Condizioni generali di vendita e garanzia
La FIAC S.p.A. garantisce i prodotti da qualsiasi difetto di progettazione e fabbricazione
per un periodo di 12 mesi dalla data di installazione, la quale deve essere comunicata
a FIAC S.p.A. tramite debita compilazione della cartolina di garanzia o per mezzo del
modulo presente sul sito www.fiac.it. In assenza di comunicazioni, la garanzia sarà
riconosciuta per 12 mesi a partire dalla data riportata sulla fattura FIAC di vendita.
a) Sono escluse dalla garanzia le parti che per loro impiego specifico sono soggette
ad usura.
b) Qualsiasi intervento in garanzia può essere effettuato esclusivamente dalla FIAC
S.p.A. o dai Centri di Assistenza Tecnica Autorizzati dalla FIAC S.p.A.
c) La spedizione di qualsiasi prodotto alla FIAC S.p.A., per qualsiasi tipo d’intervento
in garanzia, deve essere preventivamente autorizzata in forma scritta dalla FIAC
S.p.A., la quale deciderà, a proprio insindacabile giudizio, se autorizzarla o avvalersi
dell’intervento di un proprio Centro Assistenza Tecnica Autorizzato.
In ogni caso, la spedizione alla FIAC S.p.A. dovrà avvenire in porto franco e la
restituzione sarà effettuata con l’addebito delle spese di spedizione.
d) La garanzia comprende la riparazione o la sostituzione gratuita dei componenti
dell’apparecchio, riconosciuti difettosi dai nostri tecnici autorizzati.
e) La garanzia decade per danni provocati accidentalmente, da incuria, uso ed
installazione errati, impropri o non conformi alle avvertenze riportate nel “libretto di
uso e manutenzione”; nonché nel caso di modifiche o riparazioni effettuate con ricambi
non originali FIAC e/o da personale non autorizzato dalla FIAC S.p.A. Tutti gli elementi
difettosi sostituiti in garanzia, vengono ritirati dal centro assistenza autorizzato.
f) È escluso dalla garanzia qualsiasi riparazione o risarcimento per danni intervenuti
durante il trasporto (in andata al o in ritorno dal Centro Assistenza Tecnica Autorizzato).
g) È escluso qualsiasi tipo di risarcimento per danni causati a persone e/o cose, derivanti
da un mancato/inadeguato uso del modello acquistato e/o dal fermo macchina (deve
essere cura del cliente cautelarsi per questa evenienza).
h) L’assistenza per gli apparati in garanzia è ottenibile solamente dall’acquirente in
regola con le norme contrattuali e amministrative che presenti specifica documentazione
attestante il periodo di acquisto.
i) Questa è l’unica garanzia validamente riconosciuta dalla FIAC S.p.A.. Nessuno è
autorizzato a rilasciarne altre verbali o scritte, o a modificarne i termini.
FORO COMPETENTE
Per qualsiasi controversia sarà esclusivamente competente il Foro di Bologna.
1 - CONDIZIONI DI VENDITA
Gli ordini inviati per l’acquisto di prodotti della FIAC S.p.A. comportano l’accettazione,
senza riserve, delle condizioni di fornitura sotto indicate, parte integrante del contratto
di vendita. Eventuali variazioni dovranno essere approvate dalla FIAC S.p.A. attraverso
l’invio della conferma di vendita, inviata solo su esplicita richiesta del committente, ed
avranno valore solo per le vendite a cui si riferiscono.
2 - ORDINI
Saranno ricevuti dalla FIAC S.p.A. sempre con la clausola “salvo accettazione della
casa”. Le condizioni di fornitura descritte si intendono approvate dal cliente con la
trasmissione dell’ordine stesso. L’ordine del cliente si ritiene impegnativo e non può
essere ridotto o annullato, salvo il caso in cui il termine di consegna superasse di tre (3)
mesi quello indicato per iscritto dalla FIAC S.p.A. Durante la trasmissione dell’ordine
in caso di discordanza tra codice e descrizione dell’articolo, verrà data precedenza
al codice. Le ordinazioni effettuate tramite ns. agenti, rappresentanti od incaricati
sono sempre subordinate all’approvazione da parte della FIAC S.p.A.. Esse debbono
quindi ritenersi impegnative solamente se confermate con l’invio della Conferma di
Vendita (su esplicita richiesta del committente). Per ordini inferiori a Euro 150,00 netti
(imponibile merce) il pagamento dovrà avvenire in contrassegno e sarà applicato in
fattura un addebitato extra di Euro 10,00 a titolo di spese fisse. La merce viene venduta
franco nostro stabilimento.
3 - TERMINI DI CONSEGNA
L’evasione dell’ordine è subordinata alla disponibilità di magazzino ed alla possibilità di
fabbricazione, non dando quindi garanzia di saldo. La FIAC S.p.A. pertanto si riserva
la facoltà di evadere l’ordine in diverse riprese. La mancata consegna parziale o totale
dell’ordine non può dare luogo ad alcun diritto di rivalsa o di richiesta di danni, né
di annullamento o riduzione dell’ordine a meno di quanto descritto in precedenza,
né ritardo dei pagamenti, da parte del cliente alla FIAC S.p.A. I termini di consegna,
eventualmente comunicati, sono da intendersi approssimativi. La FIAC S.p.A. non
risponde inoltre per ritardi provocati da forza maggiore.
La FIAC S.p.A. potrà rifiutare annullamenti di ordini per modelli non a stock ordinati
esplicitamente su richiesta del cliente.
4 - SPEDIZIONI
La merce viene consegnata franco fabbrica e pertanto viaggia a rischio e pericolo
del committente. In caso di ritardo, avarie, furti, manomissioni o perdita durante il
trasporto, il destinatario dovrà rivolgersi esclusivamente ai vettori. La FIAC S.p.A. declina
ogni responsabilità verso il committente e verso il destinatario. Prima di prendere in
consegna le merci si raccomanda di controllare il peso e l’integrità del contenuto ed il
numero di colli. In caso di contestazione si ricorda di elevare riserva sul documento di
trasporto facendola controfirmare con data ed ora dall’autista.
5 - IMBALLI
La FIAC S.p.A. consegna il materiale in adeguati imballi o pacchi i quali vengono forniti
a titolo gratuito. Eventuali ammanchi nel numero dei pezzi (anche confezioni sigillate)
dovranno essere segnalati entro 8 giorni dal ricevimento della merce tramite lettera
raccomandata.
Trascorso detto limite la merce si riterrà tacitamente accettata. Eventuali imballi in
casse, gabbia o simili saranno addebitati al costo.

6 - PREZZI
Valgono i prezzi di listino (I.V.A. esclusa) in vigore al momento dell’ordine, che annulla
e sostituisce tutti i precedenti e le eventuali relative condizioni di sconto indicate con
lettera separata.
La FIAC S.p.A. si riserva la facoltà di variare il Listino in ogni momento e senza preavviso.
I pagamenti devono essere eseguiti al domicilio della FIAC S.p.A., nel modo indicato
sulla fattura. I pagamenti devono essere eseguiti puntualmente alle scadenze stabilite
anche nel caso di prodotti riscontrati difettosi il cui reclamo è regolato dal punto 8.
7 - PAGAMENTI
In caso di mancato pagamento da parte della clientela alle scadenze pattuite, la FIAC
S.p.A. si riserva il diritto di variare le condizioni d’ufficio a pagamento anticipato. La
FIAC S.p.A., in caso di mancato pagamento da parte della clientela, provvederà a
sospendere le forniture, riattivandole a pagamento avvenuto.
Il ritardo nel pagamento della fattura, anche se parziale, fa sorgere il diritto della
FIAC S.p.A. ad esigere, con decorrenza immediata, l’interesse secondo il disposto D.L.
231/2002. La FIAC S.p.A. si riserva la facoltà di variare in ogni momento le condizioni
di pagamento.
8 - RESTITUZIONI DI MERCE
La FIAC S.p.A. accetta resi di macchine, accessori, ricambi riconoscendo il 100%
dell’importo e gli oneri di trasporto qualora l’errore sia generato dalla stessa. In ogni
caso non saranno accettati resi non preventivamente autorizzati in forma scritta. Inoltre
non saranno autorizzati resi di merce fatturata da oltre 6 mesi dalla richiesta di reso.
9 - CARATTERISTICHE DEI PRODOTTI
Tutti i prodotti messi in commercio da FIAC S.p.A. sono costruiti nel rispetto delle leggi
vigenti e dalla sicurezza dell’utilizzatore finale.
I dati tecnici, le dimensioni e le caratteristiche riportate sui cataloghi potrebbero subire
variazioni senza preavviso. Le eventuali modifiche apportate non disimpegnano il
cliente dalla fornitura, né possono dar luogo a rivalse da parte di quest’ultimo.
10 - INFORMATIVA AI SENSI DELL’ART. 13 DEL D.LGS. 30 GIUGNO 2003, N. 196 CODICE IN MATERIA DI PROTEZIONE DEI DATI PERSONALI
I dati personali forniti dal cliente saranno trattati dal titolare FIAC S.p.A., con sede in
Via Vizzano n. 23, 40037 Pontecchio Marconi (Bologna), Italia, (di seguito “FIAC”),
con strumenti automatizzati e non, nel rispetto di quanto previsto dal D.Lgs. 30 giugno
2003, n. 196 - Codice in materia di protezione dei dati personali, esclusivamente ai
seguenti fini: per dare esecuzione al presente contratto ed adempiere a tutte le relative
prestazioni ed obbligazioni, ivi comprese le prestazioni di garanzia, e per svolgere analisi
e ricerche statistiche in forma anonima. A tali esclusivi fini i suoi dati potranno essere
comunicati ad operatori contrattualmente legati a FIAC (quali spedizionieri, corrieri,
istituti bancari e creditizi) e alle società ed operatori appartenenti alla rete distributiva
e di assistenza di FIAC (quali filiali, importatori, distributori, concessionari, rivenditori,
installatori, riparatori), eventualmente anche aventi sede in paesi non appartenenti
all’Unione Europea, e saranno portati a conoscenza dei Responsabili (se designati) e
degli Incaricati del trattamento nominati dal Titolare FIAC e dai suddetti soggetti. I dati
personali non saranno diffusi.
Il conferimento dei dati a tali fini è facoltativo, cioè non discende da un obbligo
normativo, ma è strettamente necessario per poter concludere e dare esecuzione al
presente contratto. Il mancato conferimento dei dati a tali fini non consentirà pertanto
di concludere il presente contratto e di darvi esecuzione.
Nella sua qualità di interessato il cliente gode dei diritti di cui all’art. 7 del Codice
privacy, di cui si riporta di seguito il testo:“1. L’interessato ha diritto di ottenere la
conferma dell’esistenza o meno di dati personali che lo riguardano, anche se non
ancora registrati, e la loro comunicazione in forma intelligibile. 2. L’interessato ha diritto
di ottenere l’indicazione: a) dell’origine dei dati personali; b) delle finalità e modalità
del trattamento; c) della logica applicata in caso di trattamento effettuato con l’ausilio
di strumenti elettronici; d) degli estremi identificativi del titolare, dei responsabili e
del rappresentante designato ai sensi dell’articolo 5, comma 2; e) dei soggetti o delle
categorie di soggetti ai quali i dati personali possono essere comunicati o che possono
venirne a conoscenza in qualità di rappresentante designato nel territorio dello Stato,
di responsabili o incaricati. 3. L’interessato ha diritto di ottenere: a) l’aggiornamento, la
rettificazione ovvero, quando vi ha interesse, l’integrazione dei dati; b) la cancellazione,
la trasformazione in forma anonima o il blocco dei dati trattati in violazione di legge,
compresi quelli di cui non è necessaria la conservazione in relazione agli scopi per i quali
i dati sono stati raccolti o successivamente trattati; c) l’attestazione che le operazioni
di cui alle lettere a) e b) sono state portate a conoscenza, anche per quanto riguarda
il loro contenuto, di coloro ai quali i dati sono stati comunicati o diffusi, eccettuato il
caso in cui tale adempimento si rivela impossibile o comporta un impiego di mezzi
manifestamente sproporzionato rispetto al diritto tutelato. 4. L’interessato ha diritto di
opporsi, in tutto o in parte: a) per motivi legittimi al trattamento dei dati personali che
lo riguardano, ancorché pertinenti allo scopo della raccolta; b) al trattamento di dati
personali che lo riguardano a fini di invio di materiale pubblicitario o di vendita diretta o
per il compimento di ricerche di mercato o di comunicazione commerciale”.

aggiornato dei Responsabili del trattamento designati da FIAC, è possibile

Sales and warranty general conditions
FIAC S.p.A. guarantees its products against all design and production defects for a
period of 12 months from the date of installation. This date must be submitted to FIAC
S.p.A. by fill in the warranty card or the form present on the website www.fiac.it . In
case of no information from the customer, the warranty will be valid for a period of 12
months from the date of FIAC invoice.
a) This warranty does not cover parts which, due to the use to their specific use are
subject to wear and tear.
b) Any warranty work must only be performed by FIAC S.p.A. or by a Service Centre
authorised by FIAC S.p.A.
c) Shipments of any goods to FIAC S.p.A. for any type of warranty work must only be
carried out after the written authorisation of FIAC S.p.A. who will decide, at its sole
discretion, whether to authorise such a return or whether to make use of the services
of an Authorised Service Centre. All shipments to FIAC S.p.A. must be made on a
carriage-paid basis and shipping costs will be charged for the return to the customer
of the products concerned.
d) This warranty covers the repair or replacement free of charge of components that
are recognised to be defective by our authorised technicians.
e) This warranty does not cover damage caused by accident, negligence or incorrect
or improper installation or use, including installation or use that does not comply with
the information contained in the “Maintenance Manual”. It also ceases to apply if
modifications or repairs using non-original FIAC parts are carried out by persons not
authorised by FIAC S.p.A. All defective parts replaced under warranty will be retained
by the authorised service centre.
f) This warranty does not cover the repair or the reimbursement of damage caused
during transportation (to or from the Authorised Service Centre).
g) This warranty does not cover any form of reimbursement for damage caused to
persons and/or objects deriving from the improper/inappropriate use of the model
purchased and/or downtime (it’s customer’s duty to safeguard itself from this event).
h) Warranty support for equipment is only available to those customers complying with
the contractual and administrative conditions of sale who present specific documentary
evidence of the date of purchase.
i) This is the only warranty recognised as valid by FIAC S.p.A. No-one is authorised to
give any other written or verbal warranties, or to modify these terms.
JURISDICTION
All disputes will be settled by sole reference to the Bologna Court.
1 - TERMS OF SALE
The submission of orders for the purchase of FIAC S.p.A. products implies acceptance,
without reservations, of the following terms of supply which are an integral part
of the sales contract. Any variations must be approved by FIAC S.p.A. by an order
confirmation, which will be sent only on request of the customer, and which will only
apply to that specific order.
2 - ORDERS
Orders are always received by FIAC S.p.A. with the clause “subject to acceptance by the
company”. Submission of an order implies acceptance by the customer of the stated
terms of supply. Orders from customers are firm and binding and cannot be reduced
or cancelled, unless the delivery time exceeds by three (3) months that communicated
in writing by FIAC S.p.A.
If on submission of the order the product code is not consistent with the product
description, then reference will be made to the product code. Orders placed via our
agents, representatives or salespersons are always subject to acceptance by FIAC
S.p.A. Accordingly, they are only binding if confirmed by the sending of an Order
Confirmation (on request of the customer).
With regard to orders of less than Euro 150.00 net (taxable value of goods),  payment
terms are cash-on-delivery or in advance and an additional charge of Euro 10.00 will
be added to the invoice to cover fixed expenses. Goods are sold on an ex works basis.
3 - TERMS OF DELIVERY
Completion of an order is subject to the availability of stock and production schedules
and, accordingly, there is no guarantee of fulfilment in one shipment.
FIAC S.p.A. therefore reserves the right to fulfil orders by making a number of
shipments. Partial or total failure to fulfil an order does not give the customer of FIAC
S.p.A. any right of redress or to claim damages, or to cancel or reduce the order,
unless in the circumstances described earlier, or to delay payments. Any delivery times
communicated are understood to be approximate. In addition, FIAC S.p.A. does not
accept liability for delays caused by force majeur. FIAC S.p.A. may refuse cancellations
of orders for models not carried in stock that have been ordered specifically by the
customer.
4 - SHIPMENTS
Goods are delivered on an ex works basis and, accordingly, travel at the customerâs
own risk. In the case of delays, damage, theft, tampering or loss during transportation,
the recipient must refer solely to the carriers since FIAC S.p.A. does not accept any
responsibility for this towards the customer or the recipient. Before accepting a delivery
of goods, we suggest that the weight, the number of packages and their condition
be checked. In the case of dispute, the reservations should be noted on the shipping
document and countersigned by the driver, adding the date and time.
5 - PACKING
FIAC S.p.A. delivers the goods with adequate packing or packaging that is supplied
free of charge.
Any shortages in the number of items (including those in sealed boxes) must be
reported by registered letter within 8 days of receipt. After this period of time, the
goods are deemed to have been tacitly accepted.
Any expenses for packaging in crates or cages or similar, will be debited at cost.
6 - PRICES
The price list in force (excluding VAT) at the time of the order, which cancels and
replaces all previous price lists, applies to the order together with any discount terms
specified in a separate letter.
FIAC S.p.A. reserves the right to amend the Price List at any time and without prior
notice. Payments must be addressed to FIAC S.p.A., on the basis indicated on the
invoice. Payments must be made punctually on the due dates established, even with
regard to products that are found to be defective, claims for which are governed by
point 8.
7 - PAYMENTS
If a customer fails to make a payment at the expiry date then FIAC S.p.A. reserves the
automatic right to change the payment terms to in advance. If a customer fails to make
a payment, then FIAC S.p.A. will suspend supplies until payment has been received.
Delays in the settlement, or partial settlement, of an invoice give FIAC S.p.A. the right,
with immediate effect, to demand default interest pursuant to Decree 231/2002.
FIAC S.p.A. reserves the right to amend the terms of payment at any time.
8 - RETURN OF GOODS
FIAC S.p.A. accepts returns of machines, accessories and spares, recognising 100%
of the amount and the transport costs, in the case of an error made by the Company.
In any case, no returns of goods will be accepted unless these have been specifically
authorised by FIAC S.p.A. in writing, and no returns of goods that have been invoiced
for more than 6 months from the request for return will be authorised.
9 - CHARACTERISTICS OF PRODUCTS
All products sold by FIAC S.p.A. are manufactured in compliance with laws and safety
of the user.
The technical information, sizes and characteristics included in the catalogues may be
amended without prior notice. Any changes do not release the customer from the
order committment and does not give the latter any right of redress.
10 - INFORMATION ACCORDING WITH ART. 13 D. LGS. 30 JUNE 2003, N. 196 CODE FOR THE PROTECTION OF PERSONAL DATA
Personal data provided by the customer will be treated by the holder FIAC SpA, located
in Via Vizzano No 23, 40037 Pontecchio Marconi (Bologna), Italy, (hereinafter “FIAC”),
with IT system and not in compliance with the provisions of D. Lgs. 30 June 2003, n.
196 - Code for the protection of personal data, exclusively for the following purposes:
to give effect to this contract and to fulfill all of its services and obligations, including
the after sale/warranty service and to perform statistical analysis and research in an
anonymous form. Under this exclusive purpose your data may be communicated to
operators contractually linked to FIAC (such as freight forwarders, couriers, banks) and
to companies and workers belonging to the FIAC distribution and servicing network
(such as subsidiaries, importers, distributors, dealers, installers, after sales centres), even
if located in countries outside the European Union, and will be brought to the attention
of Managers (if designated) and people in charge of the processing designated by the
Owner and FIAC by those entities. Personal data will not be disclosed.
The provision of data for such purposes is optional, it’s not a regulatory requirement,
but it is strictly necessary to conclude and give effect to this contract. The failure to
provide data for such purposes will not consent, therefore, to conclude this contract
and to carry it out.
The customer can exercise his rights under Art. 7 of the Privacy Code, that states:
“1. A data subject shall have the right to obtain confirmation as to whether or not
personal data concerning him exist, regardless of their being already recorded, and
communication of such data in intelligible form. 2. A data subject shall have the
right to be informed: a) of the source of the personal data; b) of the purposes and
methods of the processing; c) of the logic applied to the processing, if the latter is
carried out with the help of electronic means; d) of the identification data concerning
data controller, data processors and the representative designated as per Section 5(2);
e) of the entities or categories of entity to whom or which the personal data may
be communicated and who or which may get to know said data in their capacity
as designated representative(s) in the State’s territory, data processor(s) or person(s)
in charge of the processing. 3. A data subject shall have the right to obtain: a)
updating, rectification or, where interested therein, integration of the data; b) erasure,
anonymization or blocking of data that have been processed unlawfully, including data
whose retention is unnecessary for the purposes for which they have been collected
or subsequently processed; c) certification to the effect that the operations as per
letters a) and b) have been notified, as also related to their contents, to the entities to
whom or which the data were communicated or disseminated, unless this requirement
proves impossible or involves a manifestly disproportionate effort compared with the
right that is to be protected. 4. A data subject shall have the right to object, in whole
or in part, a) on legitimate grounds, to the processing of personal data concerning
him/her, even though they are relevant to the purpose of the collection; b) to the
processing of personal data concerning him/her, where it is carried out for the purpose
of sending advertising materials or direct selling or else for the performance of market
or commercial communication surveys.”
