By 2030 we’ll arrive at recycle of 70% of municipal waste and 80% of packaging waste, coming to the complete closure of landfills. The problem then is how to implement the provisions of the European community. To apply environmental legislation it should be drawn, in each case, a clear line between the two legal situations, deciding if the material in question is waste or not: and here lies the problem. In the Community legislation on waste, there is no legal definition of concepts such as “by-product” or “secondary raw material”: a material is a waste or not. The Court has repeatedly stated that the circumstances define a material as a waste or not, and therefore the competent authorities must decide on a case-by-case basis. It’s important to underline that, although a particular material (on the criteria defined by the Court) does not fall in the category of waste, if in practice its holder discards it, it must be considered and treated as waste. But when a product is waste? When the product is NOT directly sought by manufacturing process, it must be considered a production residue. When the product is the “result of a technical choice”, made directly to produce it, the result is not a production residue. The geographical areas considered are Northern Europe, Southern Europe, where it is included Italy, Central Europe, Eastern Alfredo Pollici Europe and UK-Ireland. In 2013 the market grew overall by 3.5%, led by plastic materials that had an increase of 5.9% while paper of 3.3%. The first quarter of 2014 registered a growth rate of 4.4% compared with the same period in 2013 as regards paper web labels, 9.5% growth for the plastic web labels. Southern Europe has had a growth in the quarter of 9.9% and finished ahead of Northern Europe (7.2%) and Eastern Europe (6.8%).
