CONDIZIONI GENERALI DI VENDITA
GENERAL CONDITIONS OF SALE
1) CONSEGNA: la consegna della merce avviene secondo le modalità
concordate con la parte acquirente. La merce, anche se franco destino,
viaggia sempre a rischio e pericolo del committente;
1) DELIVERY: the goods will be delivered according to the agreements
with the buyer. The goods, even if delivered free to destination, are always
transported at the risk and peril of the consigner;
2) CONTESTAZIONI: qualunque tipo di contestazione è ammessa solo se
adeguatamente documentata, e se comunicata direttamente alla ditta
venditrice, pena la decadenza, a mezzo lettera raccomandata a.r. entro
OTTO giorni dal ricevimento della merce;
2) DISPUTES: any disputes or complaints will only be acknowledged if suitably
documented and communicated directly to the selling company, subject
to the loss of rights, by registered letter with return receipt within EIGHT days
of receiving the goods;
3) VIZI e DIFETTI: eventuali vizi e/o difformità della merce – ancora in
garanzia- obbligano il venditore solo alla riparazione della merce difettosa
o difforme, senza diritto per l’acquirente al risarcimento danni;
3) FLAWS AND FAULTS: any faults and/or difference in the goods, still under
guarantee, only oblige the seller to repair the goods that are faulty or
different, without the purchaser having any right to claim compensation for
damages;
4) RESTITUZIONI: eventuali restituzioni verranno accettate solo se autorizzate
direttamente e per iscritto dal venditore.
5) GARANZIA: il venditore si impegna a garantire il prodotto da vizi e/o difetti
del materiale o di lavorazione che si manifestino entro e non oltre 12 mesi
dalla consegna;
6) PAGAMENTI: il pagamento della fattura deve essere effettuato entro la
scadenza prevista . Scaduto il termine il venditore è autorizzata ad emettere
nota di addebito con spese senza preavviso e l’acquirente è tenuto a
corrispondere gli interessi di mora non inferiori ai tassi bancari correnti per il
credito commerciale ed a rimborsare le spese di incasso.
7) PROPRIETA’: la proprietà della merce passa al compratore a pagamento
completo ricevuto dal venditore;
8) FORO: Per qualsiasi contestazione o controversia qualunque sia il luogo
di consegna della merce o di pagamento, è competente solo il Foro di
Reggio Emilia;
9) Fatturazione: Controllare l’esatta intestazione della fattura e/o della
partita IVA. In caso di errore comunicarlo tempestivamente: diversamente
non ci riterremo obbligati in solido ex art.41 D.P.R. n.633/72;
10) Trattamento dei dati personali: In ottemperanza alla legge 31-12-1996
nr.675 “Tutela della Privacy” si comunica che il responsabile incaricato dei
dati personali è l’amministratore a ciò preposto.I dati acquisiti saranno
trattati secondo le disposizioni della legge 675/96
11) Agli effetti dell’art.1341 C.C. il compratore dichiara di avere preso
visione, di avere compreso e di accettare tutte le clausole suddette
4) RETURNS: any returns will only be accepted if authorised directly and in
writing by the seller.
5) WARRANTY: the seller undertakes to guarantee the product from defects
and / or defects of the material or work that occur no later than 12 months
from delivery;;
6) PAYMENTS: the invoice must be paid within the envisaged deadline. When
this term
has expired the seller is authorised to issue an invoice with expenses withot
prior warning and the purchaser must pay interest on arrears no lower than
the current
bank rate for commercial credit and reimburse the expenses for receipts.
7) PROPERTY: the property of the goods passes to the buyer when full
payment is received by the seller;
8) PLACE OF JURISDICTION: Any dispute, whatever the place of delivery of
the goods or payment, come under the sole jurisdiction of the Law Courts
of Reggio Emilia;
9) Invoicing: Check the exact heading of the invoice and/or the VAT n..In
the case of error please communicate this in good time: otherwise we will
not be considered joint obligor in accordance with Article 41 of Presidential
Decree D.P.R. n.633/72;
10) Processing personal data: in compliance with Act 31-12-1996 n.675
“Privacy Act” we inform you that the person responsible as controller of
the personal data is the director. The data collected will be processed in
accordance with the dispositions of Act 675/96
11) As a consequence of Article1341 of the Civil Code the buyer declares to
have examined, understood and to accept all of the above clauses.
