Nella mia qualità di Curatore del fallimento Sertam S.r.l. n. 87/2011, dichiarata dal Tribunale di
Modena con sentenza del 24 giugno 2011, con la presente
rendo noto
ad ogni effetto di legge, che in data 3 ottobre 2011, B.P. Elettronica di Bencivenga Patrizia & C.
Snc con sede in Fiorano Modenese (MO), via Madonna del Sagrato n. 2/4/6, codice fiscale e partita
iva numero 02245400367, ha sottoscritto con il fallimento un contratto di affitto di ramo d’azienda
in forza del quale, a partire da detta data, B.P. Elettronica Snc è titolare IN VIA ESCLUSIVA:
- del marchio registrato SERTAM;
- dei contratti di assistenza sottoscritti con Sertam Srl fino alla data del 24 giugno 2011;
- di tutti i beni mobili del fallimento, compreso disegni tecnici, software, stampi, fusioni,
attrezzature e magazzino di Sertam Srl;
- della sede industriale in via Romagna 17 a Maranello (MO), oltre che degli indirizzi di posta
elettronica, dei riferimenti telefonici e del sito Internet www.sertam.it.
B.P. ELETTRONICA DI BENCIVENGA PATRIZIA & C. SNC, IN FORZA DI DETTO
CONTRATTO DI AFFITTO, È L’UNICA AZIENDA TITOLATA A PROSEGUIRE
L’ATTIVITÀ DI SERTAM SRL.
I crediti ed i debiti sorti in epoca antecedente al 24 giugno 2011, data di fallimento di Sertam Srl,
restano esclusi dall’affitto di ramo d’azienda, e pertanto, permangono in carico al fallimento.
Ricordo che l’udienza per l’esame dello stato passivo del fallimento è stata fissata per il giorno 24
novembre 2011, ed il termine per presentare domanda di ammissione in via tempestiva scade il
giorno 25 ottobre 2011. Le domande di ammissione al passivo depositate presso la cancelleria
fallimentare del Tribunale di Modena successivamente al 25 ottobre 2011 saranno considerate
tardive ai sensi di Legge.

As Receiver of the bankruptcy of Sertam S.r.l. No. 87/2011, as stated by the Court of Modena with ruling of
June 24, 2011, hereby
I make known
with any legal effect, that on October 3rd 2011, B.P. Elettronica di Bencivenga Patrizia & C.Snc based in
Fiorano Modenese (MO), via Madonna del Sagrato No. 2/4/6, tax code and VAT identification number
02245400367, has signed with the bankruptcy a contract of a business branch lease and, as provided, starting
from the above mentioned date, B.P. Elettronica Snc become the EXCLUSIVELY holder of:
- the trademark SERTAM;
- service contracts signed with Sertam Srl until June 24, 2011;
- all goods and chattels of bankruptcy, including technical drawings, equipments, warehouse, software,
moulds and fusions of Sertam Srl;
- the industrial headquarters based in via Romagna No. 17 in Maranello (MO), as well as the e-mail
addresses, telephone numbers and the website www.sertam.it.
B.P. ELETTRONICA DI BENCIVENGA PATRIZIA & C. SNC, ACCORDING TO THE ABOVE
MENTIONED RENTAL CONTRACT, IS THE ONLY COMPANY ENTITLED TO CONTINUE
THE BUSINESS OF SERTAM SRL.
Receivables and payables arisen in the period prior to June 24, 2011, date of bankruptcy of Sertam Srl, are
excluded from business branch lease, and therefore, they remain in charge to bankruptcy.
I remember you that the hearing for examining the insolvency status was scheduled for November 24, 2011,
and the deadline for applying promptly expires on October 25, 2011. Applications for admission to the
liabilities filed at the records office of Bankruptcy Court of Modena after October 25, 2011 will be
considered late under the Law.
