We left off in the previous
article with a final quip aimed at
summing up a controversial
technical/political concept:
smoking is bad for you,
games, if they are games, are
good!
We are now in mid
January and the same
sentence has become
the most debated news
of the start of the year.
As is now well known,
also to our European
colleagues, since 10
January an Italian law
has been passed banning smoking in all public
areas and work places,
with the exception of special spaces fitted with the
air filtering equipment based
on the very restrictive technical
parameters contained in the
Ministerial Decree of 23 December
2003.
It is clear that for an ex-smoker
such as myself, who had the good
luck of feeling bad while still young
and being forced to give up the vice
(for others) and has since carefully
had to avoid all smoky places, it has
been good to finally be able to enter
a pub at midnight for a nice beer
without worrying about smoke intoxication. However this opinion is not
shared, for example, by a certain
Davide, manager of two bowling centres, who has already seen a significant drop in earnings.
In vain I tried to convince him
that the western world is increasingly
being populated by “non smokers”,
and that therefore, in order to bring
new customers, he should exploit
this period by adequately promoting
his centre with slogans such as “no
smoke, just fun” or “a chocolate after
a cup coffee and you’ll live to a hundred”, or “our sandwiches are ham,
not nicotine”, etc., etc., and at the
same time by activiting strategies to
help out the heavier smokers.
To tell the truth, I have always
been convinced of this, and therefore
I’ve welcomed the passing of the
Sirchia law on smoking not only for
my health, but also because I am
sure that, in the not too distant future,
our businesses will benefit from it.
It is obvious that this assumption
will only be proven further down the
track. In fact, it may seem paradoxical: smoking and gambling have
always gone hand in hand, and
imagining separating the two without
negative economic consequences
might seem heresy.
However, there is a difference
between two combinations: gambling-smoking, and amusement
games-smoking. In my opinion, the
most serious “immediate” problems
will affect the 4 casinos and 300
bingo halls where the players are

naturally obliged to remain seated
for hours and hours in the same
room (we are speaking about gamblers, and therefore professionals),
while the players of our paragraph 6,
7a and 7c machines are looking
more for entertainment and temporary amusement, and therefore can
easily find the time to go outside the
venue and smoke a cigarette without
worrying that the next player may
gain advantage from their leaving
the machine momentarily.
This, at least, is my opinion and,
as a result, I have managed to convince various managers of places
where my games are installed to fit
2/3 gas heaters and special gazebos
outside, so as to create places for
people to smoke and meet. It is a
gamble together with my clients: I
am sure we will win, even if at present, one week after the law has
entered into force, my optimistic
forecasts have been miserably contradicted.
To tell the truth, however, it
would be too simple to blame the
decrease in earnings only on the
banning of smoking in public premises; here in the north of Italy, we have
just seen 10 days of thick fog, and
with the last sales now over, the
money we have jealously saved in a
year’s work has finished, and so we
have to evaluate various factors
together.
The advantages of banning
smoking also include the increase in
the safety of our premises, as some
more dodgy characters don’t like
staying for long periods without
smoking, and therefore one hopes
that they move to less controlled
environments, leaving room for families, young people and new customers.
To conclude this subject that, as
is clear, we all have our own opinions on, I would like to highlight a
typical vagueness of our legislators,
that, in any case, is trivial, as compared to the long debated haziness
of the word “predominant” related to
skill in our previous law.
The law, after having precisely
defined all the places where smoking is banned, including private
clubs, has an exception, reported in
the “Il Sole 24 ore” newspaper:
“smoking is allowed in private areas
or in special cases, such as those
where access is reserved for members only (but not with a card issued
to anyone who arrives); the area
must not be structured as a business
concern; the number of people who
access the place must not be significant; there must be no employees,
as the presence of such would
require the banning of smoking for
occupational health reasons.”
Incredible: these things can only
happen in Italy!

anche perché sono sicuro che, in
tempi non troppo lunghi, anche le
nostre attività ne trarranno dei vantaggi.
Ovvio che la dimostrazione della
mia teoria potrà avvenire solo col
tempo. Sembrerebbe infatti un paradosso: da che mondo è mondo, fumo
e gioco sono in simbiosi e pensare di
scollegare le due attività senza conseguenze economiche negative, sembrerebbe un’eresia.
Però c’è una differenza fra i binomi gioco d’azzardo-fumo, e gioco da
intrattenimento-fumo. Secondo me, i
problemi “immediati” più gravi li
dovrebbero avere i 4 casinò e i 300
bingo italiani dove i giocatori sono
naturalmente costretti a rimanere
seduti per ore ed ore nello stesso
posto (parliamo di giocatori d’azzardo, perciò professionisti del gioco). I
giocatori dei nostri comma 6, 7a e
7c, invece, sono decisamente più
votati al divertimento e all’intrattenimento temporaneo, per cui possono
tranquillamente trovare il tempo per
andarsene fuori dal locale a fumare
una sigaretta senza l’assillo che il
giocatore successivo possa trarre dei
vantaggi dal momentaneo abbandono dell’apparecchio.
Questo mio convincimento è così
forte che, sono riuscito a persuadere
anche diversi esercenti dei locali
dove ho collocato i miei giochi a
posizionare 2/3 funghi a gas ed appositi gazebo all’esterno, per creare dei
luoghi di fumo ed aggregazione. È
una scommessa con i miei esercenti:
sono certo di vincerla anche se, dopo
una sola settimana dall’entrata in
“Smoking
prohibited” sign.

Sarebbe tuttavia troppo semplicistico addossare tutte le colpe della
obiettiva riduzione degli incassi, alla
sola proibizione di fumare nei locali
pubblici; qui nel Nord stiamo vivendo 10 giorni di nebbia fittissima e
con gli ultimi “saldi” sono finiti
anche i “soldi” gelosamente risparmiati in un anno di lavoro per cui
occorre valutare diversi fattori congiunturali.
Fra i vantaggi del divieto di
fumare, c’è anche l’aumento della
sicurezza nei nostri locali, perché ad
alcuni personaggi, notoriamente
pericolosi, mal si conciliano lunghi
periodi di astinenza dal fumo per cui
si spera che vadano in ambienti
meno controllati lasciando spazio
alle famiglie, ai più giovani e ai
nuovi clienti.
Per chiudere questo argomento
che, come si può ben capire, lascerà
ognuno con le proprie convinzioni,
desidero evidenziare una curiosa
vaghezza tipica dei legislatori nostrani che comunque, dopo il nostro
“preponderante” (riferito all’abilità
dei giochi) è una sciocchezza.
La legge, dopo aver definito con
precisione tutti i locali dove è proibito fumare, quindi anche i circoli privati, mette in evidenza una eccezione
riportata da “Il Sole 24ore”: “si può
fumare solo in locali privati o in particolari casi, come in quelli dove
l’accesso è riservato ai soli soci (ma
non con tessera rilasciata a chiunque si presenti); il locale non deve
avere una complessità tale da dimostrare iniziativa imprenditoriale; il
numero delle persone che accedono
non deve essere rilevante; non vi
devono essere dipendenti, perché la
loro presenza obbligherebbe a
rispettare il divieto di fumo a tutela
della salute dei lavoratori.”
Incredibile: queste cose possono
succedere solo in Italia!

Con il sempre più utilizzato “voto
di fiducia”, tutti gli emendamenti

of confidence”, all the amendments
proposed by the government to
modify law 326 passed, while all
those presented by the business
associations, in particular those concerning the reduction of the PREU
tax, were already rejected in by the
budget commission.
Unfortunately, the way in which
these amendments are written is so
contorted that if a “normal” human
being doesn’t have them explained
by a legal expert such as, for example, our lawyer Massa, he will never
understand the major innovations
introduced into our sector by 4 additional lines to the original text.
It was sufficient in fact, to replace
in paragraph 3 and 4 of article 38 of
law 388 the words “paragraph 6”
with “paragraph 6 and 7”, to achieve
an apocalyptic change in the
required formalities to introduce
arcade video games onto the market.
These must in fact be previously
approved in the same way as the
paragraph 6 machines and, it
seems, are also to the controlled
with a remote connection.
In view of the bitter experience of
paragraph 6 machines, we hope a
more feasible solution will be found,
for example the installation of a black
box: at least from this point of view,
there will be advantages, given the
almost inexistent earnings of the current 7c machines against the astronomical taxes.
You can imagine the state of
mind of the businessman who, to get
the approval for distribution of an Out
Run 2P that costs around 18-20,000
euro, were forced to “lose” one
machine and leave it permanently
stored at the State Monopolies!
Having to divide this added cost
among the presumably few
machines that he will sell, how much
would the cost of this game to the
operators be increased?
We hope that the good sense of
the officers of the State Monopolies
will take them to a change meaning
that this is not required, even if the
procedure might be necessary for
some “home made inventions”.
What will happen now until the
return from Brussels of the technical
decree on the approvals if we can’t
find a suitable solution to achieve, in
the meantime, a sort of approval for
the distribution of the new games
and the operation of those for which
the approval was issued in 2004?
In the most optimistic cases, the
expectation is at least 3/4 months!
We hope, finally, the work produced by the Manufacturers Section
of SAPAR on the technical specifications of new types of entertainment
games with prizes, such as Skill with
Prize and ticket redemption games,
will be accepted by the relevant bodies and we have the rapid introduction in Italy of machines that are different from the current ones, to be
installed in the few games arcades

Purtroppo il modo con cui
vengono scritti questi emendamenti
è così contorto che se un essere
umano “normale” non si fa spiegare
il testo da un buon avvocato conoscitore della materia, come ad esempio
il nostro dott. Massa, non arriverà
mai a comprendere le grandi innovazioni introdotte nel nostro settore da
4 righe aggiunte al testo originario.
È stato sufficiente infatti, sostituire al comma 3 e 4 dell’articolo 38
della legge n. 388 le parole “comma
6” con “comma 6 e 7”, per ottenere
un apocalittico cambiamento delle
modalità di introduzione sul mercato
dei normali videogiochi da sala.
Dovranno infatti essere preventivamente omologati alla stessa stregua degli apparecchi comma 6 e,
pare, vadano anch’essi controllati a
distanza.
Certo che, vista l’amara esperienza degli apparecchi comma 6, sarà
auspicabile venga trovata una soluzione più realizzabile, quale ad
esempio l’installazione di una scatola nera: almeno da questo punto di
vista ne trarremo dei vantaggi visti
gli incassi, pressoché nulli, degli
attuali 7c a fronte di una tassazione,
a dir poco, astronomica.
Lascio immaginare lo stato
d’animo di quell’imprenditore che,
per ottenere il N.O. di Distribuzione
di una Out Run 2P che costerà i soliti 18/20.000 euro, fosse costretto a
“perdere” un esemplare per lasciarlo
perennemente in deposito presso i
Monopoli! Dovendo poi suddividere
questo costo aggiuntivo sui presumi-

bili pochi esemplari che si andrebbero a vendere, di quanto sarebbe maggiorato il prezzo di tale gioco destinato ai gestori?
Speriamo bene che il buon senso
dei funzionari dei Monopoli non
imponga ciò, semmai questo procedimento potrebbe essere applicato a
qualche “spiritosa invenzione” fatta
in casa.
Cosa succederà da oggi e fino al
ritorno da Bruxelles del Decreto
Tecnico di omologa se non si riuscirà a trovare un adeguato escamotage per ottenere, nel frattempo, uno
straccio di Nulla Osta per la distribuzione dei nuovi giochi e per la messa
in esercizio di quelli i cui Nulla Osta
sono stati rilasciati nel 2004?
Si parla, nel più ottimistico dei
casi, di almeno 3/4 mesi!
Speriamo infine, che quanto elaborato dalla Sezione Costruttori
della Sapar relativamente alle caratteristiche tecniche di nuove tipologie
di giochi da intrattenimento e a premio tipo le Skill with Prize e ticket
redemption, venga benevolmente
accolto dagli organi competenti e si
arrivi velocemente all’introduzione
anche in Italia di apparecchi diversi
dagli attuali, da installare nelle
poche sale giochi ancora rimaste in
esercizio.

Se questa Finanziaria non ha
certo favorito gli operatori dei videogiochi, i concessionari dei bingo italiani, penso, abbiano trascorso uno

My journalist friends at other
European magazines, when calling
me to wish me a Merry Christmas,
took the chance to ask me for information on the trend of the game in
Italy: imagine, with my gesticulating
English, the efforts I made to explain
by telephone how, in five days, the
House voted “yes” to coin-op games
in bingo halls, and immediately after
the Senate voted “no”, and this is
inexplicably absurd, considering the
parliamentary majority is the same!
I remember the enthusiasm on
22 December at the opening of a
new bingo hall in via Cola di Rienzo
in Rome, where I was kindly invited,
when, during the party, the splendid
Barbara Chiappini announced the
end of prohibition and the extension
to bingo halls of the rights of any
other bar in Italy: a legislative injustice had been resolved and finally,
these structures would begin to take
on the same characteristics as their
Spanish predecessors!
Unfortunately, no-one had
thought about the MP Buontempo
who, perhaps with a some justification, had imagined that this license
would have transformed the current
300 bingo halls into casinos, and
therefore with a surprise amendment, blocked the passage through
parliament. I say ‘with some justification’ because, with the usual imprecision, perhaps peppered with a little
of malice, the amendment that would
have introduced games with prizes
in bingo halls didn’t specify the type
of machine, nor the number. In other
words, it was not clear if the lobby of
licensees aimed to have a “certain
number of paragraph 6 machines” or
alternatively an undefined number of
professional slot machines.
Someone, in fact, justified the
“overturning” by the Senate as punishment against those who “want too
much” or simply revenge by those
who hadn’t taken part in the bingo
tender just because the installation
of games with prizes was banned in
bingo halls.
To conclude, whatever the opinion, the problems in Italy are solely
down to a political class that is inept
and incapable of handling a small
yet significant issue of bingo halls
with expertise and equality.

fossero stati 4 avrei brontolato).
Partenza da Livorno, arrivo a Nizza,

escursioni: S.Tropez, Cannes,
Montecarlo. Ovviamente la comitiva
si è subito divisa in due tronconi: gli
uomini nei vari casinò e le donne a
fare shopping. Complice una temperatura primaverile, abbiamo sfruttato
tutte le ore di sole per girovagare alla
ricerca delle cose che più ci attraevano. La prima sorpresa, a parte
Montecarlo, è stato l’innumerevole
quantità di casinò che ho trovato
nella zona: probabilmente era un bel
po’ di tempo che non andavo in
Francia, però ho capito perché la
legge contro l’azzardo è così feroce e
puntuale nella sua applicazione; il
Governo francese deve aver fatto una
scelta ben precisa: l’azzardo a me o
in luoghi controllati da me, e i videogiochi a voi, sembra quasi che il
ministro delle Finanze sia andato a
cena con l’amico Donatoni prima di
emanare le sue prescrizioni!
Questi casinò sono quasi tutti
uguali: moltissime slot-machine,
qualche gioco multiplayer come il
Derby Owners Club della Sega o
roulette con 10 touch screen e pochi
tavoli per i classici giochi da casinò,
segno questo che anche lì, come a
Venezia, i dirigenti di questi locali
hanno capito quali apparecchiature
possono offrire dell’intrattenimento
ai giocatori giustificando così, a loro
stessi, la perdita matematica di tanti
bei soldini.
A questo proposito vorrei far presente che, eccetto Montecarlo dove
si possono giocare anche 2 euro,
negli altri casinò la massima puntata
sulle slot è di 1 euro però la calca
maggiore, specie di donne che erano
in numero nettamente superiore agli
uomini, l’ho notata attorno alle slot
che funzionano a 0,10 o 0,20 euro
per partita!
Altro che le nostre comma 6
dove, nel rigioco, uno può scommettere 40, 50 volte di più!
A mio avviso le stiamo uccidendo e, masochisticamente, ci stiamo
auto-distruggendo con questa corsa

Forse stiamo ancora una volta
sbagliando tutto, noi dobbiamo ringraziare la Sorte e la Sapar per averci
dato qualcosa con cui lavorare, ma
questo “qualcosa” deve rimanere
nell’ambito dell’intrattenimento, se
sconfina con l’azzardo, prima o poi
anche il nostro Stato come qualsiasi
altro Stato al mondo, se lo prenderà
per sé e noi non faremo più neanche
i lavavetri!♠

things that interested us. The first
surprise, apart from Montecarlo, was
the large number of casinos I found: I
hadn’t been to France for a while,
however I understood why the law
against gambling is so strict and
applied so tightly; the French government must have made a precise
choice: gambling in controlled places
for us, and video games for you. It
seems almost as if the Minister of
Finance went to dinner with Donatoni
before issuing his requirements!
These casinos are almost all the
same: many slot machines, some
multi-player games such as the Sega
Derby Owners Club or roulettes with
10 touchscreens, and only few tables
for the classic casino games, a sign
that there too, like in Venice, the
managers of these structures have
understood what machines offer
entertainment to the players, thus
justifying for them the mathematical
certainty of losing so much money.
In this regard, I would like to point
out that, except for Montecarlo where
2 euro bets are possible, in the other
casinos the maximum bet on the slot
machines is 1 euro, however the
most popular machines, played
mostly by women who easily outnumbered the men, operated at a
cost of 0.10 or 0.20 euro per game!
Much different from our paragraph 6 machines where, in the
replay, players can bet 40, 50 times
more!
In my opinion we are masochistically self-destructing with this rush to
find the “vice” to be bled, and what’s
more, only to the advantage of the
State.
Perhaps we are once again getting it wrong, we must thank luck and
SAPAR for having given us something to work with, but this “something” must remain within the context
of entertainment, as if it becomes
gambling, sooner or later our government, like any other in the world, will
take it for itself and we won’t even
get a job as window cleaners!♠
