CONDIZIONI GENERALI DI VENDITA
1 - Il presente listino prezzi sostituisce ed annulla tutte le precedenti edizioni.
2 - I prezzi di listino, IVA esclusa, non sono impegnativi ed eventuali variazioni saranno comunicate.
3 - La merce viaggia a rischio e pericolo del Committente, anche se venduta franco destino. Il fatto che la merce sia venduta franco destino, non esonera il Committente dall’ anticipare, salvo chiederne il rimborso, le spese doganali, trasporto ecc. per lo svincolo in arrivo; in difetto le spese di sosta saranno tutte a suo carico.
Eventuali reclami debbono pervenire, entro otto giorni dell’arrivo della merce a destino.
Non si accettano merci di ritorno senza previa autorizzazione e queste, in ogni caso, debbono essere rese franco di porto fino ai nostri magazzini.
4 - Durante l’eventuale periodo di garanzia, che dovrà comunque essere preventivamente da noi esplicitamente accettato e confermato, verranno sostituiti gratuitamente a
franco nostro Stabilimento, quei pezzi che risultassero difettosi per accertati difetti di materiali e di lavorazione.
Non verrà da noi riconosciuta qualsiasi altra spesa relativa, alla sostituzione dei materiali, come spese di smontaggio e montaggio, trasporti, nonche’ rivalsedi danni, indennizzi
ecc. sia da parte del Committente sia da parte di terzi.
5 - Salvo i casi in cui la data delle consegne sia stata da parte nostra esplicitamente accettata come base essenziale del contratto, i ritardi nella consegna non daranno diritto
ad annullamenti dell’ordine, od a richiesta di risarcimento di danni; comunque i termini di consegna decorrono dal giorno di perfezionamento da parte del Committente di tutti
i suoi obblighi contrattuali. La mancata spedizione di una parte dell’ordine non può dar luogo ad alcuna contestazione.
6 - I pagamenti debbono essere fatti alla nostra sede, nei tempi pattuiti. In caso di ritardato pagamento verranno applicati gli interessi di mora in ragione dei tassi bancari
correnti.
7 - Il foro di Lecco ha competenza esclusiva per qualunque controversia possa insorgere (in relazione all’acquisto dei prodotti).

2 - Prices onto this list, VAT excluded, are not binding and any modification would be communicated by written

The fact, that delivery term is free house, does not relieve Buyer of advancing, repayment excepted, the customs or transport duties, etc. for arrival clearance; failing, demurrage costs will be all at buyer’s charge. Any claim should be raised within 8 days from goods arrival at destination.
No return of goods can be accepted without previous authorisation and, in any case, they should be shipped free to our warehouse.
4 - During the eventual warranty period, in any case, expressly accepted and confirmed by us, pieces, proved to have material or tooling defects, can be substituted free of
charge, ex works. No other expense concerning to materials substitution will be acknowledged, as mounting and dismounting costs, transports, as well as claim of damages,
etc. both by the side of buyer or third-party.
5 - Except cases where we have expressly accepted the delivery date as essential base of contract, delivery delays won’t raise the right to cancel order or to claim for damages;
in any case delivery terms start from the date Buyer executes all duties of contract. Lack of shipment of a part of the order can not justify any contestation.
6 - Payments should be settled to our legal address within agreed terms. In case of late payment, arrears interests will be calculated following up to date Bank rates.
7 - Lecco court of justice has exclusive competence in case of any contestation (concerning the purchase of products).

1 - Cette liste de prix remplace et annule toute précédente édition.
2 - Les prix tarif ici montrés, H.T., ne contraignent pas la Société, les possibles variations seront communiquées.
3 - La marchandise voyage aux risques et périls du Commettant, même si elle est vendue f.co domicile. Le fait que la marchandise soit rendue f.co domicile n’exonère pas le
Commettant d’avancer les frais de douane, transport, etc. pour l’arrivée de la marchandise, sauf en demander le remboursement; en défaut de ça les frais de stationnement
seront tous à sa charge. Les réclamations doivent être communiquées dans huit jours de la date d’arrivée à destination de la marchandise. Nous n’acceptons pas des retours
de marchandise sans autorisation préalable, en tout cas, le retour sera rendu f.co notre domicile seulement.
4 - Pendant la durée de la période de garantie, qui nous aurons préalablement et explicitement acceptée et confirmée, nous remplacerons à titre gracieux, f.co notre domicile,
les pièces dont nous pourrons vérifier la défectuosité de matériaux et/ou outillage.
Nous ne pourrons pas reconnaître aucun autre frais concernant le remplacement des matériaux, les frais de démontage et montage, transports, ou retraites de dommages,
indemnisations, etc. soit de la part du Commettant ou de la part de tiers.
5 - Sauf dans les cas où la date de livraison a été explicitement acceptée de notre part tel que base essentielle du contrat, les retards de livraison ne donnent pas le droit d’annuler la commande ou à une demande d’indemnisation de dommages ; en tous cas, les termes de livraisons prennent effet du jour de la réalisation de toutes les obligations
contractuelles de la part du Commettant. Le manque de livraison d’une partie de la commande ne peut pas donner lieu à contestation.
6 - Les paiements doivent être faits à notre siège, dans les temps établis. En cas de paiement en retard, les intérêts de retard seront débités selon les taux bancaires courants.
7 - Pour toute contestation pouvant survenir (pour ce qui concerne l’achat des produits), attribution exclusive est faite aux Tribunaux de Lecco.

3 - Die Ware wird auf Risiko und Gefahr des Auftraggebers versandt. Dies gilt auch bei Preisstellungen frei Haus. Eine Freihaus-Lieferung befreit den Auftraggeber nicht von der
Vorauszahlung der Zollgebühren, Transportkosten usv. zur zollamtlichen Freischreibung, vorbehaltlich der Rückerstattung; andernfalls gehen die Standgelder voll zu dessen
Lasten. Reklamationen sind innerhalb von acht Tagen nach Ankunft der Ware am Bestimmungsort einzureichen. Warenrücksendungen bedürfen der vorherige Genehmigung
und müssen frachtfrei an unsere Lagerhäuser erfolgen.
4 - In der von uns ausdrücklich ausgewiesen und bestätigten Garantiezeit werden muß, werden schadhafte Teile, die erwiesenermaßen auf Material- und Herstellungsfehler

5 - Soweit das Lieferdatum von uns ausdrücklich als Vertragsgrundlage akeptiert wurde, berechtigen Lieferverzögerungen nicht zu Auftragsannullierungen oder Schadensersatzforderungen. Die Lieferzeit läuft in jedem Fall ab dem Tag, an dem der Auftraggeber seinen Vertragsverpflichtungen vollständig nachgekommen ist. Die Nichtlieferung
eines Teils der Bestellung berechtigt nicht zu Beanstandungen irgendeiner Art.
6 - Die Zahlungen sind innerhalb der vereinbarten Fristen an unseren Geschäftssitz zu richten. Bei Zahlungsverzögerungen werden Verzugszinsen in höheder gültigen
Bank-zinsen berechnet.
7 - Im Fall von Streitigkeit (bezüglich des Einkaufs den Produkten) ist Lecco der exclusive Gerichtsstand.

Per ordini inferiori a 500,00 euro netti la resa sarà franco nostro stabilimento (porto assegnato) o addebito in fattura di 25,00 euro.

Per ordini superiori a 1.000,00 euro netti, franco destino.
