Se c’è un luogo ideale in cui praticare sport all’aria aperta, questo è indubbiamente Varese con il suo territorio. Qui i laghi, dove la barca a vela e il canottaggio trovano condizioni apprezzate perfino dalle squadre olimpiche dell’Australia e di diversi altri Stati che li scelgono per la loro preparazione, si combinano
con i percorsi tra le vallate prealpine, scenario di alcune delle più importanti competizioni internazionali
di ciclismo. Varese però significa, tra le tante altre opportunità che offre, anche un circuito di percorsi da
golf in cui praticare quest’attività sportiva con sullo sfondo le immagini di “sua maestà” Monte Rosa che
s’intersecano con quelle già richiamate della “Provincia dei Sette Laghi”. E in più le discipline dell’aria con
il volo a vela piuttosto che il deltaplano. Insomma, un ventaglio di possibilità grazie certamente a una natura favorevole, ma soprattutto ai servizi che le istituzioni hanno saputo offrire insieme allo spirito imprenditoriale di operatori capaci. Varese è quindi pronta ad accogliervi: fatevi avvolgere dal fascino di un

If you look for a great place to practice outdoor sports, this is undoubtedly Varese with its territory. Here, in the lakes, is where
sailing and canoeing find conditions that are appreciated even by the Olympic teams of Australia and several other Countries
that choose them for their training. The lakes are combined with routes between the pre-Alpine valleys, frame of some of the
major international cycling competitions. But Varese means, among many other opportunities that it offers, also a circuit of
golf courses, where to practice this sport with in the background the majesty of Monte Rosa, which intersect with those already
mentioned of “the Province of the Seven Lakes”. And in addition, the air sport of gliding rather than hang gliding. In short, a
range of possibilities certainly thanks to a favourable nature, but especially to the services that the institutions were able to
offer together with the entrepreneurial spirit of capable operators. Varese is therefore ready to welcome you: let yourself be enwrapped by the charm of an ideal place to practice outdoor sports!

h) Alberghi
Art. 108 - Ammissione all’albergo
Il contratto si considera concluso nel momento in cui l’albergatore aderisce alla richiesta fattagli ed accetta di riservare la camera ordinata dal cliente o da chi per lui.
Art. 109 - Prenotazione di camere – Disdette, mancato arrivo
Il cliente che prenota la camera (o le camere) s’impegna ad occuparla alla data convenuta. Ogni cliente deve precisare la data esatta dell’arrivo e della partenza, come pure
fornire le sue esatte generalità ed il suo indirizzo.
Le prenotazioni non garantite da caparra o carta di credito o altra forma di garanzia, le
prenotazioni verbali o telefoniche sono valide, in mancanza di conferma scritta, fino alle
ore 17 del giorno previsto per l’arrivo. Per arrivi previsti oltre le ore 17, la prenotazione deve essere preventivamente accettata dall’albergatore.
L’albergatore può esigere, a titolo di garanzia del pernottamento o del soggiorno, il versamento di una caparra o altre forme di deposito – per un importo non superiore ad
1/3 del servizio prenotato – nonché richiedere la comunicazione per iscritto degli estremi della carta di credito del prenotante.
Nel caso di prenotazioni di durata non superiore ai 3 giorni, salvo accordi diversi, il cliente ha diritto all’annullamento della prenotazione solo se comunica la rinuncia almeno 24
ore prima della data di arrivo fissata. In caso contrario l’albergatore ha diritto a trattenere la caparra versata o ad avvalersi del No Show, addebitando cioè, in caso di mancata presentazione del cliente entro i termini previsti, la carta di credito del prenotante
dell’importo corrispondente ad un pernottamento.
Nel caso di prenotazione di durata superiore ai 3 giorni, il cliente ha diritto all’annullamento ed alla restituzione della caparra solo se comunica la rinuncia in un tempo congruo, in relazione alla località ed al periodo stagionale. Salvo condizioni diverse previste
da accordi particolari tra le parti, i termini minimi che debbono essere rispettati dal
cliente per notificare l’annullamento sono:
- alberghi di vacanza, durante l’alta stagione 30 gg. prima della data d’arrivo; durante la
bassa stagione 15 gg. prima della data d’arrivo;
- in tutti gli altri alberghi, 7 gg. prima della data d’arrivo;
Le prenotazioni garantite si considerano annullate nel caso in cui il cliente non si presenti in albergo nel giorno stabilito entro le ore 24 e non ne abbia dato comunicazione,
salvo diverso accordo tra le parti. Negli alberghi che devono garantire il servizio notturno, la prenotazione è valida fino alle ore 10 del giorno successivo. L’albergatore ha
diritto, in questa ipotesi, di trattenere la somma versata a titolo di caparra o di avvalersi del No Show – addebitando la carta di credito del prenotante dell’importo equivalente al prezzo della camera prenotata e non occupata.
In caso di ritardo nell’arrivo sulla data stabilita, l’albergatore può trattenere sulla somma
anticipata l’importo corrispondente al prezzo della camera per ogni giorno che è stata
tenuta a disposizione del cliente.

Art. 110 - Condizioni di durata del contratto
a) La camera è a disposizione del cliente dalle ore 14 del giorno di arrivo e fino alle ore
12 del giorno di partenza. L’albergatore che non sia in grado di accettare la prenotazione deve avvertire il cliente purché sia in tempo per farlo.
Qualora per causa indipendente dalla propria volontà l’albergatore si trovi nell’impossibilità di rispettare l’accordo pattuito, propone al cliente analoga sistemazione in altro
esercizio di pari categoria, assumendo a proprio carico l’eventuale differenza di prezzo.
In caso di non accettazione da parte del cliente, l’albergatore è tenuto a restituire
l’eventuale caparra versata.
Il cliente che recede in anticipo dalla permanenza pattuita in albergo, escluso il caso di
forza maggiore documentata, paga all’albergatore la tariffa della camera per tutto il
periodo precisato nella prenotazione, salvo i casi di colpa attribuibili all’albergatore o ai
suoi preposti.
b) Il prezzo della camera viene conteggiato, in genere, per giornata. Il giorno dell’arrivo
è conteggiato per intero; quello della partenza non è conteggiato, purché sia stata annunciata in tempo e la camera venga liberata come indicato al precedente paragrafo a).
c) Ai clienti che esigono di prendere possesso della camera fin dal primo mattino del
loro arrivo, può essere richiesto il pagamento del prezzo per la notte precedente, se la
camera è stata tenuta a disposizione del cliente.
d) Il prezzo di una camera doppia assegnata a una persona non può superare quello della
camera singola, salvo espressa richiesta del cliente a cui deve essere comunicato il relativo prezzo. Nessun supplemento viene corrisposto per bambini che non utilizzano il
letto aggiunto.
Art. 111 - Prestazione di servizi extra
Non viene addebitato alcun supplemento al cliente per l’uso del frigobar (con esclusione dei prodotti consumati), della radio o filodiffusione, della TV, se facenti parte dell’attrezzatura della camera. Per ulteriori apparecchi non in dotazione alla camera, messi a
disposizione dall’albergatore su richiesta del cliente, può essere addebitato un supplemento preventivamente comunicato.
Art. 112 - Accettazione, permanenza, danni relativi ad animali
L’ammissione di animali in albergo è consentita previa autorizzazione dell’albergatore.
Questi, in caso di accettazione, può applicare per l’animale un supplemento preventivamente comunicato ed accettato dal cliente.
Il cliente custodisce l’animale accettato nella propria camera ed in condizioni tali da non
arrecare molestie o danni.
Fuori dalla camera il cane è dotato di museruola. E’ vietato far sostare gli animali nei
locali comuni dell'albergo (D.P.R. 23.6.1980 n° 237 e regolamenti comunali). Fanno eccezione i cani accompagnatori dei non vedenti.
Art. 113 - Pensione
La pensione è una convenzione tra il cliente e l’albergatore per l’alloggio e la somministrazione dei pasti.
I pasti che non sono stati serviti al cliente il giorno dell’arrivo vengono forniti, senza
pagamento ulteriore, il giorno della partenza.
Ai clienti in pensione non competono decurtazioni per i pasti non consumati in albergo.
Quando il cliente gode di “pensione completa” l’albergatore fornisce, in luogo del pasto
non consumato in albergo, un “cestino” contenente quanto necessario ad uso pasto,

sempre che il cliente richieda detta prestazione alternativa entro la sera precedente il
giorno della consumazione.
I pasti consumati da bambino fino a due anni non vengono computati, salvo che il cliente chieda l’uso della cucina. Per i bambini che dormono nella stessa camera di due adulti viene preventivamente concordato uno sconto, in relazione all’età, di almeno il 30% sul
prezzo della pensione.
Salvo diversa convenzione si intende:
a) pensione completa: il pernottamento e la somministrazione della prima colazione, del
pranzo e della cena;
b) mezza pensione: il pernottamento, la somministrazione della prima colazione e della
cena (in alternativa ed a richiesta il pranzo).
c) camera con prima colazione: il pernottamento con la prima colazione.
Si intende, inoltre, per i pasti:
- la prima colazione di tipo italiano (o continentale);
- pranzo (menu proposto);
- cena della sera (menu proposto).
Sono escluse dal prezzo pattuito le bevande in genere.
Detti pasti vengono consumati agli orari esposti nell’albergo e nei locali a questo scopo
adibiti. L’albergatore non è tenuto a somministrare i pasti fuori di detti orari e di detti
locali. Nel caso in cui ritenesse di farlo può chiedere un supplemento di prezzo.
Non sono accordate riduzioni per i pasti non consumati in albergo, salvo preavviso da
darsi entro le ore 9 antimeridiane.
La convenzione di “pensione” viene stipulata per un soggiorno di almeno tre giorni.
Art. 114 - Parcheggi
Non si applicano supplementi al cliente per l’utilizzo di parcheggio non custodito di pertinenza dell’esercizio alberghiero.
E’ applicato un supplemento per l’autorimessa o parcheggio custodito in misura non
superiore alle tariffe comunemente applicate.
Art. 115 - Pagamenti
I conti devono essere pagati dal cliente alla presentazione.
I pagamenti sono effettuati in valuta nazionale o (se ciò è stato preventivamente proposto ed accettato) in valuta straniera, assegni bancari (o circolari), buoni emessi da agenzia di viaggio, carte di credito o altre forme di pagamento.
L’albergatore, in caso di mancato pagamento del conto, oltre ad aver diritto alla risoluzione del contratto può ritenere beni ed oggetti portati dal cliente in albergo o nelle sue
dipendenze.
Art. 116 - Diritti e doveri delle parti
a) Il cliente:
- se accetta la camera, i pasti, la pensione ed altre prestazioni particolari dell’albergo,
senza essersi preventivamente informato del prezzo, accetta tacitamente le condizioni di
prezzo ufficiali;
- deve corrispondere un supplemento di spesa per il ricovero di automobili e per altri
servizi particolari da lui richiesti; deve corrispondere un supplemento per le prestazioni
particolari, come illuminazione per scopi speciali, installazione di videoregistratore, telefax, elaboratori elettronici, terminali di reti telematiche;
- deve assoggettarsi al divieto di cucinare in albergo;
- non può lavare e/o stirare indumenti nella camera dell’albergo.

b) L’albergatore:
- è in diritto di dare la precedenza ai clienti che si impegnino a consumare i pasti nell’albergo;
- ha facoltà di chiedere il pagamento anticipato delle sue prestazioni al cliente, in relazione alla richiesta di soggiorno;
- ha diritto di conteggiare un supplemento, se il cliente porta con sé alimenti o bevande
di normale consumazione nell’albergo;
- ha diritto di esigere la cessazione o l’attenuazione di ogni rumore anormale che possa
disturbare la clientela, compreso l’uso di apparecchi radio, televisori o strumenti musicali;
- ha diritto di recedere dal contratto in corso per qualsiasi infrazione al buon costume1.
Art. 117 Oggetti dimenticati
L’albergatore è tenuto a conservare gli oggetti dimenticati dal cliente per un massimo di
novanta giorni.
Art. 118 – Periodi di stagione
Nelle località ove sia d’uso praticare prezzi diversi, a seconda delle stagioni (alta, media,
bassa) l’albergatore, previa comunicazione al cliente, può praticare i prezzi massimi anche
in periodi non compresi nell’alta stagione, quando concorrano particolari circostanze:
ponti, festività, ecc., tali da conferire a questi periodi caratteristiche da alta stagione.

seguito per comodità si trascrivono e sono conformi alla convenzione europea sulla
responsabilità degli albergatori per le cose portate dai clienti in albergo (legge 10 giugno
1978 n° 316 e convenzione internazionale del 17 dicembre 1962):
Art. 1783 c.c. Responsabilità per le cose portate in albergo
Gli albergatori sono responsabili di ogni deterioramento, distruzione o sottrazione delle
cose portate dal cliente in albergo. Sono considerate cose portate in albergo: 1) le cose
che vi si trovano durante il tempo nel quale il cliente dispone dell'alloggio; 2) le cose di
cui l’albergatore, un membro della sua famiglia o un suo ausiliario assumono la custodia,
fuori dell’albergo, durante il periodo di tempo in cui il cliente dispone dell’alloggio; 3) le
cose di cui l’albergatore, un membro della sua famiglia o un suo ausiliario assumono la
custodia sia nell’albergo, sia fuori dell’albergo, durante un periodo di tempo ragionevole, precedente o successivo a quello in cui il cliente dispone dell’alloggio.
La responsabilità di cui al presente articolo è limitata al valore di quanto sia deteriorato, distrutto o sottratto, sino all’equivalente di cento volte il prezzo di locazione dell’alloggio per giornata.
Art. 1784 c.c. Responsabilità per le cose consegnate e obblighi
dell’albergatore
La responsabilità dell’albergatore è illimitata; 1) quando le cose gli sono state consegnate in custodia; 2) quando ha rifiutato di ricevere in custodia cose che aveva l’obbligo di
accettare.
L’albergatore ha l’obbligo di accettare le carte-valori, il denaro contante e gli oggetti di
valore; egli può rifiutarsi di riceverli soltanto se si tratti di oggetti pericolosi o che, tenuto

conto della importanza, e delle condizioni di gestione dell’albergo, abbiano valore eccessivo o natura ingombrante.
L’albergatore può esigere che la cosa consegnatagli sia contenuta in un involucro chiuso
o sigillato.
Art. 1785 c.c. Limiti di responsabilità
L’albergatore non è responsabile quando il deterioramento, la distruzione o la sottrazione sono dovuti: 1) al cliente, alle persone che l’accompagnano, che sono al suo servizio o che gli rendono visita; 2) a forza maggiore; 3) alla natura della cosa.
Art. 1785 bis c.c.Responsabilità per colpa dell’albergatore
L’albergatore è responsabile, senza che egli possa invocare il limite previsto dall’ultimo
comma dell’articolo 1783, quando il deterioramento, la distruzione o la sottrazione delle
cose portate dal cliente in albergo sono dovuti a colpa sua, dei membri della sua famiglia o dei suoi ausiliari.
Art. 1785 ter c.c. Obbligo di denuncia del danno
Fuori dal caso previsto dall’Art 1785 bis, il cliente non potrà valersi delle precedenti disposizioni se, dopo aver constatato il deterioramento, la distruzione o la sottrazione,
denunci il fatto all’albergatore con ritardo ingiustificato.
Art. 1785quater c.c. Nullità
Sono nulli i patti o le dichiarazioni tendenti ad escludere o a limitare preventivamente la
responsabilità dell’albergatore.
Art. 1785quinquies c.c. - Limiti di applicazione — Le disposizioni della presente sezione,
non si applicano ai veicoli, alle cose lasciate negli stessi, né agli animali vivi.
L’albergatore ha il privilegio sulle cose portate dal cliente in albergo e nelle dipendenze;
privilegio precisato dall’Art. 2760 cc. che recita:
Art. 2760 c.c. Crediti dell’albergatore
I crediti dell’albergatore per mercedi e somministrazioni verso le persone albergate
hanno privilegio sulle cose da queste portate nell’albergo e nelle dipendenze e che continuano a trovarvisi (c. 1783).
Il privilegio ha effetto anche in pregiudizio dei terzi che hanno diritto sulle cose stesse
a meno che l’albergatore fosse a conoscenza di tali diritti al tempo in cui le cose sono
state portate nell’albergo (c. 2778, n° 9).

h) Hotels
Art. 108 – Admission to the hotel
The contract is considered as stipulated when the hotelkeeper accepts the request
made and agrees to reserve the room ordered by the guest or by someone in its stead.
Art. 109 - Booking of rooms – Cancellations, No-Show
The guest booking the room (or rooms) commits to occupying it on the agreed date.
All guests must specify the exact date of checking-in and checking-out, as well as provide his personal particulars and address.
The bookings not guaranteed by a deposit or credit card or other type of guarantee,
verbal or telephonic bookings are valid, without written confirmation, until 5.00 p.m. on
the day envisaged for the checking-in. For check-ins envisaged after 5.00 p.m., the booking must be preventively accepted by the hotelkeeper.
The hotelkeeper, as a guarantee of the accommodation or stay, can demand a down payment or an advance or other form of deposit – for an amount not exceeding the value
of 1/3 of the service booked – as well as requesting communication in writing of the particulars of the booking party’s credit card.
In the case of bookings for a stay not exceeding 3 days, except in the case of other agreements, the guest has the right to cancel the booking only if communication of the waiver is made at least 24 hours before the date fixed for the checking-in. Otherwise, the
hotelkeeper has the right to retain the deposit paid or to take advantage of the NoShow, in other words, in case of the guest not showing up within the terms envisaged,
debiting the booking party’s credit card with the amount corresponding to an overnight
stay.
In the case of bookings relative to a duration exceeding 3 days, the guest has the right
to the cancellation and to the deposit’s refund only if the cancellation gets notified within
a reasonable time, in relation to the location and the seasonal period. Except for other
conditions envisaged by means of a specific agreement between the parties, the minimum terms to be complied with by the guest for notifying the cancellation are:
- holiday hotels, during high season, 30 days before the checking-in date; during low season, 15 days before the checking-in date;
- in all other hotels, 7 days before the checking-in date.
Guaranteed bookings are considered cancelled should the guest not show up at the
hotel on the expected day within 24 hours and without having given notice, except in
the case of a different agreement between the parties. In hotels that must guarantee
night service, the booking is valid until 10.00 a.m. of the next day. In this instance, the
hotelkeeper has the right to withhold- the amount paid as deposit or to take advantage
of No-Show – debiting the booking party’s credit card with an amount equivalent to the
price of the room booked and not occupied.
In case of delayed checking-in on the established day, the hotelkeeper will have the right

to withhold from the sum of the deposit the amount corresponding to the price of the
room for every day that the room was held at the guest’s disposal.
Art. 110 – Contract’s duration conditions
a) The room is made available to the guest from 2.00 p.m. on the day of checking-in, until
12.00 noon on the day of checking-out. The hotelkeeper unable to accept the booking
must notify the guest, as long as there is sufficient time in which to do so.
Should the hotelkeeper, for causes over which he has no control, be unable to honour
the agreed arrangements, he will have to propose a similar arrangement in another
hotel of the same category to the guest, absorbing the eventual difference in price. In
case of non acceptance by the guest, the hotelkeeper must refund the deposit possibly
paid.
The guest withdrawing in advance from the agreed stay in the hotel, with the exclusion
of cases of documented force majeure, shall pay the hotelkeeper the room tariff for the
whole period stated in the booking, except for cases where the fault is attributable to
the hotelkeeper or to his employees.
b) The price of the room is generally calculated per day.The day of checking-in is accounted for in full; that of the checking-out is not counted, on condition that this has been
announced in due time and the room vacated as indicated in the previous paragraph a).
c) Guests that intend occupying the room from early morning upon their checking-in,
can be asked payment of the price for the previous night, if the room was kept at the
guest’s disposal.
d) The price of a double room assigned to a single person cannot exceed that of the single room, except when the guest, who has been advised of the price, expressly requests
this. No extra charge is payable for children that do not utilise the additional bed.
Art. 111 – Provision of extra services
No extra charge is debited to the guest for using the mini-bar (except for products consumed), the radio or the cable-radio and TV if these are part of the room equipment.
For other appliances not part of the room’s equipment but made available by the hotelkeeper upon the guest’s request, a preventively notified extra charge may be levied.
Art. 112 - Acceptance, stay, damage caused by animals
The admission of animals to hotels is permitted by prior authorisation of the hotelkeeper. In case of acceptance, an extra charge could be levied for the animal, previously
agreed upon and accepted by the guest.
The guest will take care of the accepted animal in his room and in such manner as to
cause no disturbance or damage.
Outside of the room, dogs will have to wear a muzzle. It is forbidden to allow the animals into the hotel’s public areas (D.P.R. no. 237, dated 23.6.1980 and municipal regulations). Dogs accompanying the blind are an exception.
Art. 113 –Full Board
Full Board is an agreement between the guest and the hotelkeeper for lodging together
with the providing of meals (board).
Meals that were not provided to the guest upon the day of checking-in, will be served,
without further payment, on the day of checking-out.
The guests with full board will not receive discounts for possible meals not taken at the
hotel.

When the guest opts for “full board”, the hotelkeeper will provide, in place of meals not
taken at the hotel, a “hamper” containing the necessary for a take-away meal, always provided that the guest will have requested this alternative service by the evening prior to
the day on which the meal will be needed.
Meals for children under two years of age are not computed, unless the guest requires
the use of the kitchen. For children occupying the same room with two adults, a discount of at least 30% on the price of the board is preventively agreed upon, according to
the age of the children.
Except where different arrangements have been made, the following are intended:
a) Full board: accommodation and provision of breakfast, lunch and dinner;
b) Half board: accommodation and provision of breakfast and dinner (alternatively, and
on request, lunch).
c) Bed and breakfast: accommodation with breakfast.
Furthermore, as regards the meals, the following are intended:
- Italian-type breakfast (or continental);
- Lunch (menu proposed);
- Dinner (menu proposed).
The price quoted generally excludes drinks.
Meals are served at the times posted in the hotel and in the rooms appointed for this
purpose. The hotelkeeper is not obliged to serve meals outside of these times and in
rooms other then these. Should the hotelkeeper be prepared to do this, he is entitled
to charge extra.
No discounts are granted for meals not taken in the hotel, unless a notification of this
is given by 9.00 a. m.
The “full board” mode of accommodation is stipulated for a stay of at least three days.
Art. 114 - Parking
No extra charge is levied on the guest for the use of unattended parking facilities belonging to the hotel.
An extra charge is levied for the garage or attended parking at a figure not exceeding
the normally applied tariffs.
Art. 115 - Payments
The account must be paid by the guest on its presentation.
Payments should be made in national currency or (if this was preventively proposed and
accepted) in foreign currency, cheques, banker’s drafts (or bank draft), vouchers issued
by travel agencies, credit card or other methods of payment.
The hotelkeeper, in case of a default in a bill being paid, over and above having the right
to the cancellation of the contract, will be able to confiscate objects and goods brought
into the hotel or its outbuildings by the guest.
Art. 116 – Rights and duties of the parties
a) The guest:
- if he accepts the room, meals, board and other particular services of the hotel, without
having previously checked on the price, tacitly accepts the official price conditions;
- must pay an extra charge for the garaging of vehicles and for other particular services
requested;
- must pay an extra charge for particular services, such as lighting for special purposes,
installations such as video-recorder, telefax, computers and network terminals;

- must observe the ban on cooking in the hotel;
- cannot wash and/or iron clothes in the hotel room.
b) The hotelkeeper:
- has the right to give precedence to clients committed to taking meals in the hotel;
- has the right to request an advance payment from the guest for the hotel services, in
relation to the request for the stay;
has the right to levy an extra charge, if the guest takes in food and beverages which can
normally be had at the hotel;
has the right to demand the cessation or attenuation of every abnormal noise that could
disturb the guests, including the use of radios, television sets or musical instruments;
has the right to cancel the current contract for any violation of the public decency code1.
Art. 117 – Lost and found
The hotelkeeper is committed to holding objects forgotten by guests for a maximum of
ninety days.
Art. 118 – In-season periods
In locations where it is customary to charge different prices according to the seasons
(high, medium, low), by prior notification being given to the guest, the hotelkeeper can
also charge maximum prices during periods not included in the high season, in particular circumstances such as long week ends, public holidays, etc., giving such periods highseason characteristics.

take into the hotel are controlled as provided for by Articles 1783, 1784 and 1785 of the
civil code, which are transcribed hereunder for ease of consultation, and conform to the
European provisions on the responsibility of hotel keepers for items brought by guests
to hotels (law No.316, dated June 10, 1978 and international convention dated
December 17, 1962):
Art. 1783 of the civil code – Responsibilities for articles taken into
hotels — Hotelkeepers are responsible for any damage, destruction or theft of articles brought by guests into hotels. The following are considered as articles brought into
hotels: 1) Items left in rooms during the period in which the guest occupies the lodging;
2) Items for which the hotelkeeper, a member of his family or his employee assume
custody, outside of the hotel, during the period in which the guest occupies the lodging;
3) Items for which the hotelkeeper, a member of his family or his employee assume
custody both inside and outside the hotel, during the period in which the guest occupies the lodging.
The responsibility as provided for in the present article is limited to the value of whatever item was damaged, destroyed or stolen, up to an equivalent of one hundred times
the price of the lodging per day.
Art. 1784 of the civil code - Responsibility for items left in custody
and obligations of the hotelkeeper — The responsibility of the hotelkeeper is
unlimited: 1) when articles are entrusted for custody; 2) when he refuses to accept articles that he is obliged to accept.
The hotelkeeper has the obligation of accepting securities and valuables, cash money and
items of value; he can refuse to accept them only should they be classified as dangerous

objects or, taking into account their importance and the hotel’s management conditions,
should they have excessive value or be of an encumbering nature.
The hotelkeeper can demand that the item taken in custody be contained in closed or
sealed packaging.
Art. 1785 of the civil code - Responsibility limitations
The hotelkeeper is not held responsible when damage, destruction or theft are due to:
1) the guest, the persons accompanying the guest, at his service or visiting him; 2) force
majeure; 3) the intrinsic nature of the item.
Art. 1785 bis of the civil code - Responsibility for misdeed of the
hotelkeeper
The hotelkeeper is responsible, without being able to appeal to the limitation provided
for in the last clause of article 1783, when the damage, destruction or theft of the items
brought by the guest to the hotel are due to the hotelkeeper’s own fault, members of
his family or his employees.
Art. 1785 ter of the civil code - Obligation to report damage
Other than the case provided for in Art 1785 bis, the guest will not be able to count on
the previous provisions should he, after having become aware of the damage, destruction or the theft, report the fact to the hotelkeeper with unjustified delay.
Art. 1785 quater of the civil code - Nullity The pacts or declarations tending to exclude or preventively limit the responsibility of
the hotelkeeper are null and void.
Art. 1785 quinquies c.c. - Limits of application
The provisions of the present section are not applicable to vehicles, items left in vehicles, nor to live animals.
The hotelkeeper has precedence over the articles brought by guests to the hotel and
outbuildings; this is dealt with in Art. 2760 of the civil code, which states:
Art. 2760 of the civil code - Credits of the hotelkeeper
The credits of the hotelkeeper per compensations and services rendered towards persons hosted in the hotel, have precedence over the articles brought by these guests into
the hotel and its outbuildings and which have remained therein (c. 1783).
The precedence also has effect in detriment to third parties with rights over these selfsame articles, unless the hotelkeeper was aware of these rights at the time in which the
articles were brought to the hotel (c. 2778, no. 9).
