Part I Reading Comprehension
International Herald Tribune (Dec 13-14 2003)
Editorial page: A premature constitution
The leaders of the European Union are facing a fateful moment this weekend when they
decide at their summit in Brussels whether to accept the draft of a constitutional treaty. Much
of the draft is essentially a codification of the tangle of oft-revised treaties and rules that now
govern the EU. The draft also attempts the Solomonic feat of creating power-sharing
arrangement that would satisfy 15 current and 10 incoming members of hugely different size
and wealth. Other key proposals include the new positions of an EU president and an EU
foreign minister. These are all useful and necessary changes to avoid political paralysis in a
greatly enlarged and diversified Union.
The real problem with the constitutional project is not in the draft—which, after all, can be
fine tuned—but in the fact that the exercise has failed to generate much interest in the broad
European public. Even if the summit this weekend approves the draft, it might well founder in
the national referendums that several states have decreed as a condition for ratification.
There are several reasons for this. One is that the goings on in that faceless entity that
Europeans refer to as “Brussels” are about as exciting as a day-old baguette, and the European
Parliament does not have the legislative powers, or the knack to generate a buzz.* For all the
control that Brussels has over the lives of all Europeans—and it is expanding daily—few
Europeans really understand the balance of powers among the Council, the Commission, the
ever-changing president, the Parliament and the innumerable agencies. Many, moreover have
come to resent this power.
* to generate a buzz – create excitement and a momentum for growth

The Charter of Fundamental Rights: content and scope
For the first time a single document brings together all of the rights previously to be found
in a variety of legislative instruments., such as national laws and international conventions
from the Council of Europe, the United Nations and the International Labour
Organisation. By making fundamental rights and freedoms clearer and more visible, the
Charter helps to develop the concept of citizenship of the European Union and to create an
area of freedom, security and justice (as stated in the preamble). The Charter enhances
legal security as regards the protection of Fundamental rights, where in the past such
protection was guaranteed only by the case law of the court of Justice and article 6 of the
treaty on European Union. The charter contains a preamble and 54 Articles.
