Valid for six days on all alpine ski lifts, with a new,
cutting edge snow-making system, creating
over 20km of fantastic slopes for downhill skiing
and snowboarding. Including a ski-bus and ski
storage. It’s also possible to choose the Nordic ski
option, with entry into the stunning Campomulo
cross-country ski area.
As soon as you arrive in Asiagoneve, you will
receive your ski pass, valid from Friday afternoon.

A two hour lesson every day, with the choice
between alpine skiing or snowboarding, in
complete safety, discovering the secrets behind
new techniques and improving your ski skills.
During certain periods of the year, a ‘master class’
is also provided together with your classmates.
Our incredibly convenient Mini Club service will be
available on the slopes for your children.
ENTERTAINMENT AND MINI CLUB

and specialised in teaching children
as well as racing, freeride and new
school skiing. They are a group of
friends able to patiently teach you all
of the techniques of the ‘Italian Ski
and Snowboard School’ – some of the
best in the world, in a fun way, safely
helping you to experience the Alpine
environment where they were born
and have lived all their lives. For over
twenty-five years now, the Asiagoneve
Instructors’ teaching method has stood
out for its fun approach, teaching the
most refined techniques in a cheerful way.

THE ASIAGONEVE TROPHY
SKIPASS
At the end of the course, after having
skied and joked with the instructors,
there is the ASIAGONEVE TROPHY.
A competition for everyone, with
trophies for the top three in each group
and MEDALS for ALL PARTICIPANTS!
The ski pass is valid on the Verena
2000 ski lifts, and is personal and
non-transferable. It must be looked
after with care and, if it gets lost,
another one must be purchased at the
standard ski lift rate. No photograph
or deposit payment is required.
The competition will be held over the Christmas period and from
10th to 26th March (excluding Easter)
he alpine ski and snowboard
courses included in the Ski
Packages begin on Monday and
end on Saturday*. Lesson times will
be confirmed upon arrival, during the
holiday presentation to participants. For
those choosing the Weekend Package,
courses will start on Friday afternoon.
Children over 5 or those between 4 and
5 who have already skied, may take
part in the courses.
We recommend individual lessons for
children under 5. Further details will be
provided upon arrival at Asiagoneve
Village. Lessons are held in the Monte
Verena ski resort, with a free ski bus
service.

MASTER CLASS
A master class for your chosen
discipline (alpine skiing or
snowboarding) is also included in the
Ski Package, to be held during your ski
holiday together with other people from

The master class is only for those

packages from 10th January onwards.

IN CAMPOMULO
As one of the first cross-country ski
areas of its kind in Italy, it is renowned
for its beautiful, Nordic-like terrain,
home to 150 km of excellent ski trails.
The Nordic Ski Package includes
six entries to the ski area plus an
individual lesson with an instructor
from the local Campomulo Ski
School, a small town reachable with
the free ski-bus.
The Asiago Plateau has always played
host to World Cup competitions and
Nordic Ski World Championships!

Verena 2000 is the highest ski
resort on the Asiago Plateau,
where you can ski on exclusive
slopes with Asiagoneve, forgetting
about overcrowded ski lift stations
and endless queues and simply
enjoying your ski holiday in complete

3 lodges in the ski resort, all with a
warm and welcoming atmosphere:

Every Wednesday evening, together with
the instructors and entertainment staff,
we’ll involve you in the traditional and
exceptional Asiagoneve Party, held at the
Rifugio Kubelek lodge, right at the top
of Monte Zovetto. A fantastic mountain
dinner awaits you, together with magic
shows by the astonishing Magician Hu,
cabaret and lots of music to sing and
dance to together. You’ll even get the
chance to be horrified by the incredibly
famous, increasingly tone-deaf, ski
instructors’ “Shameless Choir”, performing
their own pieces, with no holding back
– all amazingly recorded onto CD, the
proceeds from which will go to charity.

SNOWSHOEING
Asiagoneve’s entertainment staff also
organise unforgettable excursions with
snow rackets, known as snowshoes.
On fresh, compact snow, the
snowshoes allow you to walk along
snow-covered trails and pastures,
discovering otherwise unreachable
spots.
DOLOMITES SUPERSKI TOURS
For those of you wanting to treat
yourselves to some “SUPER SKIING”,
every Friday, the Asiagoneve ski
Instructors will accompany you on the
legendary “Sella Ronda” – the Alps’
most famous ski circuit, also known as
the “tour of the 4 mountain passes”:
Sella, Gardena, Campolongo and
Pordoi. Forty kilometres by ski at the
foot of the splendid Dolomites (Unesco
Natural Heritage Site).

BETWEEN HISTORY AND CULTURE
The Asiago Plateau is an area with
a rich culture of history and science,
just waiting to be discovered. You can
visit the Astronomical Observatory,
the natural history and First World War
museums, or you can go and discover
the secrets behind the making of
Asiago cheese.
Asiago hosts many initiatives to
celebrate the Centenary of the First
World War, which lasted from 1915-18,
leaving many painful memories behind
on the Plateau.

AT THE ‘BAITO DELLA SPELONCA’ CHALET
Asiagoneve organises a fantastic offpiste ski excursion, together with the
Instructors, covering a gentle 10km
descent, from the Monte Verena Fort
(2020 m) down to the Roana Lake
(1090 m).
Half-way along, there’s a stop-off at
Baito della Spelonca for a generous
snack of typical foods, where the
legendary singer “Ciccio Corona” and
the Instructors’ “Shameless Choir”
will also be performing their hilarious
songs. Return trip is organised with
the ski-bus.

Asiagoneve ski holidays are spread
across a number of periods, which
you’ll find on the pages dedicated to
the 7 affiliated hotels. All prices are per
person and include the famous Ski
Package: hotels with choice of board,
ski pass, ski or snowboard school and
entertainment services.
At our hotels, you’ll find all of the
warmth and hospitality that the local
mountain people have to offer, with
first-class services spoiling you and
fulfilling your every wish and desire.
You’ll be able to taste local cuisine
and traditional wines and grappe from
the Veneto region. Every week, you’ll
also be offered a traditional Typical
Cimbrian Dinner.
Some hotels also provide gluten-free
cuisine.
Every hotel offers entertainment
services and Asiagoneve assistance.
WEEKEND PACKAGE
Group ski and snowboard courses as
part of the weekend package have the
following timetable:
Friday from 2pm to 4pm, Saturday
from 9.30am to 11.30am and from
2.30pm to 4.30pm or Sunday from
10.30am to 12.30pm.
6 hours of group lessons are
guaranteed as long as there are more
than 6 students per class, otherwise
the Ski school reserves the right to
carry out at least one hour of private
tuition for each participant.
In order to organise the courses,
participants must present themselves
at the VERENA Ski School reception
by 1.30pm on Friday. Should this

The registration fee is equal to €30.00
per person. It is always due and covers

1. PREMESSA NOZIONE DI PACCHETTO TURISTICO
Il Turista ha diritto di ricevere copia del contratto di vendita di pacchetto turistico ai sensi degli art.35 e 36 del D.Lgs 79/2011.
La nozione di pacchetto turistico (art.34 D.lgs 79/2011 - Codice del Turismo) è la seguente:
I pacchetti turistici hanno ad oggetto i viaggi, le vacanze, le crociere turistiche ed i circuiti tutto compreso, risultanti dalla combinazione - da
chiunque ed in qualunque modo realizzata - di almeno due degli elementi di seguito indicati, venduti ed offerti in vendita ad un prezzo
forfettario :
a) trasporto
b) alloggio
c) servizi turistici non accessori al trasporto o all’alloggio che costituiscono parte significativa del pacchetto turistico, per la soddisfazione
delle esigenze ricreative del Turista.
2. FONTI LEGISLATIVE
Il contratto di compravendita di pacchetto turistico è regolato, oltre che dalle presenti condizioni generali, anche dalle indicazioni contenute
nella documentazione di viaggio consegnata al consumatore.
Detto contratto, sia che abbia ad oggetto servizi da fornire in territorio nazionale sia estero, sarà altresì disciplinato dalle disposizioni in
quanto applicabili, della L.27/12/1997 n°1084 di ratifica ed esecuzione della Convenzione Internazionale relativa al contratto di viaggio
(CCV) firmata a Bruxelles il 23/04/1970 e del D.Lgs 79/2011 – Codice del Turismo.
3. INFORMAZIONE AL TURISTA - SCHEDA TECNICA
L’organizzazione (Happy Siben SRL) ha l’obbligo di realizzare in catalogo o fuori catalogo – anche mediante supporto elettronico o telematico - una scheda tecnica. Gli elementi obbligatori minimi da inserire nella scheda tecnica del catalogo o del programma fuori catalogo sono:
1. estremi dell’autorizzazione amministrativa dell’organizzatore, o se applicabile la D.I .A. o S.C.I.A dell’organizzatore.
2. estremi della polizza assicurativa di responsabilità civile.
3. periodo di validità del catalogo o del programma fuori catalogo.
4. cambio valutario di riferimento ai fini degli adeguamenti valutari, giorno o valore (art.40 Cod.Tur)
5. modalità e condizioni di sostituzione del viaggiatore (art. 39 Cod. Tur)
Le condizioni,regole e informazioni contenute nella scheda tecnica riportata in calce alle presenti condizioni generali costituiscono parte
integrante delle condizioni medesime.
4. PRENOTAZIONI - Proposta / Conferma di acquisto del pacchetto turistico.
La domanda di prenotazione dovrà essere redatta su apposito modulo , se del caso elettronico, compilato in ogni sua parte e sottoscritto dal
cliente, che ne riceverà copia. L’accettazione delle prenotazioni si intende perfezionata nel momento in cui l’organizzatore invierà relativa
conferma (contratto), anche a mezzo sistema telematico, al cliente o presso l’Agenzia di Viaggi venditrice/intermediaria. Il contratto si
intenderà concluso nel momento in cui il cliente o l’Agenzia Viaggi venditrice/intermediaria firmerà la copia dello stesso.
L’accettazione della Proposta/Conferma si intende così perfezionata, con conseguente conclusione del contratto.
Le indicazioni relative al pacchetto turistico non contenute nei documenti contrattuali, negli opuscoli, ovvero in altri mezzi di comunicazione
scritta, saranno fornite dall’organizzatore in regolare adempimento degli obblighi previsti a proprio carico dall’art. 37 D.Lgs 79/2011 –
Codice del Turismo, in tempo utile prima dell’inizio del viaggio.
5. PAGAMENTI
Ai sensi dell’art 36 D.Lgs 79/2011, all’atto dell’ accettazione della Proposta commerciale (firma del contratto), il consumatore provvederà a
versare il 25% dell’importo complessivo come acconto del pacchetto acquistato.
Il saldo si effettuerà successivamente in base alla data di prenotazione e comunque entro i 30 gg. precedenti alla data di partenza.
Nello specifico:
Per prenotazioni effettuate a meno di 30 giorni e fino a 7 giorni dalla data di partenza, il saldo deve pervenire entro il primo giorno lavorativo successivo alla data di prenotazione stessa. Per prenotazioni a meno di 7 giorni dalla data di partenza, il saldo deve pervenire entro
lo stesso giorno di prenotazione. Il computo delle giornate è da riferirsi al calendario. Il mancato pagamento delle somme di cui sopra alle
date stabilite costituisce clausola risolutiva espressa tale da determinare, da parte dell’organizzatore, la risoluzione di diritto del contratto
con applicazione della penale nella misura indicata nella SCHEDA TECNICA al paragrafo Penali Annullamento.
6. PREZZO
Il prezzo del pacchetto turistico è determinato nella Proposta/Conferma di pacchetto turistico, con riferimento a quanto indicato in catalogo
o programma fuori catalogo ed agli eventuali aggiornamenti degli stessi cataloghi o programmi fuori catalogo successivamente intervenuti.
I prezzi di acquisto del pacchetto turistico potranno subire delle variazioni al rialzo fino a 20 giorni prima della partenza, qualora successivamente alla stipula del contratto intervengano delle variazioni nelle seguenti voci:
- variazione del costo del trasporto.
- variazione delle polizze assicurative delle compagnie aeree.
- variazione del carburante.
- variazione dei diritti e delle tasse quali quelle di atterraggio, di sbarco o imbarco nei porti o negli aeroporti.
- variazione del tasso di cambio applicato.
Per il calcolo di tali variazioni si farà riferimento al corso dei cambi ed ai costi di cui sopra in vigore alla data indicata nella scheda tecnica,
ovvero agli aggiornamenti comunicati successivamente alla stampa del presente catalogo.
Le quote non subiranno variazioni per oscillazioni dei parametri inferiori al 2%. Qualora la variazione dovesse essere superiore a tale
percentuale l’adeguamento sarà applicato per intero.
7. RECESSO DEL TURISTA
Il Turista può recedere dal contratto, senza pagare penali, nelle seguenti ipotesi:
- aumento del prezzo di cui al precedente art. 6 in misura eccedente il 10% del valore dell’intero pacchetto turistico.
- modifica in modo significativo di uno o più elementi del contratto oggettivamente configurabili come fondamentali ai fini della fruizione
del pacchetto turistico complessivamente considerato e proposta dall’organizzatore dopo la conclusione del contratto stesso ma prima della
partenza e non accettato dal Turista.
Nei casi di cui sopra, il Turista ha alternativamente diritto:
- ad usufruire di un pacchetto turistico alternativo, senza supplemento di prezzo o alla restituzione dell’eccedenza di prezzo,qualora il
secondo pacchetto turistico abbia valore inferiore al primo;
- alla restituzione della sola parte di prezzo già corrisposta. Tale restituzione dovrà essere effettuata entro sette giorni lavorativi dal
momento del ricevimento della richiesta di rimborso.
Il Turista dovrà dare comunicazione scritta della propria decisione (di accettare la modifica o di recedere), entro e non oltre due giorni
lavorativi dal momento in cui ha ricevuto l’avviso di aumento di modifica.
In difetto di espressa comunicazione entro il termine suddetto, la proposta formulata dall’organizzatore si intende accettata. Al Turista
che receda dal contratto prima della partenza al di fuori delle ipotesi precedentemente elencate, sarà addebitata indipendentemente dal
pagamento dell’acconto di cui all’ art. 5 e oltre al costo individuale di gestione pratica, la penale nella misura indicata nella SCHEDA TECNICA
al paragrafo Penali Annullamento.
Nel caso di gruppi precostituiti, tali somme verranno concordate di volta in volta al momento della firma del contratto.
8.MODIFICA O ANNULLAMENTO DEL PACCHETTO TURISTICO PRIMA DELLA PARTENZA DA PARTE DELL’ORGANIZZATORE
Nell’ipotesi in cui, prima della partenza, l’organizzatore abbia necessità di modificare in modo significativo uno o più elementi del contratto,
ne dà immediato avviso al Turista, mediante forma scritta, indicando il tipo di modifica e la variazione di prezzo che ne consegue. Tali comunicazioni verranno effettuate in tempo utile prima dell’inizio del viaggio. Ove non accetti la modifica, il Turista potrà esercitare alternativamente il diritto di riacquisire la somma già pagata o di godere dell’offerta di un pacchetto turistico sostitutivo proposto, così come formulato
nel precedente art.7. Il Turista può esercitare i diritti sopra previsti anche quando l’annullamento dipenda dal mancato raggiungimento del
numero minimo di partecipanti previsto nel Catalogo o nel Programma fuori catalogo o da casi di forza maggiore e caso fortuito relativi al
pacchetto turistico acquistato. Ai sensi dell’art.42 del d.lgs 79/2011 nel caso in cui il pacchetto turistico venga cancellato prima della partenza
per qualsiasi motivo, tranne che per colpa del Turista, questi ha diritto di usufruire di un altro pacchetto turistico di qualità equivalente o
superiore senza supplemento di prezzo o di un pacchetto turistico qualitativamente inferiore previa restituzione della differenza del prezzo,
oppure gli verrà rimborsata - entro sette giorni lavorativi dal momento del recesso o della cancellazione - la somma di denaro già corrisposta.
8 BIS. MODIFICA PRIMA DELLA PARTENZA DA PARTE DEL TURISTA.
Le modifiche richieste dal Turista a prenotazioni già effettuate come ad esempio: modifica di data, destinazione struttura alberghiera, cambio nome, variazione numero partecipanti – possono, in aggiunta ad eventuali supplementi di prezzo che saranno comunicati al momento
della richiesta di modifica, comportare l’applicazione dei seguenti “costi di variazione”: € 15,00 per ogni modifica richiesta.
ATTENZIONE: la diminuzione del numero dei partecipanti, il cambio di data e/o struttura all’interno di una pratica è da intendersi come
“annullamento parziale” (vedi quindi art.7 recesso del consumatore).
9. MODIFICHE DOPO LA PARTENZA
Ai sensi dell’art. 41 2° comma del D.lgs 79/2011, qualora dopo la partenza l’organizzatore si trovi nell’impossibilità di fornire, per qualsiasi
ragione tranne che per un fatto proprio del Turista, una parte essenziale dei servizi contemplati in contratto, dovrà predisporre soluzioni
alternative, senza supplementi di prezzo a carico del Contraente.
Qualora le prestazioni fornite siano di valore inferiore rispetto a quelle previste, l’Organizzatore del viaggio dovrà rimborsare il Turista in
misura pari a tale differenza. Qualora non risulti essere possibile alcuna soluzione alternativa, ovvero la soluzione predisposta dall’Organizzatore venga rifiutata dal Turista per seri e giustificati motivi, l’Organizzatore fornirà senza supplemento di prezzo, un mezzo di trasporto
equivalente a quello originario previsto per il ritorno al luogo di partenza o al diverso luogo eventualmente pattuito, compatibilmente alle
disponibilità del mezzo e di posti e lo rimborserà nella misura della differenza tra il costo delle prestazioni previste e quello delle prestazioni
effettuate, fino al momento del rientro anticipato.
10. SOSTITUZIONI
Ai sensi dell’art 39 del D.lgs 79/2011, Il cliente potrà sostituire a sé un terzo a condizione che:
a)l’organizzatore ne sia informato per iscritto almeno 4 giorni lavorativi prima della data fissata per la partenza, ricevendo contestualmente
comunicazione circa le generalità del cessionario.
b) il sostituto soddisfi tutte le condizioni per la fruizione del servizio ed in particolare i requisiti relativi al passaporto, ai visti, ai certificati
sanitari. In ogni caso verrà applicato un costo di variazione di 15 euro per il cambio del nome di ogni cliente. Per tutti i pacchetti organizzati
con voli di linea, ogni modifica sarà soggetta a costi di variazione, in base alle disposizioni di ogni singola compagnia aerea. Il Cedente ed
il Cessionario sono solidalmente obbligati nei confronti dell’Organizzatore al pagamento del prezzo e delle spese ulteriori eventualmente
derivanti dalla cessione. L’Organizzatore fa presente che, per talune tipologie di servizi, può verificarsi che un terzo fornitore di servizi non
accetti la modifica del nominativo del Cessionario, anche se effettuata entro il termine di cui al precedente punto a).
L’Organizzatore non sarà pertanto responsabile dell’eventuale mancata accettazione della modifica da parte dei terzi fornitori di servizi.
Tale mancata accettazione sarà tempestivamente comunicata dall’Organizzatore alle parti interessate non appena appresa dal fornitore.
11. OBBLIGHI DEI PARTECIPANTI
I partecipanti dovranno essere muniti di documento di riconoscimento validi per l’effettuazione del viaggio, nonché dei visti di soggiorno e
di transito e dei certificati sanitari che fossero eventualmente richiesti. Essi inoltre dovranno attenersi all’osservanza della regole di normale
prudenza e diligenza ed a quelle specifiche in vigore nei paesi destinazione del viaggio, a tutte le informazioni fornite loro dalla Happy Siben
SRL, nonché ai regolamenti ed alle disposizioni amministrative o legislative relative al pacchetto turistico. I partecipanti saranno chiamati
a rispondere di tutti i danni che la Happy Siben SRL dovesse subire a causa della loro inadempienza alle sopra esaminate obbligazioni.
Il consumatore è tenuto a fornire alla Happy Siben SRL tutti i documenti, le informazioni e gli elementi in suo possesso utili per l’esercizio del
diritto di surroga di quest’ultimo nei confronti dei terzi responsabili del danno ed è responsabile verso la Happy Siben SRL del pregiudizio
arrecato al diritto di surrogazione. Il consumatore comunicherà altresì per iscritto alla Happy Siben SRL, all’atto della prenotazione, le
particolari richieste personali che potranno formare oggetto di accordi specifici sulle modalità del viaggio, sempre che ne risulti possibile
l’attuazione.
12. CLASSIFICAZIONE ALBERGHIERA
La classificazione delle strutture alberghiere,fornita mediante catalogo o altro materiale pubblicitario, è quella espressa a seguito delle
formali indicazioni delle autorità competenti del paese in cui il servizio è erogato cosi come esplicitato dall’art. 38 comma b del D.legs
79/2011. In assenza di classificazioni ufficiali riconosciute dalle competenti Pubbliche Autorità dei Paesi, anche membri della UE, cui il
servizio si riferisce, l’organizzatore si riserva la facoltà di fornire in catalogo o depliant una propria descrizione della struttura ricettiva,tale
da permettere una valutazione e conseguente accettazione della s tessa da parte del Turista.
13. REGIME DI RESPONSABILITA’
L’organizzatore risponde dei danni arrecati al Turista a motivo dell’inadempimento totale o parziale delle prestazioni contrattualmente
dovute, sia che le stesse vengano effettuate da lui personalmente che da terzi fornitori dei servizi, a meno che l’evento sia derivato da fatto
del Turista (ivi comprese iniziative autonomamente assunte da quest’ultimo nel corso dell’esecuzione dei servizi turistici) o da circostanze
estranee nella fornitura delle prestazioni previste in contratto, da caso fortuito, da forza maggiore, ovvero da circostanze che lo stesso
organizzatore non poteva,secondo la diligenza professionale, ragionevolmente prevedere o risolvere. Il venditore presso il quale sia stata
effettuata la prenotazione del pacchetto turistico non risponde in alcun caso delle obbligazioni nascenti dall’organizzazione del viaggio, ma
è responsabile esclusivamente delle obbligazioni nascenti dalla sua qualità di intermediario e comunque nei limiti per tali responsabilità
previsti dalle norme vigenti in materia. Si sottolinea che è compito del partecipante verificare documenti e/o visti necessari per visitare il
paese scelto per la vacanza
14. LIMITI DEL RISARCIMENTO
I risarcimenti di cui agli art. 44, 45 e 47 del Codice del Turismo ed i relativi termini di prescrizione, sono disciplinati da quanto ivi previsto
e comunque nei limiti previsti dalle Convenzioni Internazionali che disciplinano le prestazioni che formano oggetto del pacchetto turistico
nonché dagli art. 1783 e 1784 del codice civile.
15. OBBLIGO DI ASSISTENZA
L’organizzatore è tenuto a prestare le misure di assistenza al Turista imposte dal criterio di diligenza professionale esclusivamente in
riferimento agli obblighi a proprio carico per disposizione di legge o di contratto.
L’Organizzatore e l’Intermediario sono esonerati dalle rispettive responsabilità (art.13 e 14), quando la mancata o inesatta esecuzione
del contratto è imputabile al Turista o è dipesa dal fatto di un terzo a carattere imprevedibile o inevitabile, ovvero da un caso fortuito o di
forza maggiore.
16. RECLAMI E DENUNCE
Ogni mancanza nell’esecuzione del contratto deve essere contestata dal Turista anche ai fini di cui all’art. 1227 codice civile, mediante tempestiva presentazione di reclamo affinché l’Organizzatore, il suo Rappresentante locale o l’Accompagnatore vi pongano tempestivamente
rimedio; in caso contrario non potrà essere contestato l’inadempimento contrattuale. Il turista dovrà altresì – a pena di decadenza - sporgere
reclamo mediante l’invio di una raccomandata,con avviso di ricevimento, o altro mezzo che garantisca la prova dell’avvenuto ricevimento,
all’organizzatore o all’intermediario, entro e non oltre dieci giorni lavorativi dalla data di rientro nel luogo di partenza.
Per ogni ulteriore informazione trova applicazione il dettato previsto dall’art.49 del D.Lgs 79/2011 (Codice del Turismo).
17. ASSICURAZIONE
Oltre alla copertura assicurativa RC già prevista, se non espressamente comprese nel prezzo, è possibile, ed anzi consigliabile, stipulare
al momento della prenotazione presso gli uffici dell’organizzatore o del venditore speciali polizze assicurative contro le spese derivanti
dall’annullamento del pacchetto, infortuni, spese mediche ed assistenza.
18. FONDO DI GARANZIA
E’ istituito presso la Presidenza del Consiglio dei Ministri – Dipartimento per lo sviluppo e la competitività del turismo - il Fondo Nazionale di
Garanzia a cui il Turista può rivolgersi (ai sensi dell’art. 51 del D.lgs 79/2011), in caso di insolvenza o di fallimento dichiarato del Venditore
o dell’Organizzatore, per la tutela delle seguenti esigenze:
a)rimborso del prezzo versato
b)suo rimpatrio nel caso di viaggi all’estero.
c) rientro forzato di turisti da paesi extracomunitari in occasione di emergenze imputabili o meno all’organizzatore.
L’Organizzatore concorre ad alimentare il Fondo nella misura stabilita dal comma 2 dell’art.51 del D.Lgs 79/2011. ADDENDUM
CONDIZIONI GENERALI CONTRATTO DI VENDITA SINGOLI SERVIZI TURISTICI
A) DISPOSIZIONI NORMATIVE
I Contratti aventi ad oggetto l’offerta del solo servizio di trasporto, del solo servizio di soggiorno, ovvero di qualunque altro separato servizio
turistico, non potendosi configurare come fattispecie negoziale di organizzazione di viaggio ovvero di pacchetto turistico, sono disciplinati
dalle seguenti disposizioni della CCV :
art. 1, n. 3 e n. 6; art da 17 a 23; art da 24 a 31, per quanto concerne le previsioni diverse da quelle relative al contratto di organizzazione,
nonché dalle altre pattuizioni specificamente riferite alla vendita del singolo servizio oggetto di contratto.
B) CONDIZIONI DI CONTRATTO
A tali contratti sono altresì applicabili le seguenti clausole delle condizioni generali di contratto di vendita di pacchetti turistici sopra riportate:
art. 4; art. 5 art. 7; art. 8; art. 9; art. 10; art. 11; art.15; art. 17.
L’applicazione di dette clausole non determina assolutamente la configurazione dei relativi servizi come fattispecie di pacchetto turistico. La
terminologia delle citate clausole relativa al contratto di pacchetto turistico (organizzatore viaggio ecc ..) va pertanto intesa con riferimento
alle corrispondenti figure del contratto di vendita dei singoli servizi turistici (venditore,soggiorno,ecc..).
C) COMUNICAZIONE OBBLIGATORIA AI SENSI DELL’ARTICOLO 16 DELLA L. 269/98
La legge italiana punisce con la pena della reclusione i reati inerenti la prostituzione e la pornografia minorile, anche se gli stessi sono
commessi all’estero.
D) INFORMATIVA EX ART.13 D.LGS. 196/2003 (protezione dati personali)
I dati personali che verranno eventualmente richiesti sono indispensabili al fine dell’adempimento del contratto e del conferimento dei
servizi richiesti a Happy Siben SRL. I dati personali forniti saranno trattati in forma anonima per eventurali elaborazioni statistiche. I dati
personali raccolti al nome della prenotazione tramite Call Center e/o Agenzia di viaggi/Booking on line saranno trattati direttamente da
Happy Siben SRL (in qualità di titolare del trattamento ai sensi di legge) e/o da società da essa controllate e/o ad essa collegate, tramite le
persone incaricate ai sensi di legge, con l’ausilio di strumenti elettronici e/o manuali e, comunque, in modo da garantire la sicurezza e la
riservatezza degli stessi. I dati saranno comunicati ai soli fornitori fornitori dei servizi compresi nel pacchetto turistico e alle Autorità qualora
imposto da specifiche normative. Il cliente potrà in ogni momento esercitare i diritti ex art. 7 D. lgs . N. 196/03 contattando: Happy Siben

RECESSO DEL TURISTA
La rinuncia del viaggio (anche parziale) da parte del consumatore dà diritto al rimborso della somma versata al netto delle penalità qui di
seguito indicate, da calcolarsi sull’intero ammontare della quota di partecipazione:
nessuna penale applicata per disdette fino a 30 giorni prima della partenza;
25% della quota di partecipazione da 29 a 21 gg prima della partenza;
50% della quota di partecipazione da 20 gg a 11 gg prima della partenza;
75% della quota di partecipazione da 10 gg a 4 gg prima della partenza;
100% della quota di partecipazione 3 a 0 gg prima della partenza.
COPERTURA ASSICURATIVA
- Aderendo ad una proposta di viaggio Happy Siben SRL il consumatore può stipulare, al momento della prenotazione, una polizza assicurativa a copertura delle spese derivanti dall’annullamento del pacchetto con la Europ Assistance e/o spese mediche.
SPESE ISCRIZIONE
- Tale quota aggiuntiva richiesta al consumatore oltre al prezzo del pacchetto turistico va a coprire il c.d. costo individuale di gestione pratica,
costituito appunto dai costi della gestione dinamica della pratica stessa (corrispondenza varia, telefono, fax, invio/spedizione documenti di
viaggio, gestione amministrativa, etc.). Spesa iscrizione non rimborsabile € 30,00 p.p. oltre gli anni 10 da pagare in loco.
ESCURSIONI E SERVIZI FACOLTATIVI ACQUISTATI IN LOCO
- Le escursioni, i servizi e le prestazioni acquistate dal consumatore in loco e non comprese nel prezzo del pacchetto turistico, pur potendo
essere illustrate e descritte in questo opuscolo, sono estranee all’oggetto del relativo contratto stipulato da Happy Siben SRL nella veste di
organizzatore. Pertanto nessuna responsabilità potrà essere ascritta a Happy Siben SRL, a titolo di organizzatore di servizi, nell’eventualità
che persone del nostro staff, accompagnatori o corrispondenti locali possano occuparsi della prenotazione o vendita di tali escursioni.
NUMERO MINIMO PARTECIPANTI
Perchè le proposte indicate nei Cataloghi del T.O. abbiano regolare svolgimento, il numero minimo di partecipanti dev’essere pari a 25
persone oltre gli anni 10. Il “Charter bus” chiede un minimo di 30 partecipanti oltre gli anni 10.
