has been established the applicant must proceed with acquiring the document from the local authorities in that country and have it legalised. If the issuing country is a signatory to Hague Convention of 5 October 1961 an apostille will be sufficient. In both circumstances the certificate must be submitted together with a translation. d. Receipt of payment of the 200 Euro fee e. Valid identification (passport) The applicant may save, modify, cancel or submit the completed application. Please note that once the application has been submitted, it cannot be modified. Due to this, any error in the information submitted, including typing errors, will cause the rejection of the application by this Consulate and the applicant will need to repeat the application. 4. After reviewing the submitted application the Consulate may: - accept the request - request additional documentation or request that documents be amended - reject the application Once the application is accepted, the applicant will be requested to submit to this Consulate all of the original documentation and to make the necessary payments (stamp duties). The applicant will get instruction per email by the Consulate of Italy in Brisbane.
