CRITERI PER LA DESIGNAZIONE DEGLI ON D.Lgs. n. 46/97 - ALLEGATO XI e XII q Indipendenza: nessun coinvolgimento nei processi di progettazione, fabbricazione, istallazione o uso dei dispositivi che certifica q Competente professionalmente e libero da tutte le pressioni e condizionamenti in particolare quelli finanziari q Possesso di personale, sedi ed attrezzature per le attività tecniche ed amministrative per cui è autorizzato q Il personale deve possedere una formazione tale da coprire tutte le competenze oggetto dell’autorizzazione, ivi compresa l’esperienza e la competenza degli ispettori e auditors (EN 19011) CRITERI PER LA DESIGNAZIONE DEGLI ON D.Lgs. n. 46/97 - ALLEGATO XI e XII q L’accreditamento in accordo alle norme EN 45000 (EN 17000) è utile, ma è essenziale la conoscenza della tecnologia e dei dispositivi per cui è autorizzato. q L’autorizzazione è strettamente definita e limitata ai metodi di attestazione di conformità e ai dispositivi per cui è stata dimostrata la competenza. q L’autorizzazione permette all’ON di operare in tutto il territorio UE e all’esterno di essa. Il Fabbricante può affidarsi a qualsiasi ON di sua scelta. q Possesso di adeguata assicurazione per la responsabilità civile. An introduction of an EU portal where manufacturers must report serious incidents and corrective actions they have taken and co-ordinated analysis of certain high risk incidents. Post-market follow-up required Notified Body - Code of Conduct v NB Code of Conduct compliance is voluntary. When released (Feb-11), it did not receive support from all Notified Bodies and IVD’s were not included. Revision discussed on 07-Sep-12. Increased scope to IVD’s indicated v The Code of Conduct is an initiative to improve harmonised implementation of the European Directives, creating a more level playing field for manufacturers. Specifies criteria such as the qualification and experience of NB personnel and the minimum time required for various conformity assessment processes. Provision of panEU standard for NB’s. v Borderline Classification Issues: Creation of an expert panel on borderline classification issues and resultant regulatory status v Transparency and harmonised traceability: Central registration for medical devices & UDI Page 21 11 © 2013 DEKRA Impact Page 22 © 2013 DEKRA Ø A standard approach to CE certification, audits should be maintained across all of the signatory bodies Ø Will provide an EU wide NB harmonised approach to ensure that all CA’s are working to the same levels with their NB’s Notified Body Changes Under Consideration Unannounced manufacturer inspections Major Changes Increased surveillance of manufacturers processes and documentation The aim of these changes is to strengthen confidence in the Manufacturer Unannounced Manufacturer Inspections v NB’s should conduct an unannounced and unpredictably timed audit at least once every 3 years v NB’s should audit device samples from an on-going production run and compare conformity with its Technical Documentation and its Clinical Evaluation v NB’s should verify the traceability of all critical device components and materials v At least one critical process e.g. design control, manufacturing etc, should be audited on each inspection Page 23 12 © 2013 DEKRA Notified Body Changes Under Consideration The aim of these changes is to strengthen confidence in the Notified Body Designating Rules & Audits for Notified Bodies v CA’s (with specific oversight) will be required to verify the designation of NB’s to ensure they have the expertise and competence to assess devices and technologies that they require certification for v It is understood that by the beginning of 2013, device NB’s assessing Class III devices will be ‘skill’ audited by a team comprising CA’s and EU Commission. Initial proposal also for NB’s assessing Class D IVD’s v The CA auditing team will have to investigate any challenges / concerns regarding NB compliance raised by manufacturers / industry associations Ø If the NB is deemed to ‘no longer meet competency requirement levels’, the Commission must request the NB ‘takes measures’ to address the concerns and inform other Member States Page 24 © 2013 DEKRA Notified Body Changes Under Consideration WHAT’S IMMEDIATELY APPLICABLE? Ø The main impact is the NB / manufacturer inspection format. It is expected that NB’s will issue guidance documents on the revised inspection procedures, similar to guidance currently provided by NBOG for NB’s. More audit planning by manufacturers – “mock NB audits” Impact ü EN ISO 13485:2012 => already harmonized, with no transition period ü EN ISO 14971:2012 => already harmonized, with no transition period Ø Problems with NB availability if CA’s determine NB’s ‘no longer meet competency requirement levels’ ü NB focus on the contracts with subcontractors Ø Code of Conduct will increase the standards for NB and interim controls may result in reduction of third party contracting by NB’s resulting in shortage of NB’s.
