Mercoledì 13 luglio 2016 Per maggiori informazioni: [email protected] Novità riguardanti la definizione di esportatore ai sensi del Nuovo Codice Doganale News regarding the definition of exporter according to the New Customs Code di Francesco Pizzo e Lorenzo Ontano Il 7 luglio 2016, con Nota n. 70662, l’Agenzia delle Dogane ha fornito alcune precisazioni in merito alla definizione di esportatore ex art. 1, punto 19, del Regolamento delegato UE n. 2015/2446. The Italian customs authorities issued, on July 7, 2016, the Note no. 70662 providing some clarifications with reference to the definition of exporter provided by article 1, point 19, of the Delegated Regulation (EU) 2015/2446. In particolare, ai sensi del suddetto articolo, si definisce esportatore “la persona stabilita nel territorio doganale dell’Unione che, al momento dell’accettazione della dichiarazione, è titolare del contratto concluso con il destinatario nel paese non-UE e ha la facoltà di decidere che le merci devono essere trasportate verso una destinazione situata al di fuori del territorio doganale dell’Unione”. According to the above-mentioned provision, exporter is “the person established in the customs territory of the Union who, at the time when the declaration is accepted, holds the contract with the consignee in the third country and has the power for determining that the goods are to be brought to a destination outside the customs territory of the Union”. A tal riguardo, l’Agenzia delle Dogane, con la Circolare n. 8/D del 19 aprile 2016, in un primo momento aveva indicato che qualora un operatore stabilito in un paese non-UE avesse inteso presentare una dichiarazione di esportazione, lo stesso avrebbe dovuto nominare un rappresentante doganale stabilito nella UE che agisse in qualità di esportatore per suo conto. In pratica, ciò significava che il rappresentante doganale dell’operatore non-UE sarebbe figurato nel campo 2 della dichiarazione doganale quale soggetto esportatore. In this respect, the Italian customs authorities issued, at first instance, the Circular Letter no. 8/D on April 19, 2016, clarifying that a non-EU company, in order to exports goods from Italy, had to appoint an Italian customs broker acting as exporter. In practice, the customs broker of the non-EU company had to be mentioned in the box 2 of the customs declaration as the exporter. La Nota n. 70662 adesso ha chiarito, invece, che “durante il periodo transitorio (1° maggio 2016/1° maggio 2019) il nome, l’indirizzo e il numero EORI del soggetto stabilito in un paese non-UE che esporta merci dall’Unione possa essere indicato nella casella 2 del DAU come soggetto speditore, a condizione che la dichiarazione doganale di esportazione sia presentata da un rappresentante doganale stabilito nell’Unione che operi in rappresentanza indiretta e che, in qualità di dichiarante nonché esportatore, sia indicato nella casella 14 del DAU”. The Note no. 70662 is clarifying that “during the transitional period (May 1, 2016/May 1, 2019) the name, address and EORI number of the person established in a non-EU country exporting goods from the EU can be indicated in the box 2 of the SAD as consignor, provided that the customs export declaration is issued by a customs broker established in the EU operating via indirect representation and that the latter is included in the box 14 of the SAD as declarant and exporter. Alla luce di tale chiarimento, torna ad applicarsi la prassi operativa antecedente l’entrata in vigore del Nuovo Codice Doganale.
