Mississippi 2013 Legislation as of May 14, 2013
The Regular 2013 Session for the Mississippi General Assembly began in January 2013 and the
Session is now over. Below are the final updates on the bills of importance to the default
servicing community.
Bills that passed:
MS House Bill 928: This bill would allow scrivener’s affidavits to correct errors in instruments
affecting real estate. This bill was signed by the Governor and is now law. The act becomes
effective upon passage.

MS Senate Bill 2696: This bill revises various provisions of the Mississippi Safe Act. Some
changes include revision to the definition of certain terms, increase in the loan originator
license fee, deletion of certain license and renewal fees and revision of other examination fees
for mortgage brokers, lenders and loan originators, and the additional requirement for
licensees to maintain a journal of serviced loans. This bill was signed by the Governor and is
now law. The act takes effect on July 1, 2013.

MS Senate Bill 2111: Revises the manner in which notice of the expiration of the time to
redeem real property sold at a tax sale is made to the owner of the property if the owner is a
resident of the state of Mississippi. This bill was signed by the Governor and is now law. The
act takes effect on July 1, 2013.

MS House Bill 47: This bill would amend Mississippi Code related to the appointment of
freeholders in partition proceedings specifically requiring the appointment of one freeholder.
This bill passed the House but died in Senate Committee on March 5, 2013.

MS House Bill 209: This bill clarifies the identifying information that must be included on
instruments pertaining to real estate that are presented for recording. Specifically, the new
requirement is that instruments filed for record must also include the name, address, physical
mailing address and telephone number of every grantor, grantee, borrower, beneficiary,
trustee or other party to the instrument. This bill passed the House but died in Senate
Committee on March 5, 2013.

MS House Bill 468: This bill creates the Uniform Power of Attorney Act which clarifies all rules
and regulations surrounding the use of a Power of Attorney. This bill passed the House but
died in Senate Committee on March 5, 2013.

MS House Bill 1302: Codifies the duty of care of a possessor of real property to a trespasser.
This bill passed the House but died in Senate Committee.

MS House Bill 1481: Creates an additional fee for recording deeds and deeds of trust. The
funds will be used for the Mississippi Housing Loan Assistance Bond Sinking Fund. This bill died
in House committee.
