LIMITI DI GARANZIA!
LIMITED WARRANTY!
Copertura della garanzia. La MIGLIORINO garantisce che il prodotto di sua
produzione, incluse tessere di mosaico, decori, bordure, piastrelle, pannelli ecc. (di
seguito “i Prodotti”), è esente da difetti nei materiali e nella fabbricazione.!
Beneficiari della garanzia. La presente garanzia è concessa esclusivamente a coloro
che acquistano i Prodotti da un rappresentante autorizzato MIGLIORINO o
direttamente dalla MIGLIORINO e a coloro che, in forza delle leggi statali vigenti,
hanno diritto alla garanzia in quanto terzi beneficiari (“L’Acquirente”).!
Periodo di validità della garanzia. La presente garanzia ha validità per un periodo di
diciotto (18) mesi a decorrere dalla data di installazione dei Prodotti, e comunque non
oltre due (2) anni dalla data dell’acquisto degli stessi.!
Procedura Reclami. L’Acquirente deve informare per iscritto la MIGLIORINO, tramite
raccomandata con ricevuta di ritorno, del difetto riscontrato nei Prodotti entro trenta
(30) giorni dall’avvenuta constatazione dello stesso e comunque non oltre il termine di
validità della presente garanzia. Il rispetto di tali tempi è tassativo. La notifica,
accompagnata dalla prova d’acquisto, deve essere inviata al seguente indirizzo: - via
Euripide, 40 - 76123 Andria (BT) - Italia. La copia della notifica può essere anticipata
via e- mail all’indirizzo: [email protected]. La MIGLIORINO, a sua
discrezione, può richiedere che l’Acquirente restituisca tutti i Prodotti difettosi. In ogni
caso i Prodotti non devono essere restituiti alla MIGLIORINO se non previa richiesta
scritta da parte della stessa.!
Gli impegni della MIGLIORINO. Qualora la MIGLIORINO accerti che i Prodotti sono
difettosi, si impegna, a sua scelta, a (i) sostituire gratuitamente i Prodotti difettosi, a
condizione che l’Acquirente si faccia carico delle eventuali spese di spedizione e dei
costi assicurativi e doganali; oppure (ii) a rimborsare all’Acquirente il prezzo pagato per
i Prodotti difettosi. In ambedue i casi, l’Acquirente è tenuto ad osservare la Procedura
Reclami descritta nel paragrafo precedente. La MIGLIORINO in ogni caso, oltre al
prezzo pagato per i Prodotti difettosi, non rimborserà null’altro all’Acquirente, come ad
esempio le spese sostenute per la posa dei Prodotti, per la loro correzione,
manutenzione, rimozione, sostituzione o le spese e i costi dei materiali occorrenti per la
eventuale diagnosi. La MIGLIORINO declina inoltre qualunque responsabilità in
relazione ad eventuali mutazioni di colori, tonalità o sfumature dei Prodotti causate da
macchie o contaminazione o da altri agenti esterni.!
Limiti della garanzia. La presente garanzia non copre difetti o danni (latenti o meno)
provocati da uso improprio, abuso, mancanza di cura o conservazione impropria; da
variazioni meteorologiche, temperature, acqua o agenti chimici; da grandine, impatto
con oggetti esterni, terremoti, uragani, cicloni, fulmini, inondazioni, tempeste o altre
cause di natura violenta o eventi di forza maggiore; da assestamenti, smottamenti,
distorsioni, cedimenti o fessurazioni nella struttura di supporto o nella base; da
esposizione ad agenti chimici dannosi; da danni occorsi durante il trasporto o la
manipolazione da parte dell’installatore o del fornitore; o da installazione impropria.!
È responsabilità dell’Acquirente consultare un tecnico o più tecnici specializzati sul tipo
specifico di installazione per la quale l’Acquirente intende utilizzare i Prodotti, al fine di
ottenere istruzioni e raccomandazioni circa il metodo, gli attrezzi e i materiali adatti per
l’installazione dei Prodotti (compresi, fra l’altro, la scelta e il metodo di applicazione di
prodotti adesivi e sigillanti per fughe). La MIGLIORINO non si assume alcuna
responsabilità in merito all’installazione dei Prodotti. Ogni riferimento ad istruzioni di
posa, strumenti di posa o materiali specifici nelle pubblicazioni MIGLIORINO, inclusi
cataloghi e sito web, sono da ritenersi indicativi e non devono in alcun modo essere
considerati come degli indicatori tecnici e specialistici sul tipo di installazione.!
La MIGLIORINO è presente soltanto nell’area di Andria – Italia e pertanto non è
presente nell’area dell’Acquirente. È responsabilità dell’Acquirente consultare un
tecnico che operi in loco al fine di ottenere quelle particolari istruzioni e
raccomandazioni di installazione e manutenzione che potrebbero essere utili in
relazione alle condizioni meteorologiche, temperature, qualità di acqua o agenti chimici
presenti nell’area dell’Acquirente.!
Unica ed esclusiva garanzia. QUESTA GARANZIA SOSTITUISCE
ESPRESSAMENTE QUALSIASI ALTRA GARANZIA, ESPRESSA O IMPLICITA, IVI
INCLUSA, NEI LIMITI CONSENTITI DALLA LEGGE, QUALSIASI GARANZIA SULLA
COMMERCIABILITÀ O SULLA IDONEITÀ DEI PRODOTTI AD UNO SCOPO
PARTICOLARE. LA MIGLIORINO NON LEGITTIMA, NÈ AUTORIZZA ALCUN
RIVENDITORE O CLIENTE AD ESTENDERE LA SUDDETTA GARANZIA O AD
AGGIUNGERE PARTICOLARI CLAUSOLE, OLTRE QUELLE RIPORTATE IN QUESTA
LETTERA DI GARANZIA. L’ACQUIRENTE NON POTRÀ RITENERE VALIDA ALCUNA
AFFERMAZIONE O ATTESTAZIONE RIGUARDANTE LA GARANZIA SUI PRODOTTI
DIVERSA DA QUELLE CONTENUTE IN QUESTA LETTERA DI GARANZIA, ANCHE
SE ESPRESSA DA UN RAPPRESENTANTE DELLA MIGLIORINO.!
Modifiche ai Prodotti. La MIGLIORINO si riserva il diritto di cessare o di modificare la
produzione dei Prodotti, compresi i colori degli stessi, senza l’obbligo di darne notizia
all’Acquirente, ed esclude pertanto eventuali responsabilità in merito.!
Legge applicabile, territorialità. Questa lettera di garanzia, la sua applicazione o la
sua interpretazione sarà sottoposta unicamente ai suoi termini e alla legge italiana,
senza che abbiano efficacia eventuali conflitti territoriali o di altre leggi applicabili ivi
inclusa la CISG. Tutte le dispute o controversie derivate o inerenti a questa lettera di
garanzia o la sua violazione saranno intentate esclusivamente davanti alla giurisdizione
competente presso il foro di Trani.
Limited Warranty Coverage. MIGLIORINO warrants that its mosaic tiles, including
mosaic decors, borders, tiles, panels etc. (“Product”) will be free of defects in materials
and workmanship.!
Limited Warranty Conditions. This limited warranty is provided exclusively to
purchasers of Product from a MIGLIORINO authorized agent or directly from
MIGLIORINO, and to all those who are entitled to the rely on this limited warranty by
applicable law as third party beneficiaries (“Purchaser”).!
Warranty Period. This limited warranty is provided for a period of eighteen (18) months
from the date of installation of the Product, but in no case shall this limited warranty
extend for longer than two (2) years from the date of purchase of the Product.!
Procedure for Claims. The Purchaser shall inform MIGLIORINO in writing, by
registered letter with advice of receipt, of any defect found in Product within thirty (30)
days since the defect was found and in any case within the duration of the warranty
period. No exceptions will be made to the above deadlines. The notice, together with
the proof of purchase, shall be sent to the following address: - via Euripide, 40 - 76123
Andria (BT) – Italy. Copy of notice can also be sent in advance by e-mail to the
following address: [email protected]. MIGLIORINO, at its discretion, may ask
the Purchaser to return all defective Product. In no case shall Product be returned to
MIGLIORINO unless so required by the latter in writing.!
MIGLIORINO Commitments. Should MIGLIORINO find Product to be defective, it
shall, at its option, either (i) replace the defective Product, provided however that the
Purchaser bears any shipment, insurance, and customs costs; or (ii) refund the price
paid for the defective Product to the Purchaser. In either case, the Purchaser shall
follow the procedure for claims described in the previous paragraph. In any case, no
other cost (e.g. cost of laying, fixing, maintaining, removing, replacing Product or any
other cost or expense for material required for diagnosing the defect) shall be refunded
by MIGLIORINO, except for the price of defective Product. Also, MIGLIORINO shall not
be held liable for any change in colors, hue, or shade of Product caused by stains or
contamination or external agents. !
Limited Warranty. This limited warranty does not cover any (either latent or otherwise)
product defects or damage caused by misuse, abuse, mishandling or improper
preservation; by weather changes, temperature, water or chemical agents; hail, impact
with external objects, earthquake, hurricane, tornadoes, lightning, flood, storms or
similar disaster or force majeure events; settling, landslide, warping, subsiding or
cracking of the supporting structure or of the base; exposure to harmful chemical
agents; damage occurred during transport or handling by the installer or the supplier;
improper installation.!
The Purchaser shall be responsible for consulting one or more skilled technicians as to
the specific type of installation where the Purchaser intends to use Product, in order to
acquire information about the most suitable methods, tools, and materials to install
Product (including but non limited to the selection and application method of glues and
seals for grout gaps). MIGLIORINO takes no responsibility whatsoever for the
installation of Product. Any and all reference to application instructions, tools or specific
materials contained in MIGLIORINO literature, including catalogues and the web site,
shall be deemed as a guide only, and never to be considered as technical and
specialist information on the type of installation.!
MIGLIORINO is present only in the area of Andria, Italy, therefore it may not be present
in the area of the Purchaser. It is therefore the Purchaser’s responsibility to contact a
local expert in order to obtain all specific instructions and installation and maintenance
tips that might be necessary with regard to the specific weather and temperature
conditions, water quality, or chemical agents that may be present in the Purchaser’s
area.!
Sole and Exclusive Warranty. THIS WARRANTY EXPRESSLY REPLACES ANY
OTHER EXPRESSED, OR IMPLIED WARRANTY INCLUDING – WITHIN THE
LIMITATIONS SET BY LAW – ANY WARRANTY ON THE POSSIBILITY TO SELL AND
APPLY PRODUCT FOR SPECIAL PURPOSES. MIGLIORINO DOES NOT
AUTHORIZE ANY RETAILER OR CUSTOMER TO EXTEND SAID WARRANTY OR
ADD ANY ADDITIONAL CLAUSES, EXCEPT FOR THOSE SPECIFIED IN THIS
WARRANTY. NO CLAIM OR STATEMENT ABOUT THE WARRANTY ON PRODUCTS
THAT IS DIFFERENT FROM THOSE CONTAINED IN THIS WARRANTY– EVEN IF
MADE BY A SICIS AGENT - CAN BE DEEMED TO BE VALID BY THE PURCHASER.!
Changes to Product. MIGLIORINO reserves the right to stop or make changes in the
manufacturing of Mosaics, including their colors, without any obligation whatsoever to
inform the Purchaser accordingly, therefore MIGLIORINO shall not be held liable for
that.!
Applicable Law; Jurisdiction. This limited warranty, its application, and construction
shall be governed exclusively by its terms and by the internal laws of Italy, without
giving effect to any of its conflict of laws provisions or CISG. Any dispute or difference
arising out of or relating to this limited warranty or its breach thereof shall be
commenced exclusively in the Courts of competent jurisdiction in the city of Trani, Italy.
