Le delegazioni finlandese e svedese hanno preannunciato il loro voto contrario sul progetto di risposta e hanno fatto le seguenti dichiarazioni: FI: "FI non ha obiezioni alla logica del progetto di risposta per quanto riguarda l'applicabilità del regolamento n. 1049/2001, articolo 4, paragrafo 1, lettera a). Tuttavia, sembrerebbe che la possibilità di accesso parziale a norma dell'articolo 4, paragrafo 6 del regolamento non sia stata approfonditamente esaminata." SE: "Dovrebbe essere concesso un ulteriore accesso parziale, per esempio ai punti 18, 25, 27, 34, 36 e 37, in quanto la loro divulgazione non arrecherebbe pregiudizio ad alcuno degli interessi tutelati a norma dell'articolo 4." 6212/10 buc/BAR/bp DG F2A 1 IT La maggioranza delle delegazioni ha convenuto di rendere pubblico il risultato della votazione. S'invita pertanto il Comitato dei Rappresentanti permanenti a suggerire che nella prossima sessione il Consiglio: - approvi, tra i punti "A", il progetto di risposta allegato al presente documento, con il voto contrario delle delegazioni finlandese e svedese; - decida di rendere pubblico il risultato della votazione. TO CONFIRMATORY APPLICATION No 05/c/01/10 made by Mr Alexander MacKenzie by e-mail on 8 February 2010, pursuant to Article 7(2) of Regulation (EC) No 1049/2001, for public access to document 14458/2/04 REV 2 (RESTREINT UE) The Council has considered this confirmatory application under Regulation (EC) No 1049/2001 (OJ L 145 of 31.5.2001, p. 43) and Annex II to the Council's Rules of Procedure (Council Decision 2009/937/EU, Official Journal L 325, 11.12.2009, p. 35) and has come to the following conclusion: 1. The applicant refers to document 14458/2/04 REV 2 (RESTREINT UE) which is a note from the EU Counter-Terrorism Coordinator and the Commission to the Political and Security Committee and contains an assessment of EU Counter-Terrorism Clauses. The public already had access to a partially declassified version of the document, 14458/2/04 REV 2 EXT 1, but the applicant, in his initial application, requested access to "as much declassified information as possible". 2. In its reply dated 4 February 2010, the General Secretariat refused full public access to this document pursuant to Article 4(1)(a), first and third indents of the Regulation (protection of the public interest with regard to public security and with regard to international relations). 3. Following the applicant's confirmatory application dated 8 February 2010, the Council has thoroughly examined the document and carried out internal consultations to ascertain the applicability of the above-mentioned exceptions to the parts retained. The Council has come to the conclusion set out below. 6212/10 ALLEGATO 3 DG F2A IT 4. Document 14458/2/04 REV 2 (RESTREINT UE) contains an assessment of the EU CounterTerrorism Clauses which the EU includes since September 2001 into all agreements with third countries. Certain still classified parts of the document discuss in detail the way in which the EU model counter-terrorism clauses are adapted in order to suit the specificities of the EU's relations with the third countries concerned. Furthermore, other classified parts of the document contain analyses and assessments of the counter-terrorism provisions included in already existing agreements as well as in agreements which are currently being negotiated. Releasing the concerned parts of the document to the public would not only prejudice the EU's position in its current negotiations with third countries on agreements which should include such counter-terrorism clauses but would also have an adverse effect in similar future negotiations. It would also be detrimental to the efforts undertaken by the EU to make specific counter-terrorism issues a key element of its relations with third countries. Furthermore, disclosure of the concerned parts of the document would breach the mutual confidence among the EU and its negotiating parties and thus seriously prejudice the relations between the European Union and the third parties concerned. 5. Full public access to document 14458/2/04 REV 2 must therefore be refused pursuant to the third indent of Article 4(1)(a) of the Regulation (protection of the public interest with regard to international relations). 6. However, in the light of the internal consultations referred to above, the Council has come to the conclusion that further partial access may be granted, in application of Article 4(6) of the Regulation, to the following additional parts of the document which are not covered by any of the exceptions under Regulation 1049/2001: - point 2 on page 2, points 6, 7 and 8 on pages 3 and 4, second sentence of point 12 and second and third sentence of point 13.
