THE ITALIAN COIN-OP GAMES SECTOR: GAME OVER? Given the great deal of confusion stirred up by the press and TV news, both national and regional, regarding the interpretation of the new law on video games in force as of January 1, 2001 and contained in three absurd articles of the 2001 budget, I will attempt to provide an answer to the following two questions: a) How has the new law been received by the operators in the sector? b) What new regulations have been added? He then managed to “protect” the text, by forcing the majority coalition to vote against any amendments presented, even by MPs from their own party, obtaining the following results: - a Budget that modified some of the fundamental articles from the code on public safety laws (this is incomprehensible and absurd even for someone as ignorant in “political ethics” as myself) - the immediate withdrawal from the market of hundreds of thousands of machines that had suddenly become illegal, despite being purchased and operating in full compliance with a national law, 425/ 95, in force until 31/12/00 - the impossibility of sourcing alternative machines, in that pinball machines (those recommended by Minister Bianco in his tragic-comical speech to the Senate on 18/12/00) are basically no longer produced, and video games (on top of the crisis caused by Internet, Playstation etc.) would be subject to a set of rules and new taxes (3 Ministerial Decrees, and Regulations yet to be issued) that would be justified only if applied to payout machines. These limits have on the other hand remained for the normal Pac-Man, Sega Rally, etc. Incredible! - the immediate application of the laws, in that even those amendments that requested some delay in the application of the laws either didn’t pass or were withdrawn in time to avoid a certain refusal and converted into ridiculous 44 THE EXPERT APPROACH come vincita un premio in denaro e riscrive la bozza del decreto in tre articoli della “sua” Finanziaria. Riesce poi a “blindare” tale testo, imponendo alla maggioranza di votare contro qualsiasi emendamento presentato, persino da parlamentari del suo partito, e ottiene i seguenti risultati: – una legge Finanziaria che modifica degli articoli fondamentali del testo Unico delle Leggi di Pubblica Sicurezza (cosa incomprensibile e assurda anche per un ignorante di “etica politica” come il sottoscritto) – il ritiro immediato dal mercato di diverse centinaia di migliaia di apparecchi divenuti improvvisamente illegali seppur acquistati e funzionanti nel pieno rispetto delle regole di una legge di stato, la 425/95, in vigore fino al 31/12/00 – l’impossibilità di trovare apparecchi alternativi in quanto i flipper (come consigliato dal ministro Bianco nel suo tragicomico intervento al Senato del 18/12/00) non vengono quasi più prodotti e i videogiochi (oltre alla crisi determinata da Internet, Playstation eccetera) dovrebbero sottostare a un insieme di regole e nuove tasse (3 Decreti Ministeriali e un Regolamento da emanare) che sarebbero state giustificate solo se riferite ad apparecchi distributori di monete. Queste restrizioni sono invece rimaste per il normale Pac-Man, Sega Rally eccetera. Cose da pazzi! – l’immediatezza nella applicazione delle legge in quanto anche gli emendamenti che chiedevano una qualsiasi dilazione nell’applicazione della legge sono stati o bocciati o ritirati in tempo per evitare una “stroncatura” certa, e convertiti in compassionevoli “ordini del giorno”. A che “pro” tutto questo, visto che il risultato certo sarà la scomparsa di aziende come la mia che da vent’anni raccoglie i migliori tecnici che escono dalle scuole padovane (uomini e donne), li istruisce e specializza in questo settore e che – è solo ormai questione di giorni – dovrà licenziarli tutti e venti, persone sposate con famiglia a carico, impe- gni con mutui eccetera? Non migliore sorte subiranno moltissimi esercizi pubblici che dai giochi ricavavano quella parte degli utili necessaria a sopperire alla grave crisi che ha colpito già da tempo il loro settore commerciale. Cosa ha voluto fare il signor Visco? Non certo debellare il gioco d’azzardo perché ora che tutto è proibito, ritornerà in auge il gioco clandestino degli anni ‘90, effettuato nei circoli privati, nei sottoscala, negli antibagni, con l’uso di chiavi nascoste, telecomandi, interruttori a trasponder, e altro. Non certo far sparire la mafia, questo “tumore” italiano che ha fatto sì sporadicamente il suo atto di presenza anche nel settore dell’automatico ma non sarà certo debellato eliminando il gioco a premi. In realtà Visco aveva un altro progetto molto più chiaro ed esplicito: avendo fallito completamente le previsioni sugli incassi e la gestione dei “giochi d’azzardo di stato” (basti pensare al Gratta & Vinci, Sale scommesse, SuperEnalotto) ha cercato un capro espiatorio per i suoi errori e l’ha trovato nei nostri giochi. Contro gli 80 mila occupati in questo settore che se ne andranno a spasso, ha promesso di collocarne meno della metà con l’apertura delle sale bingo! Ma se la prima cifra è sicura la seconda è solo virtuale. A fronte delle 535 mila lire annue (anticipate) che paghiamo di soli tributi SIAE per ogni apparecchio in funzione, del 50-60% dei nostri utili netti che versiamo come IRPEF (anche gli “utili” minimi garantiti per apparecchio sono stabiliti, seppur solo ai fini IVA, per legge dallo stato in oltre 3 milioni l’anno), dei contributi che sborsiamo per i nostri dipendenti, dell’ICI, l’IRPEG, e di tutto l’indotto, il signor Visco ha “presunto” un maggior introito per lo stato procurato dai poveri giocatori che, non trovando i nostri apparecchi nei, bar saranno costretti a giocare al Lotto o al TotoBingol e andranno così ad aumentare il gettito di 1.400 miliardi l’anno (da distribuire ai pensionati “agenda items”. Not certainly fight the mafia, this Italian “cancer” that has certainly at times been part of the coin-op games sector, but which surely won’t be affected by eliminating games with prizes. In reality, Visco’s plan was much clearer and more explicit: as the management of “official games of chance” has failed (Scratch & Win, betting shops, SuperEnalotto), he needed a scapegoat for his mistakes, and found this in our games. Against the 80,000 people employed in this sector who will be on the streets, he promised that less than a quarter would be employed in the soon-to-be-opened bingo, halls! Against the 535,000 lire (over 270 euro) per year (paid in advance) that we pay in royalties for each machine operating, the 50-60% of our net profits that we pay as income tax (even the minimum net profits per machine have been established, even if only for VAT purposes, by law at over 3 million lire per year, over 1,500 euro), the welfare contributions we pay for our employees, property tax and company tax, Mr. Visco “assumed” greater government income from the poor players who, no longer finding our machines in bars, are forced to play the lottery or TotoBingol, and will thus increase tax income by 1,400 billion lire, over 720 million euro (100,000 lire, 50 euro, per month more for pensioners: a promise which had not been maintained at the end of the first month of the law). If we had managed our own firms with the same criteria, we would have gone bankrupt before opening: certainly at the next election Italians will remember these “bureaucrats”, and will think about the personal involvement of eminent members of the majority coalition in favour of Bingo. I am also sure that I too will be forced to forget my beliefs for a while and remember that I have many debts to pay to my suppliers, which I most likely will not be able to pay if my customers, instead of paying me, return the machines I sold them in good faith, and in compliance with the law in force up until December 31, 2000. b) law 388, 23/12/2000, amends 4 different pieces of legislation, that is: 1) art. 86 of TULPS (code on public safety laws), which also requires that distributors (who knows who they are!) and operators of amusement machines that “allow extended or repeat games” have a special “license”. This would have been a good result if it guaranteed technical certainties regarding the coin-op machines and moral certainties for their owners. Yet to manage a Pac-Man, and have to present documents (example?), no impediment certificates (who to?), pay royalties (where?), etc., seems like an elephant giving birth to a mouse! It will mean eliminating those few video games that are still present in bowling centres and youth centres, and those “pure” manufacturers and sellers, who won’t be able to sell any new products in 2001, given that to this they need to have applied for and obtained the required ‘no impediment’ certificate. 2) art. 110 of TULPS, which establishes what games are allowed. According to Ministers Visco and Bianco, only two types of games would be allowed, established in paragraph 5 and 6: the first type includes simple pinball machines or video games, such as Virtua Striker, driving simulators, etc., that is, those games commonly present in arcades, whose only prize is the extension or repeat of the game, with the purchase of “balls” or “lives”, to a maximum of ten games on the same machine. I hope that we don’t reach the point where, if a police officer discovers that an especially good pinball player is able to win 11 games, the officer arrests the player and gives him or her a hefty fine, has the bar closed and arrests the barkeeper, the operator, the manufacturer (as well as their uncles and grandfathers), while making sure the government earns a few extra million in fines. As I said, the criminal and administrative sanctions have remained the same as those which should have accompanied the use of “European” AWPs with cash prizes. These games should also last at least 12 seconds, for a maximum cost of 1,000 lire (0.5 euro). Here too there are a number of colossal errors: a driving simulator, that costs for example 40 million lire (around 20,000 euro), has to be played for 1,000 lire, and thus will never pay for itself; at the same time, if an “idiot” loses the 3 balls in a game of pinball in 11 seconds, he and a series of other innocent citizens will go to jail! The second type of games, kindly granted to the coin-op games sector by the pair of Ministers mentioned above, is in paragraph 6, and includes “cranes” or, more generally, redemption machines, that is, those games in which only physical, mental and strategic ability allow the player to win a puppet, watch or other gadget. For these machines, which to be economically viable need to work using a banknote reader, the Minister only allowed operation using coins or tokens, with a limit, here too, of 1,000 lire, and maximum value of the prize as 10,000 lire and which must be disbursed directly by the machine at the end of the winning game. Se noi avessimo gestito le nostre aziende con questi criteri, le avremmo fatte fallire prima ancora di nascere: sicuramente alle prossime elezioni gli italiani si ricorderanno di questi “burocrati”, e forse si interrogheranno anche sui perché di questo personale coinvolgimento di eminenti esponenti dell’attuale maggioranza per il Bingo. E lo stesso farò io, ignorando il mio credo, pensando ai debiti verso i miei fornitori, ai quali difficilmente potrò far fronte se i miei clienti, invece di pagarmi, mi restituiranno gli apparecchi che ho venduto loro in buona fede e in conformità alla legge vigente fino al 31 dicembre 2000. b) La legge 388 del 23/12/2000 va a modificare quattro diversi documenti legislativi preesistenti e precisamente: 1) l’art. 86 del TULPS che prevede anche per i distributori (ma si sa chi sono!) e i gestori di apparecchi da trattenimento che “distribuiscono prolungamenti e ripetizioni di partita” l’acquisizione di una particolare “licenza”. Ciò sarebbe stato un bel risultato se si trattava di garantire certezze tecniche per gli apparecchi a moneta, e morali per i loro proprietari. Ma per gestire dei Pac-Man dover presentare documenti (quali?), richieste di ‘Nulla Osta’ (a chi?), bollette SIAE (da pagare dove?) eccetera, mi sembra il classico elefante che partorisce un topolino! Significherà far sparire quei pochi videogiochi che ancora sono presenti nelle sale bowling e nei patronati, e quei produttori e rivenditori “puri” che non potranno vendere alcun prodotto nuovo sul mercato nel 2001 dato che per farlo dovrebbero aver richiesto, ed ottenuto, il relativo ‘Nulla Osta’. 2) l’art. 110 del TULPS che stabilisce quali sono i giochi permessi. Secondo le intenzioni della coppia Visco-Bianco, si tratterebbe di due sole tipologie di giochi, fissate dai comma V e VI : la prima tipologia 45 comprende i semplici flipper o i videogiochi come Virtua Striker, i simulatori di guida eccetera, cioè quelli normalmente presenti nelle sale giochi, che danno come unico premio il prolungamento del gioco con l’acquisizione di “palline” o “vite” fino alla possibilità di una vincita massima di dieci partite rigiocabili nello stesso apparecchio. Che non succeda che, se un poliziotto scopre che un giocatore particolarmente bravo a giocare a flipper riesce a vincere 11 partite lo arresti e gli dia una multa molto salata, faccia chiudere il bar e arresti anche il barista, il gestore, il produttore (forse anche gli zii e i nonni), facendo confluire contemporaneamente alle casse dello stato decine di milioni per multe varie. Come ho già detto le sanzioni penali ed amministrative sono rimaste le stesse che avrebbero dovuto accompagnare l’impiego di Awp “europei” con premi in moneta. Tali giochi dovranno inoltre durare almeno 12 secondi per un costo partita massimo di mille lire. Anche qui ci sono degli svarioni colossali: si impone a un simulatore di guida, che magari costa 40 milioni, di funzionare a mille lire, e quindi lo si condanna a non pagarsi mai; e nel contempo se dovesse capitare che un “imbranato” perde le tre palline di un flipper in 11 secondi, va in galera lui e una sfilza di altri incolpevoli cittadini! La seconda tipologia di giochi, benevolmente concessa al settore dell’automatico dalla suddetta coppia di ministri, rientra nel comma VI e comprende le “gru pesca” o, più genericamente, i redemption, cioè quei giochi dove la sola abilità fisica, mentale e strategica consente al giocatore di vincere un pupazzo, un orologio, o altri gadget. Per questi apparecchi, che per essere economicamente convenienti avrebbero l’esigenza di funzionare con un lettore di banconote, il bravo Ministro ha reso obbligatorio il funzionamento solo tramite monete o gettoni, con un limite, anche qui, di mille lire e la vincita di un pupazzo o altro oggetto del valore massimo pari a 10 mila lire, pupazzo che dovrà essere erogato direttamente dal gioco alla fine newspapers and TV news bulletins reported the rules of the new law referred to this second type of game, which is present only in large games arcades in bowling centres or cinema complexes, creating a great deal of confusion for bar operators who, not knowing the actual contents of the new law, risk jail sentences by continuing to hand out vouchers in exchange for the tickets won on the prize machines operating under the old law 425/95. Certainly, the clever ones will make video-poker machines with distributors necklaces, rings, medals, etc. which, once leaving the machine, will possibly be converted into money and replaced in these distributor, in a kind of continual cycles. Those who use these machines will also be exonerated from having to apply the ‘12 seconds’ rule and from a plethora of documents and responsibilities, because this was the original intent of the famous law on “coin for coin” that rightly exempted electromechanical machines from useless red tape, while overall there will be confusion in the police force, and a lot of tension between operators. 3) Articles 38 and 39 are added, which contain an infinitude of restrictions for distributors and operators that I won’t mention here, given the continual overlapping of ridiculous provisions without even the most basic indications on how to enact them. We will await the intervention of SAPAR among the relative under-secretaries in the hope that they will at least accept the responsibility to repair the major damage caused by their bosses. 4) So as not to contradict themselves, our lawmakers, while not mentioning it all, maintained articles 2 and 3 of the old law 425/95, which envisage the issuing of regulations enacting such law (now the new law). Eureka! Doesn’t the Minister remember that these “Regulations” had been requested by the Associations for 5 years, and that the 3 Ministries involved never managed to issue them? Will they manage this time? I doubt it! Will this be the law that stops children from killing their parents to steal the money to play video-poker machines, mums from holding up post offices, workers from wasting their savings, and so on (problems caused by law 425/95, as Visco THE EXPERT APPROACH della partita vincente. In ogni caso è utile ricordare che l’equivalenza “partita pari a 2 mila lire con vincita pari a 20 mila” è errata e pericolosissima: errata perché la moneta metallica Euro non è ancora in circolazione e pericolosissima perché 1 Euro non corrisponde a 2 mila lire e, con i tempi che corrono, anche le 63,73 lire di differenza potrebbero portarci in galera! Per complicare la vita, specie ai costruttori, Visco non ha tenuto poi in nessun conto un emendamento suggerito dalla Sapar, nel quale si cercava di conferire una caratteristica tecnico-costruttiva ben definita a quest’ultima tipologia di apparecchi, quelli di abilità, che dovevano infatti essere di natura “elettromeccanica”, cioè tali che l’abilità fisica fosse realmente presente nello svolgimento del gioco: e così ora ci scontreremo all’infinito, nelle già intasate aule dei tribunali italiani, sull’interpretazione della frase “abilità fisica, mentale o strategica”. Certamente i più furbi costruiranno dei videopoker con annesso distributore di collanine, anellini, medaglie, che, una volta usciti dall’apparecchio, potrebbero venire convertiti in denaro e riposti ancora nel distributore con una specie di ciclo continuo. Chi userà tali apparecchi sarà inoltre esonerato dall’applicare la regola dei 12 secondi, e da una pletora di documentazioni e responsabilità varie, perché così era correttamente previsto nell’intento originario della famosa legge “moneta per moneta” che giustamente esentava i soli apparecchi elettromeccanici da inutili pastoie burocratiche, mentre tutto ciò contribuirà a creare confusione nelle Forze P–––L–––A––Y––M––A–C–H-I-N-E FEBBRAIO 2001 47 dell’Ordine e gravi tensioni commerciali fra i gestori. 3) Vengono introdotti gli articoli 38 e 39 che contengono un’infinità di lacci e lacciuoli per distributori e gestori di cui è meglio non parlare qui, considerato l’accavallarsi temporale di farsesche disposizioni a riguardo, prive delle più elementari indicazioni su come metterle in atto. Stendiamo quindi un velo pietoso sull’argomento e attendiamo l’intervento della Presidenza della Sapar presso i Sottosegretari competenti, nella speranza che almeno loro si prendano la responsabilità di riparare i grossi danni provocati dai loro capi. 4) Tanto per non smentirsi, i nostri legislatori, pur non facendone menzione da nessuna parte, hanno mantenuto in essere anche gli articoli 2 e 3 della vecchia legge 425/95, dove è prevista, in particolare, l’emanazione del regolamento attuativo della legge stessa (ora quella nuova). Bella scoperta! Non si ricorda il ministro che tale “Regolamento” è stato accoratamente richiesto dalle associazioni di categoria per ben cinque anni e che i tre Ministeri competenti non sono mai riusciti ad emanarne uno? Sarà questa la volta buona? Figuriamoci! Sarà questa la mossa che impedirà ai figli di uccidere i genitori per rubare i soldi da giocare ai videopoker, alle mamme di rapinare gli uffici postali, agli operai di dilapidare tutti i loro risparmi eccetera (guai provocati dalla legge 425/95, come denuncia Visco, sempre ammesso che siano notizie attendibili e non riferite a persone ovviamente “malate” ben prima dell’introduzione dei giochi a premio in Italia). In conclusione, a prescindere dal fatto che quanto sopra espresso, purtroppo, è tutto vero e verificabile, io, per rispondere alle nuove esigenze della legge, da gestore di apparecchi da trattenimento e imprenditore che sa assumersi le proprie responsabilità, dopo avere esaustivamente illustrato la normativa a tutti gli esercenti che ospitano i miei apparecchi nei loro locali, ho agito come segue: 1) ho predisposto un attento controllo affinché tutti i programmi di 48 points out, allowing that we can believe this and that it doesn’t refer to people who were obviously “ill” well before the introduction of the games with prize in Italy). Crediamo che fosse proprio questa la volontà principale di quegli oculati legislatori che nella bozza di legge “moneta per moneta” avevano introdotto il parametro dei 12 secondi e di conseguenza la giocata a 200 lire onde limitare, di fatto, il costo orario medio di partecipazione al gioco di un qualsiasi giocatore a poche migliaia di lire. Visco si era trovato tutto pronto, peccato che sia stato così “ottusangolo” da non aver capito la portata storica dell’evento: ridurre il costo di una giocata a 200 lire, invece delle 2 mila di qualche “mal consigliato” gestore, o addirittura delle 5 mila e 10 mila di qualche “bandito”, avrebbe significato ridurre le vincite, perdite e profitti da dieci a 50 volte quelli attuali, però in moneta e nella totale legalità, mantenendo inalterato il livello occupazionale del settore; 4) in alternativa a questa riduzione obbligata della giocata massima, ho installato il Counter Easy Link 388, cioè un dispositivo che, utilizzato su apparecchiature funzionanti con schede periziate, consente di: – suddividere le banconote inserite in “partite” da mille lire – conferire ad ogni partita una durata minima di 12 secondi – limitare l’introduzione massima di banconote da 10 mila a una per un massimo di dieci partite.
