NOTICE OF RACE
PORTO CERVO 11th - 18th SEMPTEMBER
The Swan 45 World Championship 2016 is organized by the Yacht Club Costa
Smeralda (YCCS), in collaboration with the Nautor’s Swan.

2. RULES
2.1 International Sailing Federation Racing Rules of Sailing (RRS) 2013/2016.
2.2 The 2016 Swan 45 World Championship will take place within the Rolex Swan
Cup. The 2016 Swan 45 Class Rules shall apply to Class D, Swan 45 (see paragraph 5).
2.3 ISAF Offshore Special Regulations for Category 4. No white flares are required,
amending Special Regulation 4.23, jackstays are not required, amending Special
Regulation 4.04.
2.4 RRS 55 is in force.
2.5 The Sailing Instructions including all the appendices.
2.6 No National Authority prescriptions will apply except for Italian only: FIV
PRESCRIPTION PART 6, ENTRY AND QUALIFICATION Rule 75, ENTERING A RACE
Prescription to Rule 75.2.
2.7 The Registration Nationality of a boat is indicated by the owner of the boat as set out
in the entry form (FLAG section). If not indicated the sail number and/or the owner's
nationality will be used.
2.8 If there is a conflict between languages the English text will take precedence.
2.9 In the event of a discrepancy between the Notice of Race and the Sailing
Instructions, the Sailing Instructions take precedence. This changes rule 63.7.
3. ADVERTISING & IDENTIFICATION NUMBERS
3.1 In accordance with ISAF Regulation 20 Advertising Code for the Swan 45 Class,
advertising is permitted in accordance with the Swan 45 Class Rules. Boats shall display
Event Advertising in compliance with ISAF Regulation 20, Advertising Code, and as
detailed in the Sailing Instructions.
3.2 Boats will be required to display the Sponsor’s pennant on the backstay throughout
the period starting one hour after the completion of registration and ending one hour
after the finish of the last race of the regatta.
3.3 In addition boats will be required to display the event battle flag throughout the
same period but only while moored.
3.4 The Organizing Authority will supply the pennant and flag at registration.
3.5 Racing yachts shall display an identification number clearly on both lifelines. This
amends RRS 77. The identification numbers shall be collected at registration.
3.6 The Organizing Authority may also require the installation, at no cost to
competitors, of on board video cameras for the official television production and/or a
tracking system.
3.7 Boats intending to display advertising during the regatta shall state in the entry form
the nature of such advertising.
3.8 Boats are responsible for informing advertisers and sponsors that no activities
advertising any brand will be permitted ashore within the Porto Cervo Marina Area
without the consent in writing of the Organizing Authority obtained before the start of
the Regatta.
3.9 Absence of identification numbers (paragraph 3.5), Class flags and/or decals may be
matter for action by the International Jury on report by the Race Committee or
Organizing Authority only. This amends RRS 60.1.
4. MEASUREMENT, CONTROL AND RATING COMMITTEE (MRC)
4.1 A Measurement and Rating Committee will be appointed. The MRC will conduct
measurement and other checks and will advise the Race Committee of any breach.
Depending on the breach, the Race Committee may protest the boat concerned.
The MRC will consist of one representative from:
a) The ORC Rating Office;
b) Nautor’s Swan;
c) The Yacht Club Costa Smeralda.
The MRC may, at its discretion, co-opt additional technical advisers.

4.2 Measurement checks on boats entered for racing will take place in Porto Cervo
Marina on Sunday 11h between 13.00 and 19.00 and Monday 12th September between
09.00 hrs and 16.00 hrs. Sails may need to be transported ashore to the space provided
for check measurement.
4.3 Competing boats will be checked at random during the event. In this respect, boats
may be boarded at any time by the MRC.
4.4 Infringements of the Swan 45 Class Rules may lead to the boat receiving place
penalties or disqualification. However, before such action is taken, the MRC shall make
a report to the International Jury who shall then proceed accordingly (RRS 78.3).
4.5 The Swan 45 teams will be weighed on Monday 12th September.
5. ELIGIBILITY & CREW
5.1 The regatta is open to all the Swan 45 OD.
5.2 The ISAF Eligibility Code, ISAF Regulation 19 shall apply. Crew lists and ISAF Sailor
IDs for all crew, as well as declarations of alternate, substitute and relief helmsmen shall
be submitted to the Swan 45 Class Manager no later than 20th August 2016 by email to:

5.3 Crew Lists will be displayed on the official notice board as soon as possible at the
close of Registration.
5.4 The Classification Protest Time Limit will be at the close of the scheduled official
protest time on the first day of racing.
5.5 A Representative of the ISAF Sailor Classification Commission will be present during
and after Registration to conduct spot checks of crew's classifications. Boat owners,
skippers or crew must check the Official Notice Board for names of crew required to
attend an interview and for further details. The ISAF Classification Representative may
change the status of any sailor after the appropriate interview with immediate effect.
6. ENTRIES
6.1 Entries shall be received by the Organizing Authority not later than 30th June 2016
and shall be made on the enclosed Entry Form (Annex 1) which shall be completed and
returned, by email or fax, to:

6.2 Entry Fee (mooring fees are included in the entry fee) for the Swan 45 is 1.200,00
Euro.
6.3 The non refundable entry fee shall accompany the entry form. The entry fee may be
paid by Credit Card (VISA or MASTERCARD) or by bank transfer as stated on detail in
the entry form. If payment is made by bank transfer, a copy of the transfer confirmation
is to accompany the entry form.
6.4 The Organizing Authority reserves the right to accept entries after 30th June 2016, on
payment of an additional fee (€ 500,00). No moorings can be assured for late entries.
7. MOORINGS
7.1 Moorings are included in the entry fee. The entry fee includes moorings from 12.00
hrs on Sunday 11th September to 12.00 hrs on Monday 19th September, provided that
the completed entry form and fee are received by the YCCS before 30th June 2016.
7.2 The cost of electricity, water charges, tenders as well as mooring fees for late entries
or additional periods are not included in the entry fee and must be paid directly to the
Marina Office.
The mooring place for any additional period (before and/or after the event) may be at
Porto Cervo Marina or East Dock (Porto Vecchio) and different from the mooring place
assigned by the Marina in conjunction with the Oganizing Authority during the event.
Assignment of moorings will be based on availability of moorings and characteristics of
boats.
7.3 To reserve moorings before and after the dates indicated in NoR 7.1 and for tenders
please send your mooring requirement to [email protected]. The YCCS Race Office will
take care to inform the Marina Harbour Master accordingly.

7.4 Local regulations require that all boats MUST inform the Harbourmaster’s Office by
radio on VHF Channel 9 when they first arrive in Porto Cervo and each time they leave
or enter the Harbour. Sailing is FORBIDDEN inside the harbor.

When moored, it is MANDATORY for all Participants to visit the Harbourmaster’s Office
to finalize their registration procedures.
8. REGISTRATION
8.1 The Regatta is open to all Swan 45 Class yachts as defined by the Swan 45 Class
Rules. The registration shall be completed with the Organizing Authority by 16.00 hrs
on Monday 12th September and the official forms will be provided by the Organizing
Authority and published on the YCCS web site.
All Swan 45s entering the World Championship shall have submitted:
a. A copy of the 2016 Swan 45 Class OD Certificate;
b. Evidence that Owner or Charterer Class Association fees have been paid;
c. If required, provide the Owner’s or Charterer’s evidence of membership of his or
her National Authority or of an organisation affiliated to it;
d. Sail declaration form signed by the Class Manager;
e. Their completed Swan 45 Class crew declaration form to the Class Manager by 20th
August 2016;
f. Completed pre-racing Crew Weighing.
g. Acceptance of the Notice, Disclaimer of liability of Race, Photography and TV rights
consent and Insurance third party liability as set out in the Entry Form;
h. Media Releases Consent form signed by all crew members;
i. Support boat declaration, if applicable, as stated in the entry form.
Boats not complying with the requirements of NoR 8 are not eligible for the event except
with the permission of the International Jury.
8.2 Crew Lists shall be submitted at final registration and shall include ISAF Sailor ID’s
for all crew and for Italian only the FIV card code.

9.2 The Organizing Authority and/or the Race Committee reserve the right to modify the
programme because of weather conditions or for any other reason.
10. SCORING
10.1 Twelve races are scheduled and one discard will be allowed in calculating overall
results if eight or more races are completed. Five races shall constitute a series. The
Island Race may not be a discard.
10.2 The Low Point Scoring System of RRS Appendix A (Paragraph A 4.1) shall apply.
10.3 For daily prizes, when two or more races are sailed on one day, the overall result
of the day will be determined by calculating the sum of the scores for each boat.
11. PENALTY SYSTEM
A boat that may have broken a rule of Part 2 while racing may take a penalty by taking a
One Turn penalty including one tack and one gybe. If a boat breaks a Rule of Part 2
within the two-lenghts zone of any rounding or passing mark, her penalty shall be a
Two Turn penalty.
12. PROTESTS & INTERNATIONAL JURY
12.1 Protests will be heard by an International Jury whose ruling shall be final.

12.2 A system of arbitration will be available and details will be contained in the Sailing
Instructions.
12.3 Members of the International Jury will be stationed at marks from time to time and
may give an indication to boats that they consider that there has been a breach of the
rules.
13. SAILING INSTRUCTIONS
The Sailing Instructions will be available upon final registration and published on the
YCCS website (www.yccs.com).
14. RACING AREA & COURSES
14.1 The racing area will be in North Eastern Sardinian waters. The following charts are
recommended: nos. 42 – 43 - 323 – 324 – 325 – 910, Italian charts of the Istituto
Idrografico della Marina. Charts can be ordered directly at:

14.2 The courses to be sailed will be Windward/ Leeward and Coastal courses laid
along the coast and among the islands in the vicinity of Porto Cervo.
15. ELECTRONIC AIDS
15.1 All types of electronic aids, including radar, VOR, satellite, etc., are permitted. No
external aids, outside assistance or information may be used during the races, except
publically available weather forecast information.
15.2 Yachts shall be equipped with VHF with channel 9, 16 and 72.
16. SECURITY
16.1 A Regatta wristband will be necessary to use the facilities within the regatta village
and also for access to all the regatta social events. This wristband is not transferable and
will be provided by the Organizing Authority upon registration.
16.2 Each Swan 45 will be allocated a number of wristbands as part of the entry fee
based on the crew list for the boat.
17. AMENDMENTS TO THIS NOTICE OF RACE
The Organizing Authority reserves the right to amend this Notice of Race. Any
amendments prior to 11h September 2016 will be emailed to owners whose entries have
been accepted. Amendments to this Notice of Race after September 11th 2016 will be
posted on the Official Notice Board, on the official website and copies will be available
from the Regatta Office.
18. DISCLAIMER
18.1 Competitors agree to be bound by the International Sailing Federation Racing Rules
of Sailing (RRS) 2013/2016, by the Sailing Instructions and the Notice of Race.
Competitors agree to take any and all responsibility for the nautical qualities of their
yacht, the rigging, the crew’s ability and the safety equipment. Competitors also agree to
take any and all responsibility for damages caused to third persons or their belongings,
to themselves or to their belongings, ashore and at sea as a consequence of their
participation in the regatta, relieving of any responsibility the Yacht Club Costa
Smeralda, and all persons involved in the organization under whatever qualification and
to accept full responsibility for the behaviour and dress of the yacht’s crew,
representatives and guests.
Competitors are to be acquainted with ISAF Part 1 Fundamental Rule 4: “The
responsibility for a boat’s decision to participate in a race or to continue racing is hers
alone”.
In any case Competitors agree that the Yacht Club Costa Smeralda, Nautor Holding, the
sponsors and their agents in particular Rolex SA have no responsibility for loss of life or
injury to members or others, or for the loss, or damage to any vessel or property.
18.2 As part of the registration process, each individual participating crew member will
be required to sign a declaration accepting this disclaimer of liability.
19. MEDIA RELEASES
Competitors grant Rolex SA, the Yacht Club Costa Smeralda, Nautor Holding and the
Organizing Authority the unrestricted right and permission to use the name and the
image for any text, photograph or video footage of either themselves or the yacht they

are sailing during the event, to be published or broadcast in any media whatsoever
(including but not limited to Press and TV advertisements, social media or Internet), for
either editorial or advertising purposes or to be used in press information; in this respect,
competitors’ name and biographical material may also be used or reproduced in any
way known.
As part of the registration process, each individual participating crew member will be
required to sign a declaration accepting this waiver of right.
20. INSURANCE
Each participating boat shall be insured with valid third party liability insurance with
adequate cover taking into account the value of the boats racing and the measure of
damages likely to arise in the event of an accident.
21. TROPHIES AND AWARDS
- The Swan 45 Gold Cup and Rolex Timepiece will be awarded to the first overall
classified boat. Trophies will also be awarded to the 1st, 2nd and 3rd classified Swan 45s;
- A Corinthian award will be presented to the top placed Swan 45 yacht that meets the
Corinthian requirements;
- Daily Prizes will be awarded for the first classified boat of each race for each day.
Where two or more races are sailed in one day the combined result will count for the
daily prizes.
22. SOCIAL EVENTS
A varied and interesting social programme is planned for the Regatta including crew
parties, cocktail receptions and an Owners’ Dinner. Full details will be listed on the
regatta website (www.yccs.com & www.nautorswan.com) as the event details are
finalised. The final schedule will be available at time of registration.

About the Swan Cup
Created in 1980, this biennial regatta attracts a spectacular fleet of yachts from around
the world and celebrates the enduring collaboration between Rolex, Nautor’s Swan and
Yacht Club Costa Smeralda. The 2016 edition marks a special milestone as Nautor
celebrates its 50th Anniversary year. In recent years the fleet has regularly topped 100
yachts ranging from 36 to 112 feet (11 to 35 metres) in length and spanning the entire
spectrum of the Nautor’s Swan family, from early designs by Sparkman and Stephens to
hi-tech one-Design craft of German Frers. The 2016 edition will once again play host to
the Swan 45 World Championship while the remainder of the fleet will be divided into
categories according to the size and age of the participating yachts. Drawing some of
the most beautiful Nautor’s Swan yachts – including many new models - and many of
the world’s top sailors , the Rolex Swan Cup provides a week of the spirited racing and
gala Social events for which Nautor's Swan, Rolex and YCCS are renowned.

7. It is possible to exercise your right in regards to the data controller at all times, in
accordance with article 7 of D.lgs.196/2003, which is reproduced in its entirety herewith:

Legislative Decree n.196/2003, Art. 7 – Right if access to personal data and other rights
1. L'interessato ha diritto di ottenere la conferma dell'esistenza o meno di dati personali che lo
riguardano, anche se non ancora registrati, e la loro comunicazione in forma intelligibile.
1. The individual concerned has the right to obtain confirmation of the existence of personal
data regarding him/her, even if not yet registered, and to receive them in a comprehensible
form.
2. L'interessato ha diritto di ottenere l'indicazione:
a) dell'origine dei dati personali;
b) delle finalità e modalità del trattamento;
c) della logica applicata in caso di trattamento effettuato con l'ausilio di strumenti
elettronici;
d) degli estremi identificativi del titolare, dei responsabili e del rappresentante designato ai
sensi dell'articolo 5, comma 2;
e) dei soggetti o delle categorie di soggetti ai quali i dati personali possono essere
comunicati o che possono venirne a conoscenza in qualità di rappresentante designato
nel territorio dello Stato, di responsabili o incaricati.
2. The individual concerned has the right to be informed of:
a) the origin of the personal data;
b) the means and purpose of the treatment;
c) the logic applied in the case of data treated using electronic equipment;
d) the identity of the data controller, the person in charge and the designated
representative in accordance with article 5, comma 2;
e) subjects or categories of subjects to which the personal data may be transmitted or
who may come to know of the data as representatives of the State, as managers or as
persons responsible.
3. L'interessato ha diritto di ottenere:
a) l'aggiornamento, la rettificazione ovvero, quando vi ha interesse, l'integrazione dei dati;
b) la cancellazione, la trasformazione in forma anonima o il blocco dei dati trattati in
violazione di legge, compresi quelli di cui non è necessaria la conservazione in
relazione agli scopi per i quali i dati sono stati raccolti o successivamente trattati;
c) l'attestazione che le operazioni di cui alle lettere a) e b) sono state portate a
conoscenza, anche per quanto riguarda il loro contenuto, di coloro ai quali i dati sono
stati comunicati o diffusi, eccettuato il caso in cui tale adempimento si rivela impossibile
o comporta un impiego di mezzi manifestamente sproporzionato rispetto al diritto
tutelato.
3. The individual concerned has the right to obtain:
a) updates, corrections or where appropriate, inclusion of data;
b) cancellation, transformation into an anonymous form or blocking of data held in
violation of the law, including data the conservation of which is not necessary in relation
to the ends for which such data was collected and successively treated;
c) certification that the operations outlined in a) and b) have been carried out including
content, subjects to whom the data had been transmitted or broadcast, except in the
case in which such operations are impossible or involve use of means clearly
disproportionate in relation to the rights to be protected
4. L'interessato ha diritto di opporsi, in tutto o in parte:
a) per motivi legittimi al trattamento dei dati personali che lo riguardano, ancorché
pertinenti allo scopo della raccolta;
b) al trattamento di dati personali che lo riguardano a fini di invio di materiale pubblicitario
o di vendita diretta o per il compimento di ricerche di mercato o di comunicazione
commerciale.
4. The individual concerned has the right to oppose, fully or partially:
a) for legitimate reasons, the treatment of personal data relating to him/her, even if
pertinent to the intended use;
b) the treatment of personal data relating to him/her for the purpose of sending advertising
material or direct sales or for market research or commercial communications.
