Il blog di illegalcab.org (dedicato agli “amici” giornalisti) | 1 The Napster of the Taxi Industry Go to IllegalCab.org for more info & Sign up for Alerts! Illegal Ground Operators (with ½ billion dollars in their bank accounts) are a threat to all operators Are you frustrated with the lack of enforcement against and proliferation of illegal, unlicensed and uninsured taxi drivers masquerading as “ride sharers”? These bandit cab operators are popping up everywhere, so it is critical that the industry rally together. Much can be learned from what the entertainment industry did to shut down Napster to shut down the “Napster of taxis.” Uber and Lyft are the modern day “Napster” of taxis In the late nineties companies like Napster and Scour (the Napster of movies) ignored laws and enabled mass illegal stealing of music and movies from the entertainment industry. Despite huge customer adoption and massive funding from venture capitalists, Napster and Scour were eventually killed when the industry united and destroyed these illegal businesses through PR efforts, law suits (http://nyti.ms/1iAsGJQ), and by punishing their accomplices. History is repeating itself History is repeating itself as the cofounder of Scour, Travis Kalanick, is back to his old ways. His old company Scour was sued for $250 billion for illegal activities (http://bit.ly/1iAsL02) and now his new company Uber is getting sued for illegal activities as well. He is flagrantly violating the law again by operating the largest Copyright Taxistory.it Il blog di illegalcab.org (dedicato agli “amici” giornalisti) | 2 illegal taxi operation in the country UberX. He has actually admitted to the illegality of these “ride sharing” activities (http://cnnmon.ie/1moCtpt), but has said he needs to offer such a service because of Lyft (the second largest illegal cab operator). Lyft was stealing market share from Uber and that he had no faith in the law so determined that two wrongs make a right and decided to go illegal. Local and state officials have issued cease and desists ) as well as impounded vehicles (http://on.wsj.com/1nhVHgG) , but despite this the illegal cab operators have continued with impunity. With over a half a billion dollars in venture capital raised, they think they are above the law and can buy their way out of it. Even when they got legalized in Seattle with new laws, they decided that they didn’t like the burdens associated with regulation so spent $400k to overturn them (http://bit.ly/1moCFFh). There is no such thing as a “free” lunch (or taxi ride) Like with Napster, consumers love something too good to be true. People like getting rides for forty percent less than legal ones. They also don’t appreciate or fully understand the hidden costs of using illegal operators. Illegal cabs are so much cheaper because they don’t have 1. Commercial insurance and are committing insurance fraud (http://bit.ly/1eO5jgq) 2. Insurance that covers vehicle, personal injury and liability (ow.ly/vW5e5) 3. Background checks administered by law enforcers 4. Drug testing 5. Health inspection 6. Special Taxi and limo licenses 7. Notarized documentation**9 8. Licensing fees 9. Requirement for 24/7 call center 10. Wait weeks to get approved and licensed to drive the riding public 11. Higher penalties for traffic infractions 12. Greater rules to follow related to driving Copyright Taxistory.it Il blog di illegalcab.org (dedicato agli “amici” giornalisti) | 3 13. Caps on the number of vehicles they can operate 14. Pay big bucks for a medallion to operate 15. Vehicle age requirements (their vehicles can be ten plus years old) 16. Vehicle mileage requirements 17. Regular Vehicle inspection requirements 18. Wait at DMV for hours to get their official driving record 19. Legal taxi meters that can calculate the fare 20. Stricter requirements on how many points they have on their license before they can no longer drive the riding public 21. Legal requirements to -pick up people in undesirable areas -pick up handicap people -have visible marks on vehicle for identification purposes -what they can charge and when they can change what they charge -have a phone number for passengers to call -go to taxi/limo school -pass a municipality regulated exam And I am sure that I am missing more items so please provide feedback (jason at getride dot com) so I can add more to the list above. Laws were created for a reason Each of these legal requirements were created for a reason (even though some I am sure need thoughtful updating). The Mayor of Madison Wisconsin wrote a good article explaining why taxis and limos are regulated and licensed (http://bit.ly/1jmLGJI). To blindly and greedily ignore history and our laws is dangerous for passengers, drivers and others on the road. Without these burdens, illegal cab operators can move much more quickly and cheaply than their legal competitors. Wall Street funded “illegals” are eating Main Street based “legals” Plus hard working and lower income people who invested their life’s work in a legal profession are getting decimated by these venture capital backed illegal cab Copyright Taxistory.it Il blog di illegalcab.org (dedicato agli “amici” giornalisti) | 4 operators (http://bit.ly/1iAsVEO). The legacy operators can’t compete with the restrictions placed on them. They are stuck with illiquid obligations and assets like medallions (that have dropped thirty percent in value in some markets), expensive commercial insurance and transportation equipment. This unfair playing field has created massive tension between the legals and the illegals. It’s Illegal taxis (not ride sharing), stupid According to the US Department of Transportation, “ride sharing is the alternative to driving to work alone (e.g. Carpooling). The fact that the illegal cab operators hijacked the ride sharing (http://bit.ly/1lmLlYJ) is despicable and gives their illicit activity a veneer of legality. Despite their illegal behavior, they’ve also attempted to have inoculated themselves PR wise by trumpeting the “sharing economy” and painting the legacy providers as greedy obstructionist monopolists. The fact that few have questioned (http://bit.ly/1eO5wjQ) the hijacking of the term ride sharing has allowed the illegals to take the high ground and declare that their opponents are against “sharing.” It is critical that the entire ground transportation industry be made aware and come together to combat the illegals. What the Taxi & Limo Industry Can Learn from Napster’s Demise? Waiting for the local regulator to enforce existing laws is a losing proposition in the short run. The ground transportation industry has to be on the attack and can learn from the three main things that the entertainment industry did to kill Napster. I. Win in media: Napster was “stealing” and so are these illegal cab operators We need to rally the industry to stop people from calling it ride sharing and instead calling it illegal taxis & wage theft Every media article should be responded to by the industry to fix this misclassification Copyright Taxistory.it Il blog di illegalcab.org (dedicato agli “amici” giornalisti) | 5 The conversation should focus on the “wage theft” occurring between the illegal operators from the legal ones II. Win in court: Uber’s founder was sued for $250 billion (which ultimately killed his last company) There are dozens of lawsuits against Uber & Lyft Given the wide scale and institutionalized illegal activity promulgated by both companies, Lyft and Uber have significant liability exposure Suing the local regulator for equal protection under the law has also forced action in some municipalities Track Illegal Cab Activity @ IllegalCabMap.org – Tracking illegal activity across the world will help support cases III. Punish individual accomplices: Heavy Individual Illegal Napster Users were punished with million dollar plus fines & jail time With no downside risk (as Uber pays their fines), these illegal cab operators are acting with impunity Therefore we need to punish the illegal cab drivers as well Only in markets where the individual drivers’ cars were impounded did it stop Uber from acting illegally (as they couldn’t find drivers to prop up their illicit scheme) Rally the industry behind Reporting illegal cab drivers & nullify their personal insurance. Operating a commercial vehicle and violating the terms of conditions of their personal insurance, makes their insurance null and void and exposes them to insurance fraud.Enough reports to the state will force the insurance fraud investigation units to do something about it. Sue individual drivers for reckless endangerment, and fraud. Given the lack of regulatory enforcement, it is critical that the industry take control of the situation and force these “free riding” illegal drivers to pay the price for their illicit gains Copyright Taxistory.it Il blog di illegalcab.org (dedicato agli “amici” giornalisti) | 6 Although it is harsh, punishing Uber’s accomplices will quickly put an end to their supply of illegal cab operators Would love to hear more ideas or feedback @ [email protected] 1 note Illegalcab.org Blog Il Napster dell’industria Taxi immagine Vai a IllegalCab.org per ulteriori informazioni e registrati per ricevere aggiornamenti!
